    No 171/2003

    of 5 December 2003

    amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

    Whereas:

    (1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 142/2003 of 7 November 2003(1).

    (2) Commission Directive 2003/40/EC of 16 May 2003 establishing the list, concentration limits and labelling requirements for the constituents of natural mineral waters and the conditions for using ozone-enriched air for the treatment of natural mineral waters and spring waters(2) is to be incorporated into the Agreement.

    (3) Commission Directive 2003/62/EC of 20 June 2003 amending Council Directives 86/362/EEC and 90/642/EEC in respect of maximum residue levels for hexaconazole, clofentezine, myclobutanyl and prochloraz(3) is to be incorporated into the Agreement.

    (4) Commission Directive 2003/60/EC of 18 June 2003 amending the Annexes to Council Directives 76/895/EEC, 86/362/EEC, 86/363/EEC and 90/642/EEC as regards the fixing of maximum levels for certain pesticide residues in and on cereals, foodstuffs of animal origin and certain products of plant origin, including fruit and vegetables(4) is to be incorporated into the Agreement,

    HAS DECIDED AS FOLLOWS:

    Article 1

    Chapter XII of Annex II to the Agreement is amended as follows:

    1. The following indent is added in points 13 (Council Directive 76/895/EEC) and 39 (Council Directive 86/363/EEC):

    "- 32003 L 0060: Commission Directive 2003/60/EC of 18 June 2003 (OJ L 155, 24.6.2003, p. 15)."

    2. The following indents are added in points 38 (Council Directive 86/362/EEC) and 54 (Council Directive 90/642/EEC):

    "- 32003 L 0060: Commission Directive 2003/60/EC of 18 June 2003 (OJ L 155, 24.6.2003, p. 15),

    - 32003 L 0062: Commission Directive 2003/62/EC of 20 June 2003 (OJ L 154, 21.6.2003, p. 70)."

    3. The following point is inserted after point 54zzg (Commission Regulation (EC) No 223/2003):

    "54zzh. 32003 L 0040: Commission Directive 2003/40/EC of 16 May 2003 establishing the list, concentration limits and labelling requirements for the constituents of natural mineral waters and the conditions for using ozone-enriched air for the treatment of natural mineral waters and spring waters (OJ L 126, 22.5.2003, p. 34)."

    Article 2

    The texts of Directives 2003/40/EC, 2003/60/EC and 2003/62/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 6 December 2003, provided that all the notifications in accordance with Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
