Directive 98/34/CE du Parlement européen et du Conseil du 22 juin 1998 prévoyant une procédure d'information dans le domaine des normes et réglementations techniques et des règles relatives aux services de la société de l'information (JO L 204 du 21.7.1998, p. 37; JO L 217 du 5.8.1998, p. 18).

Notifications de projets nationaux de règles techniques reçus par la Commission

La Commission attire l'attention sur l'arrêt "CIA Security" rendu le 30 avril 1996 dans l'affaire C-194/94 (Rec. 1996 I, p. 2201), aux termes duquel la Cour de justice considère que les articles 8 et 9 de la directive 98/34/CE (à l'époque 83/189/CEE) doivent être interprétés en ce sens que les particuliers peuvent s'en prévaloir devant le juge national, auquel il incombe de refuser d'appliquer une règle technique nationale qui n'a pas été notifiée conformément à la directive.

Cet arrêt confirme la communication de la Commission du 1er octobre 1986 (JO C 245 du 1.10.1986, p. 4).

Ainsi, la méconnaissance de l'obligation de notification entraîne l'inapplicabilité des règles techniques concernées, de sorte qu'elles ne peuvent être opposées aux particuliers.
