DECISION (EU) 2020/1251 OF THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES
of 2 September 2020
appointing three Judges and an Advocate-General to the Court of Justice
THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Article 19 thereof,
Having regard to the Treaty on the Functioning of the European Union, and in particular Articles 253 and 255 thereof,
Whereas:
(1) |
The terms of office of 14 Judges and six Advocates-General of the Court of Justice will expire on 6 October 2021, including that of the Judge proposed by the Kingdom of Belgium. An appointment to this post should therefore be made for the term of office starting on 7 October 2021 and expiring on 6 October 2027. |
(2) |
It has been proposed that the term of office of Mr Koen LENAERTS as Judge of the Court of Justice be renewed. |
(3) |
In addition, under Articles 5 and 7 of Protocol No 3 on the Statute of the Court of Justice of the European Union, and following the resignation of Mr Egils LEVITS as of 17 June 2019, a Judge should be appointed to the Court of Justice for the remainder of the term of office of Mr LEVITS, which runs until 6 October 2024. |

Ms Ineta ZIEMELE has been nominated for this post. |

Under the same provisions, and following the resignation of Mr Jiří MALENOVSKÝ as of 6 October 2020, a Judge should be appointed to the Court of Justice for the remainder of the term of office of Mr MALENOVSKÝ, which runs until 6 October 2024. |

Mr Jan PASSER has been nominated for this post. |

Finally, owing to the withdrawal of the United Kingdom from the Union, an Advocate-General should be appointed to the Court of Justice for the remainder of the term of office of the Advocate-General proposed by the United Kingdom, which runs until 6 October 2021. |

Mr Athanasios RANTOS has been nominated for this post. |

The panel set up by Article 255 of the Treaty on the Functioning of the European Union has given a favourable opinion on the suitability of these candidates to perform the duties of Judge or Advocate-General of the Court of Justice, |
HAVE ADOPTED THIS DECISION:
Article 1
Mr Koen LENAERTS is hereby appointed Judge to the Court of Justice for the period from 7 October 2021 to 6 October 2027.
Article 2
Ms Ineta ZIEMELE is hereby appointed Judge to the Court of Justice for the period from 7 September 2020 to 6 October 2024.
Article 3
Mr Jan PASSER is hereby appointed Judge to the Court of Justice for the period from 6 October 2020 to 6 October 2024.
Article 4
Mr Athanasios RANTOS is hereby appointed Advocate-General of the Court of Justice for the period from 7 September 2020 to 6 October 2021.
Article 5
This Decision shall enter into force on the date of its publication in the Official Journal of the European Union.
