    Minutes of the sitting of 17 April 2023

    President

    1.   Resumption of the session

    The session adjourned on Thursday 30 March 2023 was resumed.

    2.   Opening of the sitting

    The sitting opened at 17.03.

    3.   Statements by the President

    The President pointed out that it had now been 20 days since Evan Gershkovich, a reporter for The Wall Street Journal, had been detained in Russia. She reiterated her call for his safe release and underlined Parliament's commitment to seeing him go free as quickly as possible.

    The President made a statement on the worrying condition of Alexei Navalny, a Russian opposition politician and Sakharov Prize laureate who was in prison in Russia. On behalf of Parliament, she reiterated her call for his immediate and unconditional release.

    The President went on to point out that, as Russia's illegal invasion of Ukraine continued, Russia had an obligation to ensure that prisoners of war were treated humanely and in accordance with the Geneva Convention. She emphasised that the perpetrators of war crimes would be brought to justice.

    The President made a statement on the worsening situation in Sudan, where violent clashes had caused many deaths and undermined efforts to ensure a democratic transition in the country. On behalf of Parliament, she strongly condemned the acts of violence and called on all parties to cease hostilities and ensure the safety of the entire population and the stability of the country.

    4.   Approval of the minutes of the previous sittings

    The minutes of the sittings of 29 March 2023 and 30 March 2023 were approved.

    5.   Composition of Parliament

    The Italian authorities had notified the President that Simona Baldassarre and Luisa Regimenti had been appointed assessors of the Region of Lazio, and that Pierfrancesco Majorino had been elected counsellor of the Region of Lombardy.

    Laura Huhtasaari had been elected to the Finnish Parliament with effect from 12 April 2023.

    Parliament noted that, in accordance with Article 7(2) and (3) of the Act of 20 September 1976 concerning the election of members of the European Parliament by direct universal suffrage, those offices were incompatible with that of member of the European Parliament.

    In accordance with Rule 4, Parliament declared that vacancies existed with effect from 3 April 2023, 4 April 2023, 5 April 2023 and 12 April 2023 respectively.

    The Italian authorities had given notice that Mercedes Bresso, Francesca Peppucci and Maria Veronica Rossi had been elected to the European Parliament replacing Pierfrancesco Majorino, Luisa Regimenti and Simona Baldassarre respectively with effect from 6 April 2023.

    The Finnish authorities had given notice that Pirkko Ruohonen-Lerner had been elected to the European Parliament replacing Laura Huhtasaari with effect from 12 April 2023.

    Parliament took due note of their election.

    Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made a written declaration stating that they did not hold any office incompatible with that of Member of the European Parliament, Mercedes Bresso, Francesca Peppucci, Maria Veronica Rossi et Pirkko Ruohonen-Lerner would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.

    6.   Request for the waiver of immunity

    The Belgian authorities had forwarded a request for the immunity of Alexis Georgoulis to be waived in connection with an investigation being conducted by the Public Prosecutor's Office attached to the Brussels Court of Appeal.

    Pursuant to Rule 9(1), the request had been referred to the committee responsible, in this case the JURI Committee.

    7.   Composition of political groups

    Teuvo Hakkarainen was no longer a member of the ID Group and had joined the ECR Group as of 6 April 2023.

    8.   Composition of committees and delegations

    The S&D and ID groups had notified the President of the following decisions changing the composition of the committees and delegations:

    The decisions took effect as of that day.

    9.   Interpretation of Rules of Procedure (action taken)

    The interpretation of Rule 9(6) provided by the AFCO Committee had been announced in plenary on 29 March 2023 (minutes of 29.3.2023, item 9).

    As it had not been contested by a political group or at least the threshold number of Members established in Rule 236(4), this interpretation was deemed to have been adopted (P9_TA(2023)0095).

    10.   Negotiations ahead of Parliament's first reading (Rule 71) (action taken)

    The decisions of the JURI and AGRI committees to enter into interinstitutional negotiations had been announced on 29 March 2023 (minutes of 29.3.2023, item 8).

    Since no requests for vote pursuant to Rule 71(2) had been received, the committees responsible had been able to begin negotiations upon expiry of the deadline set.

    On 19 April 2023, the President of Parliament, together with the President of the Council, would sign the following acts adopted under the ordinary legislative procedure:

    Regulation of the European Parliament and of the Council amending Regulation (EU) 2019/631 as regards strengthening the CO2 emission performance standards for new passenger cars and new light commercial vehicles in line with the Union's increased climate ambition (00066/2022/LEX — C9-0131/2023 — 2021/0197(COD));

    Regulation of the European Parliament and of the Council amending Regulation (EU) 2018/841 as regards the scope, simplifying the reporting and compliance rules, and setting out the targets of the Member States for 2030, and Regulation (EU) 2018/1999 as regards improvement in monitoring, reporting, tracking of progress and review (00075/2022/LEX — C9-0125/2023 — 2021/0201(COD));

    The final draft agenda for the plenary sittings of April 2023 (PE 746.423/PDOJ) had been made available to Members in accordance with Rule 157(3).

    The vote on the report by Biljana Borzan on ‘empowering consumers for the green transition’ (A9-0099/2023) (item 74 on the final draft agenda) was postponed to the May 2023 part-session.

    The statement by the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy on the situation in Peru (item 49 on the final draft agenda) was moved to the third item in the afternoon, after Question Time with the Commission (item 64 on the final draft agenda).

    Wednesday

    The item on ‘Iran, the case of Bernard Phelan and the case of Toomaj Salehi’ (item 81 on the final draft agenda) that had been scheduled for the debates on cases of breaches of human rights, democracy and the rule of law (Rule 144) was removed from the draft agenda.

    The House agreed to the proposals.

    Tuesday

    The PPE Group had requested that the Council and Commission statements on ‘the need for EU solidarity towards Italy facing an emergency situation due to the increased flows of migrants’ be added as the second item in the morning after the key debate (item 61 on the final draft agenda).

    The following spoke: Manfred Weber, on behalf of the PPE Group, who moved the request.

    The S&D, Verts/ALE and The Left groups requested that the Council and Commission statement on ‘the need for European solidarity in saving lives in the Mediterranean, in particular in Italy’ be added to the agenda, after the debate on the ‘Guidelines for the 2024 budget — Section III’ (item 31 on the final draft agenda). The sitting would be extended until 23.00 as a result.

    The following spoke: Iratxe García Pérez, on behalf of the S&D Group, who moved the request, Stéphane Séjourné, against both requests, and Manfred Weber, on behalf of the PPE Group, against the request made by the S&D, Verts/ALE and The Left groups.

    In a roll-call vote (151 in favour, 227 against, 5 abstentions), Parliament rejected the PPE Group's request.

    In a roll-call vote (252 in favour, 119 against, 13 abstentions), Parliament approved the request made by the S&D, Verts/ALE and The Left groups.

    The Council and Commission statements on ‘the need for European solidarity in saving lives in the Mediterranean, in particular in Italy’ were therefore added as the fourth item in the afternoon, after the debate on the ‘Guidelines for the 2024 budget — Section III’ (item 31 on the final draft agenda) and the sitting was extended until 23.00.

    The ECR Group requested that an oral question on ‘unjustified interference by the Commission in the chosen nature policy of a Member State’ be added to the agenda for the afternoon, after the debate on the ‘Guidelines for the 2024 budget — Section III’ (item 31 on the final draft agenda).

    The following spoke: Bert-Jan Ruissen, on behalf of the ECR Group, who moved the request.

    The PPE Group requested that a Commission statement on ‘unjustified interference by the Commission in the chosen nature policy of a Member State and the impact of the proposal for a regulation on nature restoration with regard to food and energy security’ be added to the agenda.

    The PPE Group requested that the debate on ‘Repression in Russia, in particular the cases of Vladimir Kara-Murza and Alexei Navalny’ be added as the second item in the debates on cases of breaches of human rights, democracy and the rule of law (Rule 144).
