DECISION No 2/2012 OF THE JOINT COMMITTEE ON AGRICULTURE, CREATED BY THE AGREEMENT BETWEEN THE EUROPEAN COMMUNITY AND THE SWISS CONFEDERATION ON TRADE IN AGRICULTURAL PRODUCTS
of 3 May 2012
on the amendment of Annex 8 to the Agreement between the European Community, of the one part, and the Swiss Confederation, of the other, on trade in agricultural products

THE JOINT COMMITTEE ON AGRICULTURE,
Having regard to the Agreement between the European Community and the Swiss Confederation on trade in agricultural products (1) (hereinafter referred to as ‘the Agreement’), and in particular Article 11 thereof,
Whereas:
(1) |
The Agreement entered into force on 1 June 2002. |
(2) |
Annex 8 to the Agreement is aimed at facilitating and promoting the bilateral trade flows of spirit drinks and aromatised wine-based drinks and provides, by virtue of its Article 17(1) and (2) that the working group on spirit drinks shall meet at the request of one of the Parties with a view to examining any issue relating to its implementation and to make recommendations to the Committee. |
(3) |
The working group has met several times since the last update of Annex 8 to the Agreement in 2009, in particular to examine the need to update Annex 8, following the development of the Parties’ legislation and that of the protected denominations listed in its Appendices and has made recommendations. |
(4) |
To further the objectives of Annex 8, the recommendations made by the working group must be taken into consideration and Annex 8 to the Agreement must be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Annex 8 to the Agreement between the European Community and the Swiss Confederation on trade in agricultural products shall be amended as follows:

Article 6 shall be replaced by the following: ‘Article 6 The protection afforded by Article 5 shall also apply even where the true origin of the spirit drink or the aromatised drink is indicated, or where the designation is translated, transcribed or has been transliterated, or accompanied by terms such as “kind”, “type”, “style”, “way”, “imitation”, “method” or other analogous expressions, including graphic symbols which may lead to confusion.’ |
(2) |
Appendices 1, 2 and 5 of Annex 8 to the Agreement between the European Community and the Swiss Confederation on trade in agricultural products shall be replaced by Appendix 1, Appendix 2 and Appendix 5, respectively, in the Annex to this Decision. |
Article 2
This Decision shall enter into force the day following its adoption by the Joint Committee.

(1) The geographical indication “ Irish Whiskey/Uisce Beatha Eireannach/Irish Whisky ” covers whisky/whiskey produced in Ireland and Northern Ireland.
(2) Considering that “ Genièvre ” is a protected geographical indication in the European Union and that Switzerland has expressed its intention to protect the name “ Genièvre ” as a geographical indication on its territory, the European Union and Switzerland have agreed to include the name “ Genièvre ” in Appendices 1 and 2 of Annex 8.
The Parties undertake to reexamine the situation for this name in 2015 in light of the progress made in the protection of the name “ Genièvre ” as a geographical indication in Switzerland.
(3) Considering that “ Genièvre ” is a protected geographical indication in the European Union and that Switzerland has expressed its intention to protect the name “ Genièvre ” as a geographical indication on its territory, the European Union and Switzerland have agreed to include the name “ Genièvre ” in Appendices 1 and 2 of Annex 8.
