A4-0154/95 Proposal for a Council Directive on the use of vehicles hired without drivers for the carriage of goods by road (COM(95)0002 - C4-0097/95 - 95/0012(SYN)) The proposal was approved with the following amendments: (Amendment 1) Citation 3 >Original text> In cooperation with the European Parliament, >Text following EP vote> Acting in accordance with the procedure laid down in Article 189c of the Treaty, in cooperation with the European Parliament, (Amendment 2) Recital 5 >Original text> Whereas the carriage of goods in the single market should be facilitated; >Text following EP vote> Whereas the European Union's single market is an area in which goods, persons, services and capital may move freely; whereas, therefore, the carriage of goods in particular should also be liberalized in conjunction with a gradual harmonization of transport conditions; (Amendment 3) Recital 8a (new) >Text following EP vote> Whereas it is necessary to ensure that hiring vehicles without drivers does not lead to an increase in casual and undeclared employment; (Amendment 5) Recital 11a (new) >Text following EP vote> Whereas, in line with the priorities laid down in the White Paper (COM(92)0494) on the common transport policy, the Commission shall submit no later than 30 June 1996 a proposal for liberalizing the use of vehicles without drivers for the transport of passengers in other Member States; (Amendment 7) Article 2, second paragraph (new) >Text following EP vote> There shall be adequate penalties for the infringement of the above provisions. Legislative resolution embodying Parliament's opinion on the proposal for a Council Directive on the use of vehicles hired without drivers for the carriage of goods by road (COM(95)0002 - C4-0097/95 - 95/0012(SYN)) (Cooperation procedure: first reading) The European Parliament, - having regard to the Commission proposal to the Council, COM(95)0002 - 95/0012(SYN) ((OJ C 80, 1.4.1995, p. 9.)), - having been consulted by the Council pursuant to Articles 75 and 189c of the EC Treaty (C4-0097/95), - having regard to Rule 58 of its Rules of Procedure, - having regard to the report of the Committee on Transport and Tourism and the opinion of the Committee on Economic and Monetary Affairs and Industrial Policy (A4-0154/95), 1. Approves the Commission proposal, subject to Parliament's amendments; 2. Calls on the Commission to alter its proposal accordingly, pursuant to Article 189a(2) of the EC Treaty; 3. Calls on the Council to incorporate Parliament's amendments in the common position that it adopts in accordance with Article 189c(a) of the EC Treaty; 4. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal; 5. Instructs its President to forward this opinion to the Council and Commission.
