DECISION OF THE EEA JOINT COMMITTEE

No 77/2012

of 30 April 2012

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 35/2012 of 30 March 2012 (1).

(2)

Commission Decision 2011/93/EU of 10 February 2011 amending Decision 2009/821/EC as regards the lists of border inspection posts and veterinary units in Traces (2) is to be incorporated into the Agreement.

(3)

Commission Implementing Decision 2011/215/EU of 4 April 2011 implementing Council Directive 97/78/EC as regards transhipment at the border inspection post of introduction of consignments of products intended for import into the Union or for third countries (3) is to be incorporated into the Agreement.

(4)

Commission Implementing Decision 2011/394/EU of 1 July 2011 amending Decision 2009/821/EC as regards the list of border inspection posts and veterinary units in Traces (4) is to be incorporated into the Agreement.

(5)

Implementing Decision 2011/215/EU repeals Commission Decision 2000/25/EC (5) which is incorporated in the Agreement and which is consequently to be repealed under the Agreement.

(6)

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the Agreement. This Decision is therefore not to apply to Liechtenstein,

HAS ADOPTED THIS DECISION:

Article 1

Chapter I of Annex I to the Agreement shall be amended as follows:

(1)

the text of point 87 (Commission Decision 2000/25/EC) in Part 1.2 shall be deleted;

(2)

the following indents shall be added in point 39 (Commission Decision 2009/821/EC) in Part 1.2:

‘—

32011 D 0093: Commission Decision 2011/93/EU of 10 February 2011 (OJ L 37, 11.2.2011, p. 25),

32011 D 0394: Commission Implementing Decision 2011/394/EU of 1 July 2011 (OJ L 176, 5.7.2011, p. 45).’;

(3)

the following point shall be inserted after point 149 (Commission Delegated Regulation (EU) No 1152/2011) in Part 1.2:

‘150.

32011 D 0215: Commission Implementing Decision 2011/215/EU of 4 April 2011 implementing Council Directive 97/78/EC as regards transhipment at the border inspection post of introduction of consignments of products intended for import into the Union or for third countries (OJ L 90, 6.4.2011, p. 50).’.

Article 2

The texts of Decision 2011/93/EU and Implementing Decisions 2011/215/EU and 2011/394/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 1 May 2012, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
