Valero Jordana) v Kingdom of Spain (Agents: S. Ortiz Vaamonde) — the Court (Second Chamber), composed of: C.W.A. Timmermans, President of the Chamber, C. Gulmann, J.N. Cunha Rodrigues, R. Schintgen (Rapporteur) and F. Macken, Judges; L. Poiares Maduro, Advocate General; M. Múgica Arzamendi, Principal Administrator, for the Registrar, has given a judgment on 16 September 2004, in which it:

Declares that by failing to carry out an assessment of the effects on the environment of the ‘project for a Valencia-Tarragona railway line, Las Palmas-Oropesa section. Roadbed’, which forms part of the project known as the ‘Mediterranean corridor’, the Kingdom of Spain has failed to fulfil its obligations under Articles 2, 3, 5(2) and 6(2) of Council Directive 85/337/EEC of 27 June 1985 on the assessment of the effects of certain public and private projects on the environment; |

Orders the Kingdom of Spain to pay the costs. |
