of 14 May 2024

amending Decision 2014/486/CFSP on the European Union Advisory Mission for Civilian Security Sector Reform Ukraine (EUAM Ukraine)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union and in particular Article 42(4) and Article 43(2) thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)

On 22 July 2014, the Council adopted Decision 2014/486/CFSP (1), which established the European Union Advisory Mission for Civilian Security Sector Reform Ukraine (EUAM Ukraine).

(2)

On 20 May 2021, the Council adopted Decision (CFSP) 2021/813 (2), which extended EUAM Ukraine until 31 May 2024.

(3)

On 23 February 2022, the Russian Federation launched an unprovoked and unjustified military aggression against Ukraine, which the European Council condemned in the strongest possible terms in its conclusions of 24 February 2022.

(4)

On 18 March 2022, the Council adopted Decision (CFSP) 2022/452 (3), which gave EUAM Ukraine the temporary additional task of advising Ukrainian authorities with the aim of facilitating the flow of refugees to Poland, Romania and Slovakia and the flow of humanitarian aid into Ukraine.

(5)

On 13 April 2022, the Council adopted Decision (CFSP) 2022/638 (4), which gave EUAM Ukraine the additional task to provide support to Ukrainian authorities to facilitate the investigation and prosecution of international crimes.

(6)

On 23 June 2022, Ukraine was granted the status of candidate to accession to the Union by the European Council.

On 11 December 2023, in its conclusions on civilian common security and defence policy (CSDP), the Council underlined the EU’s unwavering and long-term support for Ukraine. The Council stressed the importance of strengthening civilian CSDP support and rapidly responding to Ukraine’s growing needs as part of the EU’s wider efforts towards enhancing Ukraine’s security. The Council commended all of the work done by EUAM Ukraine, including the support to the reform of the Ukrainian security sector, integrated border management, as well as, in response to Russia’s war of aggression, the efforts made in the field of investigation and prosecution of international crimes and in re-establishing the rule of law in the Liberated and Adjacent Territories.

On 12 December 2023, recalling in the context of Russia’s war of aggression against Ukraine the Thessaloniki Agenda of 2003 and the European Council conclusions of June 2022, the Council confirmed its full and unequivocal commitment to the EU membership perspective of the Western Balkans, Ukraine, Moldova and Georgia, reiterating that their future lies within the European Union.

On 14 February 2024, in the context of the strategic review of EUAM Ukraine, the Political and Security Committee (PSC) agreed to extend the mission until 31 May 2027. On 19 March 2024, the PSC agreed to amend the mandate of the mission.

On 21 March 2024, the European Council in its conclusions stated that the European Union remains committed to supporting Ukraine’s repair, recovery and reconstruction, in coordination with international partners. The European Council welcomed the recent strengthening of EUAM Ukraine which will allow the scaling up of support for Ukrainian law enforcement agencies in Ukraine’s liberated and adjacent territories, and for reforms in the context of its EU accession process.

Decision 2014/486/CFSP should be amended to reflect the outcome of the strategic review of the mission.

(12)

EUAM Ukraine will be conducted in the context of a situation which may deteriorate and could impede the achievement of the objectives of the Union’s external action as set out in Article 21 of the Treaty,

HAS ADOPTED THIS DECISION:

Article 1

Decision 2014/486/CFSP is hereby amended as follows:

(1)

Article 2 is replaced by the following:

‘1.   EUAM Ukraine, as a non-executive civilian CSDP mission, shall aim to:

(a)

ensure the implementation of the Overarching Strategic Plan for the Reform of the Entire Law Enforcement Sector in Ukraine (OAS) and its Action Plan, and other relevant reforms across the civilian security sector, also with a view to combatting organised and transnational crime effectively, including in support of Ukraine’s accession-related commitments;

(b)

support the smooth re-establishment of the Ukrainian government functions and the rule of law in de-occupied areas, including with the aim of managing and reconciling social tensions, encouraging inclusive development;

(c)

support the development of effective capacities and capabilities for Ukraine’s Integrated Border Management with an emphasis on preventing and combatting all forms of smuggling;

(d)

contribute to the international efforts to ensure accountability for international crimes by providing support for their investigation and prosecution.

2.   For those purposes, EUAM Ukraine shall:

(a)

advise and mentor relevant Ukrainian authorities at central, regional and local levels in conducting and implementing civilian security sector reforms, with a central focus on the implementation of the OAS, including as regards reforms related to accession to the Union;

(b)

in support of the reform process, contribute to building the strategic and operational capacity and capabilities of the Ukrainian Law Enforcement Agencies, the Office of the Prosecutor General, the Security Service of Ukraine, and other relevant Ukrainian authorities;

(c)

support the restoration of a central, regional and local state presence and the civilian security sector functions in the de-occupied and adjacent territories;

(d)

provide strategic advice, mentoring and training for the reform of Ukraine’s Integrated Border Management, including on maritime aspects, contributing to combating all forms of smuggling, as well as border management-related corruption, organised crime and transnational crime;

(e)

support Ukrainian authorities to facilitate the investigation and prosecution of international crimes in accordance with Article 2a.’

(2)

In Article 2a, paragraph 2, point (c) is deleted.

(3)

Article 2b is deleted.

(4)

In Article 14(1), the following subparagraph is added:

‘The financial reference amount intended to cover the expenditure related to EUAM Ukraine for the period from 1 June 2024 to 31 May 2027 shall be EUR 122 900 000.’

(5)

Article 18 is replaced by the following:

‘A strategic assessment of EUAM Ukraine shall be conducted by 31 December 2025.’

(6)

In Article 19, the second paragraph is replaced by the following:

‘It shall apply until 31 May 2027.’

Article 2

Entry into force

This Decision shall enter into force on the day of its adoption.
