Legal basis: Orden no 5/2012, de 20 de marzo, de la Consejería de Industria, Innovación y Empleo, por la que se aprueban las bases reguladoras de concesión de subvenciones por la Agencia de Desarrollo Económico de La Rioja destinadas al fomento de la acuicultura y de la transformación y comercialización de los productos de la pesca y la acuicultura, en régimen de concesión directa (Boletín Oficial de La Rioja número 35, de 21 de marzo de 2012).

Motivation: Indicate why a State aid scheme has been established instead of assistance under the European Fisheries Fund: The subsidies provided for by Order No 5 of 20 March 2012 form part of the operational programme for the Spanish fisheries sector for the period 2007-2013, co-financed by the European Fisheries Fund.
However, the financial contributions made by the Agencia de Desarrollo Económico de La Rioja are expected to exceed those in the operational programme. We therefore take the view that Article 7(3) of Council Regulation (EC) No 1198/2006 of 27 July 2006 on the European Fisheries Fund applies and, consequently, Articles 87, 88 and 89 of the Treaty also apply.
