1. Resumption of the session
The sitting opened at 17.00.
2. Approval of the minutes of the previous sitting
The minutes of the previous sitting were approved.
3. Interpretation of the Rules of Procedure
The President informed Parliament, pursuant to Rule 211(3), of the following interpretation of Rule 187, given by the Committee on Constitutional Affairs, to which the matter had been referred.
‧In the event that the seat of a full member of a committee falls vacant, a permanent substitute from the same political group shall be entitled to vote in place of the full member, on a temporary basis pending the provisional replacement of the full member in accordance with Rule 186(5), or, in the absence of such provisional replacement, pending the appointment of a new full member. Such entitlement is based on Parliament's decision concerning the numerical composition of the committee, and aims at ensuring that the number of members of the political group concerned who can take part in the vote is equal to the number entitled to do so before the seat fell vacant.‧
If this interpretation was not contested by a political group or by at least 40 Members (Rule 211(4)) before the opening of the following day's sitting, Tuesday 11 December 2012, it would be deemed to have been adopted. Otherwise, the matter would be put to the vote in Parliament.
4. Composition of Parliament
The Lithuanian authorities had given notice of the election of Justina Vitkauskaite to replace Viktor Uspaskich as Member of Parliament with effect from 21 November 2012.
The Bulgarian authorities had given notice of the election of Monika Hans Panayotova to replace Emil Stoyanov as Member of Parliament with effect from 6 December 2012.
Under Rule 3(2), until their credentials had been verified or a ruling had been given on any dispute, and provided they had signed a written declaration that they did not hold any office incompatible with that of Member of the European Parliament, Justina Vitkauskaite and Monika Hans Panayotova would take their seat in Parliament and on its bodies and enjoy all the rights attaching thereto.
5. Request for the waiver of parliamentary immunity
The French authorities had forwarded a request by the Principal State Prosecutor at the Court of Appeal of Lyons that Marine Le Pen's parliamentary immunity be waived.
Pursuant to Rule 6(2), the request had been referred to the committee responsible, the JURI Committee.
6. Composition of committees

12. Follow-up to a request for waiver of immunity
Following the European Parliament's decision of 23 October 2012 to waive the immunity of Martin Ehrenhauser in connection with legal proceedings before the Public Prosecutor's Office of Vienna (minutes of 23.10.2012, item 6.1), the competent Austrian authorities had notified Parliament, in accordance with Rule 7(9), that legal proceedings had ended.
That notification would be forwarded, for information, to the JURI Committee.
