KOMISSION TÄYTÄNTÖÖNPANOPÄÄTÖS (EU) 2022/309,
annettu 24 päivänä helmikuuta 2022,
täytäntöönpanopäätöksen (EU) 2019/583 muuttamisesta tiettyjen ekoinnovaatioista saatujen hiilidioksidivähennysten huomioon ottamiseksi Daimler AG:n ja Daimler AG -yhteenliittymän keskimääräisten hiilidioksidipäästöjen laskennassa

EUROOPAN KOMISSIO, joka
ottaa huomioon Euroopan unionin toiminnasta tehdyn sopimuksen,
ottaa huomioon hiilidioksidipäästönormien asettamisesta uusille henkilöautoille ja uusille kevyille hyötyajoneuvoille ja asetusten (EY) N:o 443/2009 ja (EU) N:o 510/2011 kumoamisesta 17 päivänä huhtikuuta 2019 annetun Euroopan parlamentin ja neuvoston asetuksen (EU) 2019/631 (1) ja erityisesti sen 7 artiklan 5 kohdan toisen alakohdan,
sekä katsoo seuraavaa:

Unionin yleinen tuomioistuin kumosi asiassa T-359/19 (2) antamassaan tuomiossa komission täytäntöönpanoasetuksen (EU) 2019/583 (3) siltä osin kuin on kyse keskimääräisten hiilidioksidipäästöjen laskemisesta kalenterivuoden 2017 osalta sekä ekoinnovaatioista saaduista hiilidioksidivähennyksistä siten kuin ne on kirjattu kyseisen päätöksen liitteessä I olevaan taulukkoon 1 valmistajan Daimler AG:n osalta ja taulukkoon 2 Daimler AG -yhteenliittymän osalta. Sen vuoksi on aiheellista mukauttaa kyseisessä päätöksessä vahvistettuja arvoja.

Komission täytäntöönpanopäätöksen (EU) 2015/158 (4) mukaisesti sertifioidut ekoinnovaatioiden hiilidioksidivähennykset, joista jäsenvaltiot ovat ilmoittaneet ja jotka Daimler AG ja Daimler AG -yhteenliittymä ovat todentaneet, olisi otettava huomioon laskettaessa kyseisten yksiköiden keskimääräisiä päästöjä kalenterivuonna 2017.

Täytäntöönpanopäätökseen (EU) 2019/583 kirjattuihin ekoinnovaatioista saatuihin hiilidioksidivähennyksiin olisi sen vuoksi tehtävä korotus, joka on 0,292 g CO2/km Daimler AG:n ja Daimler AG -yhteenliittymän osalta.

Daimler AG:n ja Daimler AG -yhteenliittymälle täytäntöönpanopäätöksessä (EU) 2019/583 määritetyt keskimääräiset hiilidioksidipäästöt on laskettu uudelleen ottaen huomioon ekoinnovaatioista saatujen vähennysten lisäys. Tämän vuoksi on tarpeen mukauttaa asianomaisia kohtia.
