    DECISION OF THE EEA JOINT COMMITTEE

    No 34/2008

    of 14 March 2008

    amending Annex XX (Environment) to the EEA Agreement

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

    Whereas:

    (1)

    Annex XX to the Agreement was amended by Decision of the EEA Joint Committee No 15/2008 of 1 February 2008 (1).

    (2)

    Commission Decision 2005/381/EC of 4 May 2005 establishing a questionnaire for reporting on the application of Directive 2003/87/EC of the European Parliament and of the Council establishing a scheme for greenhouse gas emission allowance trading within the Community and amending Council Directive 96/61/EC (2) is to be incorporated into the Agreement.

    (3)

    Commission Decision 2006/803/EC of 23 November 2006 amending Decision 2005/381/EC establishing a questionnaire for reporting on the application of Directive 2003/87/EC of the European Parliament and of the Council establishing a scheme for greenhouse gas emission allowance trading within the Community and amending Council Directive 96/61/EC (3) is to be incorporated into the Agreement,

    HAS DECIDED AS FOLLOWS:

    Article 1

    Annex XX to the Agreement shall be amended as follows:

    1)

    The following shall be added in point 1f (Council Directive 96/61/EC):

    ‘—

    32005 D 0381: Commission Decision 2005/381/EC of 4 May 2005 (OJ L 126, 19.5.2005, p. 43), as amended by:

    32006 D 0803: Commission Decision 2006/803/EC of 23 November 2006 (OJ L 329, 25.11.2006, p. 38).’

    2)

    The following point shall be inserted after point 21ao (Commission Decision 2006/780/EC):

    ‘21ap.

    32005 D 0381: Commission Decision 2005/381/EC of 4 May 2005 establishing a questionnaire for reporting on the application of Directive 2003/87/EC of the European Parliament and of the Council establishing a scheme for greenhouse gas emission allowance trading within the Community and amending Council Directive 96/61/EC (OJ L 126, 19.5.2005, p. 43), as amended by:

    32006 D 0803: Commission Decision 2006/803/EC of 23 November 2006 (OJ L 329, 25.11.2006, p. 38).

    The provisions of the Decision shall, for the purposes of this Agreement, be read with the following adaptation:

    Article 2 shall read:

    “The reports of the EFTA States, as far as an EFTA State is concerned, shall be submitted to the EFTA Surveillance Authority by 30 June each year and shall cover the preceding calendar year from 1 January to 31 December. The first report, covering the calendar year 2008, shall be due on 30 June 2009.” ’

    Article 2

    The texts of Decisions 2005/381/EC and 2006/803/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 15 March 2008, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
