Hagemann, lawyer, against Office for Harmonisation in the Internal Market (Trade Marks and Designs) (OHIM) (Agent: T. Eichenberg), the other party to the proceedings before the Board of Appeal of OHIM having been Anders + Kern Präsentationssysteme GmbH & Co. KG, established in Norderstedt (Germany) — action against the decision of the Fourth Board of Appeal of OHIM of 6 September 2004 (Case R 65/2003-4), concerning opposition proceedings between KOMSA Kommunikation Sachsen AG and Anders + Kern Präsentationssysteme GmbH & Co. KG — the Court of First Instance (First Chamber), composed of J. D. Cooke, President, R. García-Valdecasas and I. Labucka, Judges; H. Jung, Registrar, made an order on 1 July 2005, the operative part of which is as follows:
