No 147/2002

of 8 November 2002

amending Annex XX (Environment) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex XX to the Agreement was amended by Decision No 134/2002 of the EEA Joint Committee of 27 September 2002(1).

(2) Directive 2001/80/EC of the European Parliament and of the Council of 23 October 2001 on the limitation of emissions of certain pollutants into the air from large combustion plants(2) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Annex XX to the EEA Agreement shall be amended as follows:

1. the following indent shall be added in point 19 (Council Directive 88/609/EEC):

"- 32001 L 0080: Directive 2001/80/EC of the European Parliament and of the Council of 23 October 2001 (OJ L 309, 27.11.2001, p. 1).";

2. the adaptations of point 19 shall be replaced with the following:

"At the time of incorporation of the Directive into the Agreement, Iceland and Liechtenstein do not have in operation any large combustion plants as defined in Article 1. These states will comply with the Directive if and when they put in operation such plants.";

3. the following point shall be inserted after point 19 (Council Directive 88/609/EEC):

"19a. 32001 L 0080: Directive 2001/80/EC of the European Parliament and of the Council of 23 October 2001 on the limitation of emissions of certain pollutants into the air from large combustion plants (OJ L 309, 27.11.2001, p. 1).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptations:

At the time of incorporation of the Directive into the Agreement, Iceland and Liechtenstein do not have in operation any large combustion plants as defined in Article 1. These states will comply with the Directive if and when they put into operation such plants.";

4. the text of point 19 (Council Directive 88/609/EEC) shall be deleted with effect from 1 January 2008.

Article 2

The text of Directive 2001/80/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 9 November 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(3).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
