    DECISION OF THE EEA JOINT COMMITTEE

    No 8/2011

    of 1 April 2011

    amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

    Whereas:

    (1)

    Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 116/2010 of 10 November 2010 (1).

    (2)

    Commission Regulation (EU) No 104/2010 of 5 February 2010 concerning the authorisation of potassium diformate as a feed additive for sows (holder of authorisation BASF SE) and amending Regulation (EC) No 1200/2005 (2) is to be incorporated into the Agreement.

    (3)

    Commission Regulation (EU) No 107/2010 of 8 February 2010 concerning the authorisation of Bacillus subtilis ATCC PTA-6737 as a feed additive for chickens for fattening (holder of authorisation Kemin Europa NV) (3) is to be incorporated into the Agreement.

    (4)

    Commission Regulation (EU) No 277/2010 of 31 March 2010 concerning the authorisation of 6-phytase as a feed additive for poultry for fattening and breeding other than turkeys for fattening, for poultry for laying and for pigs other than sows (holder of authorisation Roal Oy) (4) is to be incorporated into the Agreement.

    (5)

    Commission Regulation (EU) No 327/2010 of 21 April 2010 concerning the authorisation of a new use of 3-phytase as a feed additive for all minor avian species, other than ducks, and for ornamental birds (holder of authorisation BASF SE) (5) is to be incorporated into the Agreement.

    (6)

    Commission Regulation (EU) No 333/2010 of 22 April 2010 concerning the authorisation of a new use of Bacillus subtilis C-3102 (DSM 15544) as a feed additive for weaned piglets (holder of authorisation Calpis Co. Ltd Japan, represented in the European Union by Calpis Co. Ltd Europe Representative Office) (6) is to be incorporated into the Agreement.

    (7)

    Commission Regulation (EU) No 334/2010 of 22 April 2010 amending Regulation (EC) No 721/2008 as regards the composition of feed additives (7) is to be incorporated into the Agreement.

    (8)

    Commission Regulation (EU) No 335/2010 of 22 April 2010 concerning the authorisation of zinc chelate of hydroxy analogue of methionine as a feed additive for all animal species (8) is to be incorporated into the Agreement.

    (9)

    Commission Regulation (EU) No 348/2010 of 23 April 2010 concerning the authorisation of L-isoleucine as a feed additive for all animal species (9) is to be incorporated into the Agreement.

    (10)

    Commission Regulation (EU) No 349/2010 of 23 April 2010 concerning the authorisation of copper chelate of hydroxy analogue of methionine as a feed additive for all animal species (10) is to be incorporated into the Agreement.

    (11)

    Commission Regulation (EU) No 350/2010 of 23 April 2010 concerning the authorisation of manganese chelate of hydroxy analogue of methionine as a feed additive for all animal species (11) is to be incorporated into the Agreement.

    (12)

    Regulation (EU) No 335/2010 repeals Commission Regulation (EC) No 888/2009 (12) which has been incorporated into the Agreement and is therefore to be repealed under the Agreement.

    (13)

    Regulation (EU) No 349/2010 repeals Commission Regulation (EC) No 1253/2008 (13) which has been incorporated into the Agreement and is therefore to be repealed under the Agreement.

    (14)

    This Decision is not to apply to Liechtenstein,

    HAS DECIDED AS FOLLOWS:

    Article 1

    Chapter II of Annex I to the Agreement shall be amended as follows:

    (1)

    the following indent shall be added in point 1zzm (Commission Regulation (EC) No 1200/2005):

    ‘—

    32010 R 0104: Commission Regulation (EU) No 104/2010 of 5 February 2010 (OJ L 35, 6.2.2010, p. 4).’;

    (2)

    the following shall be added in point 1zzzzs (Commission Regulation (EC) No 721/2008):

    ‘, as amended by:

    32010 R 0334: Commission Regulation (EU) No 334/2010 of 22 April 2010 (OJ L 102, 23.4.2010, p. 21).’;

    (3)

    the text of point 1zzzzzc (Commission Regulation (EC) No 1253/2008) shall be replaced by the following:

    32010 R 0349: Commission Regulation (EU) No 349/2010 of 23 April 2010 concerning the authorisation of copper chelate of hydroxy analogue of methionine as a feed additive for all animal species (OJ L 104, 24.4.2010, p. 31).’;

    (4)

    the text of point 1zzzzzj (Commission Regulation (EC) No 888/2009) shall be replaced by the following:

    32010 R 0335: Commission Regulation (EU) No 335/2010 of 22 April 2010 concerning the authorisation of zinc chelate of hydroxy analogue of methionine as a feed additive for all animal species (OJ L 102, 23.4.2010, p. 22).’;

    (5)

    the following points shall be inserted after point 1zzzzzx (Commission Regulation (EU) No 9/2010):

    ‘1zzzzzy.

    (6)

    the following points shall be inserted after point 2 (Council Directive 87/153/EEC):

    ‘2a.

    32010 R 0277: Commission Regulation (EU) No 277/2010 of 31 March 2010 concerning the authorisation of 6-phytase as a feed additive for poultry for fattening and breeding other than turkeys for fattening, for poultry for laying and for pigs other than sows (holder of authorisation Roal Oy) (OJ L 86, 1.4.2010, p. 13).

    2b.

    32010 R 0327: Commission Regulation (EU) No 327/2010 of 21 April 2010 concerning the authorisation of a new use of 3-phytase as a feed additive for all minor avian species, other than ducks, and for ornamental birds (holder of authorisation BASF SE) (OJ L 100, 22.4.2010, p. 3).

    2c.

    32010 R 0333: Commission Regulation (EU) No 333/2010 of 22 April 2010 concerning the authorisation of a new use of Bacillus subtilis C-3102 (DSM 15544) as a feed additive for weaned piglets (holder of authorisation Calpis Co. Ltd Japan, represented in the European Union by Calpis Co. Ltd Europe Representative Office) (OJ L 102, 23.4.2010, p. 19).

    2d.

    32010 R 0348: Commission Regulation (EU) No 348/2010 of 23 April 2010 concerning the authorisation of L-isoleucine as a feed additive for all animal species (OJ L 104, 24.4.2010, p. 29).

    2e.

    32010 R 0350: Commission Regulation (EU) No 350/2010 of 23 April 2010 concerning the authorisation of manganese chelate of hydroxy analogue of methionine as a feed additive for all animal species (OJ L 104, 24.4.2010, p. 34).’.

    Article 2

    The texts of Regulations (EU) No 104/2010, (EU) No 107/2010, (EU) No 277/2010, (EU) No 327/2010, (EU) No 333/2010, (EU) No 334/2010, (EU) No 335/2010, (EU) No 348/2010, (EU) No 349/2010 and (EU) No 350/2010 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 1 May 2011, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
