    European Parliament legislative resolution of 14 March 2023 on the proposal for a regulation of the European Parliament and of the Council Amending Regulations (EU) 2018/841 as regards the scope, simplifying the compliance rules, setting out the targets of the Member States for 2030 and committing to the collective achievement of climate neutrality by 2035 in the land use, forestry and agriculture sector, and (EU) 2018/1999 as regards improvement in monitoring, reporting, tracking of progress and review (COM(2021)0554 — C9-0320/2021 — 2021/0201(COD))

    The European Parliament,

    having regard to the Commission proposal to Parliament and the Council (COM(2021)0554),

    having regard to Article 294(2) and Article 192 (1) of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C9-0320/2021),

    having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

    having regard to the reasoned opinion submitted, within the framework of Protocol No 2 on the application of the principles of subsidiarity and proportionality, by the French Senate, asserting that the draft legislative act does not comply with the principle of subsidiarity,

    having regard to the opinion of the European Economic and Social Committee of 8 December 2021  (1),

    having regard to the opinion of the Committee of the Regions of 28 April 2022  (2),

    having regard to the provisional agreement approved by the responsible committee under Rule 74(4) of its Rules of Procedure and the undertaking given by the Council representative by letter of 21 December 2022 to approve Parliament’s position, in accordance with Article 294(4) of the Treaty on the Functioning of the European Union,

    having regard to Rule 59 of its Rules of Procedure,

    having regard to the opinions of the Committee on Industry, Research and Energy, the Committee on Transport and Tourism and the Committee on Agriculture and Rural Development,

    having regard to the report of the Committee on the Environment, Public Health and Food Safety (A9-0161/2022),

    1.

    Adopts its position at first reading hereinafter set out (3);

    2.

    Takes note of the statement by the Commission annexed to this resolution;

    3.

    Calls on the Commission to refer the matter to Parliament again if it replaces, substantially amends or intends to substantially amend its proposal;

    4.

    Instructs its President to forward its position to the Council, the Commission and the national parliaments.

    (As an agreement was reached between Parliament and Council, Parliament's position corresponds to the final legislative act, Regulation (EU) 2023/839.)


    ANNEX TO THE LEGISLATIVE RESOLUTION

    Commission Statement on the occasion of the adoption of Regulation (EU) 2023/839  (1) of the European Parliament and the Council amending Regulation (EU) 2018/841 as regards the scope, simplifying the reporting and compliance rules, and setting out the targets of the Member States for 2030, and Regulation (EU) 2018/1999 as regards improvement in monitoring, reporting, tracking of progress and review

    In its report pursuant to Article 45 of Regulation (EU) 2018/1999 on the Governance of the Energy Union and Climate Action, the Commission will also assess aspects related to access to justice in EU Member States, notably as regards Article 10 of that Regulation and take that assessment into account as appropriate in any possible subsequent legislative proposal.
