DECISION OF THE EEA JOINT COMMITTEE

No 62/2010

of 11 June 2010

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 43/2009 of 24 April 2009 (1).

(2)

Directive 2009/62/EC of the European Parliament and of the Council of 13 July 2009 relating to the space for mounting the rear registration plate of two or three-wheel motor vehicles (2) is to be incorporated into the Agreement.

(3)

Directive 2009/79/EC of the European Parliament and of the Council of 13 July 2009 on passenger hand-holds on two-wheel motor vehicles (3) is to be incorporated into the Agreement.

(4)

Directive 2009/80/EC of the European Parliament and of the Council of 13 July 2009 on the identification of controls, tell-tales and indicators for two or three-wheel motor vehicles (4) is to be incorporated into the Agreement.

(5)

Directive 2009/62/EC repeals Council Directive 93/94/EEC (5) which is incorporated into the Agreement and which is therefore to be repealed under the Agreement.

(6)

Directive 2009/79/EC repeals Council Directive 93/32/EEC (6) which is incorporated into the Agreement and which is therefore to be repealed under the Agreement.

(7)

Directive 2009/80/EC repeals Council Directive 93/29/EEC (7) which is incorporated into the Agreement and which is therefore to be repealed under the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex II to the Agreement shall be amended as follows:

1.

the text of point 45i (Council Directive 93/29/EEC) shall be replaced by the following:

32009 L 0080: Directive 2009/80/EC of the European Parliament and of the Council of 13 July 2009 on the identification of controls, tell-tales and indicators for two or three-wheel motor vehicles (codified version) (OJ L 202, 4.8.2009, p. 16).’;

2.

the text of point 45l (Council Directive 93/32/EEC) shall be replaced by the following:

32009 L 0079: Directive 2009/79/EC of the European Parliament and of the Council of 13 July 2009 on passenger hand-holds on two-wheel motor vehicles (codified version) (OJ L 201, 1.8.2009, p. 29).’;

3.

the text of point 45q (Council Directive 93/94/EEC) shall be replaced by the following:

32009 L 0062: Directive 2009/62/EC of the European Parliament and of the Council of 13 July 2009 relating to the space for mounting the rear registration plate of two or three-wheel motor vehicles (codified version) (OJ L 198, 30.7.2009, p. 20).’.

Article 2

The texts of Directives 2009/62/EC, 2009/79/EC and 2009/80/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 12 June 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
