    DECISION OF THE EEA JOINT COMMITTEE

    No 102/2006

    of 22 September 2006

    amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

    Whereas:

    (1)

    Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 42/2006 of 28 April 2006 (1).

    (2)

    Commission Decision 2005/656/EC of 14 September 2005 amending Decision 2004/233/EC as regards the list of laboratories authorised to check the effectiveness of vaccination against rabies in certain domestic carnivores (2) is to be incorporated into the Agreement.

    (3)

    Commission Decision 2005/755/EC of 25 October 2005 amending Decisions 2005/92/EC and 2005/93/EC concerning export to third countries of certain products (3) is to be incorporated into the Agreement.

    (4)

    Commission Decision 2005/763/EC of 28 October 2005 amending Decision 2005/393/EC as regards the restricted zones in relation to bluetongue in Spain (4) is to be incorporated into the Agreement.

    (5)

    Commission Decision 2005/764/EC of 28 October 2005 amending Decision 93/52/EEC as regards the declaration that the province of Grosseto in the Region of Toscana in Italy is free of brucellosis (B. melitensis) and Decision 2003/467/EC as regards the declaration that France is free of bovine brucellosis (5) is to be incorporated into the Agreement.

    (6)

    Commission Decision 2005/768/EC of 28 October 2005 amending Decision 2001/618/EC to include the department of Ain, France, in the list of regions free of Aujeszky's disease (6) is to be incorporated into the Agreement.

    (7)

    Commission Decision 2005/773/EC of 3 November 2005 repealing Decision 2003/136/EC on the approval of the plans for the eradication of classical swine fever in feral pigs and emergency vaccination of feral pigs against classical swine fever in Luxembourg (7) is to be incorporated into the Agreement.

    (8)

    Commission Decision 2005/828/EC of 23 November 2005 amending Decision 2005/393/EC as regards the restricted zones in relation to bluetongue in Spain (8) is to be incorporated into the Agreement.

    (9)

    Commission Regulation (EC) No 1974/2005 of 2 December 2005 amending Annexes X and XI to Regulation (EC) No 999/2001 of the European Parliament and of the Council as regards national reference laboratories and specified risk material (9) is to be incorporated into the Agreement.

    (10)

    This Decision is not to apply to Iceland and Liechtenstein,

    HAS DECIDED AS FOLLOWS:

    Article 1

    Chapter I of Annex I to the Agreement shall be amended as specified in the Annex to this Decision.

    Article 2

    The texts of Regulation (EC) No 1974/2005 and Decisions 2005/656/EC, 2005/755/EC, 2005/763/EC, 2005/764/EC, 2005/768/EC, 2005/773/EC and 2005/828/EC in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 23 September 2006, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

    ANNEX

    Chapter I of Annex I to the Agreement shall be amended as follows:

    1.

    The following shall be added in points 130 (Commission Decision 2005/92/EC) in Part 1.2 and 2 (Commission Decision 2005/93/EC) in Part 5.2:

    ‘, as amended by:

    32005 D 0755: Commission Decision 2005/755/EC of 25 October 2005 (OJ L 284, 27.10.2005, p. 8).’

    2.

    The following indents shall be added in point 33 (Commission Decision 2005/393/EC) in Part 3.2:

    ‘—

    32005 D 0763: Commission Decision 2005/763/EC of 28 October 2005 (OJ L 288, 29.10.2005, p. 54),

    32005 D 0828: Commission Decision 2005/828/EC of 23 November 2005 (OJ L 311, 26.11.2005, p. 37).’

    3.

    Under the heading ‘ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT’ in Part 3.2, the text of point 21 (Commission Decision 2003/136/EC) shall be deleted.

    4.

    Under the heading ‘ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT’, the following point shall be inserted after point 32 (Commission Decision 2005/362/EC) in Part 3.2:

    ‘33.

    32005 D 0773: Commission Decision 2005/773/EC of 3 November 2005 repealing Decision 2003/136/EC on the approval of the plans for the eradication of classical swine fever in feral pigs and emergency vaccination of feral pigs against classical swine fever in Luxembourg (OJ L 291, 5.11.2005, p. 45).’

    5.

    The following indent shall be added in points 14 (Commission Decision 93/52/EEC) and 70 (Commission Decision 2003/467/EC) in Part 4.2:

    ‘—

    6.

    The following indent shall be added in point 64 (Commission Decision 2001/618/EC) in Part 4.2:

    ‘—

    7.

    The following indent shall be added in point 76 (Commission Decision 2004/233/EC) in Part 4.2:

    ‘—

    8.

    The following indent shall be added in point 12 (Regulation (EC) No 999/2001 of the European Parliament and of the Council) in Part 7.1:
