    Notice to importers

    Regional cumulation between Indonesia and Sri Lanka, in accordance with Article 55(5) of Commission Delegated Regulation (EU) 2015/2446, as regards the rules of origin used for the purposes of the scheme of generalised tariff preferences pursuant to Delegated Regulation (EU) 2015/2446

    Following a request from Indonesia and Sri Lanka for benefitting from regional cumulation provided for in Article 55(5) of Commission Delegated Regulation (EU) 2015/2446 (1) (cumulation between countries of regional group I and regional group III, as defined in Article 55(1) (a) and (c) of that Regulation), the Commission has decided to grant this cumulation possibility.

    In accordance with Article 55(2)(a) of Delegated Regulation (EU) 2015/2446, this entitlement is conditional upon Sri Lanka and Indonesia remaining, at the time of exportation of the product to the Union, both beneficiary countries in the sense of Article 2(d), (e) and (f) of Regulation (EU) No 978/2012 of the European Parliament and of the Council (2), and that the rules of origin laid down in Subsection 2 of Delegated Regulation (EU) 2015/2446 apply.

    Scope

    Sri Lanka is entitled to use, in accordance with Article 55(5) of Delegated Regulation (EU) 2015/2446, textile materials listed in Table 1 originating in Indonesia under cumulation of origin, in order to produce and export to the Union under the GSP preferential rates the textile products listed in Table 2.

    Statements on origin

    Statements on origin made out by exporters in Sri Lanka with regard to products referred to in Table 2 shall bear the mention ‘Regional cumulation with Indonesia’ or ‘Cumul régional avec Indonésie’ or ‘Acumulación regional con Indonesia’ in the placeholder for the origin criterion in Annex 22-07 of Commission Implementing Regulation (EU) 2015/2447 (3).

    Application

    The products manufactured in Sri Lanka with application of regional cumulation subject to this notice shall benefit from the GSP scheme established by Regulation (EU) No 978/2012 when imported into the Union as of 8 August 2024 and until the date when the current GSP scheme ceases to apply in accordance with Article 43(3) of that Regulation.
