EXPLANATORY MEMORANDUM 1. CONTEXT OF THE PROPOSAL Council Regulations on fishing
opportunities adopted during the second half of each year no longer include a
TAC for anchovy in the Bay of Biscay because of the different annual cycle
followed by the biology of this stock and the scientific advice on it. An
anchovy TAC needs to be set around July each year. Under Council Regulation (EC) No 713/2013,
the Council established the TAC for the fishery exploiting this stock
applicable from 1 July 2013 until 30 June 2014. The TAC and its allocation to
the Member States concerned must now be fixed for the following 12 months. 2. RESULTS OF CONSULTATIONS
WITH THE INTERESTED PARTIES AND IMPACT ASSESSMENTS Having regard to the objectives of the
Common Fisheries Policy, laid down in Regulation (EU) No 1380/2013 of 11
December 2013 of the European Parliament and of the Council, fishing
opportunities should be established on the basis of the available scientific
advice and by taking into account the biological and socio-economic aspects
whilst ensuring fair treatment between fishing sectors. For the anchovy stock in the Bay of Biscay, scientific advice is based on a fishing season running from 1 July 2014
until 30 June 2015. Preliminary advice from the International Council for the
Exploration of the Sea (ICES) estimates that the Bay of Biscay anchovy 2014
spawning stock biomass, at the time of spawning, is 66,158 tonnes. In 2009, the Commission presented a
proposal for a Regulation establishing a long-term plan for the stock of
anchovy in the Bay of Biscay and the fisheries exploiting that stock on which
the proposed TAC is based. It is therefore appropriate to fix a TAC of 20,100
tonnes for the 2014/2015 fishing season corresponding to approximately an 18%
increase from the previous TAC. Given that the fishing season starts on 1st
July 2014, it is appropriate to adopt the TAC as soon as possible. Finally,
Regulation (EU) No 1380/2013 entered into force on 1st January
2013. By virtue of Article 15 thereof, an obligation to land all catches (“the
landing obligation”) will be applicable to the anchovy fishery in the Bay of Biscay as of 1st January 2015, therefore, no rules that have so far
obliged fishermen to discard may apply to this fishery after that date. 2014/0211 (NLE) Proposal for a COUNCIL REGULATION establishing the fishing opportunities for
anchovy in the Bay of Biscay for the 2014/15 fishing season THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the
Functioning of the European Union, and in particular Article 43(3) thereof, Having regard to the proposal from the
European Commission, Whereas: (1) Regulation (EU)
No 1380/2013 of the European Parliament and of the Council[1] requires that
conservation measures be adopted taking into account available scientific,
technical and economic advice, including, where relevant, reports drawn up by
the Scientific, Technical and Economic Committee for Fisheries (STECF). (2) It is incumbent upon the
Council to adopt measures on the fixing and allocation of fishing
opportunities, including certain conditions functionally linked thereto, as
appropriate. Fishing opportunities should be allocated to Member States in
such a way as to ensure relative stability of fishing activities of each
Member State for each fish stock or fishery and having due regard to the
objectives of the Common Fisheries Policy established in Regulation (EU)
No 1380/2013. (3) The total allowable catch
(TACs) should be established on the basis of available scientific advice,
taking into account biological and socio-economic aspects whilst ensuring fair
treatment between fishing sectors. (4) Preliminary advice from
the International Council for the Exploration of the Sea (ICES) estimates that
the Bay of Biscay anchovy 2014 spawning stock biomass, at the time of spawning,

2 of Council Regulation (EC) No 847/96[2],
it is necessary to establish to what extent the stock of anchovy in the Bay of
Biscay is subject to the measures laid down in that Regulation. (6) From 1 January 2015, the
fishery for anchovy in the Bay of Biscay will be subject to the landing
obligation provided for in Article 15(1)(a) of Regulation (EU) No 1380/2013 and
therefore, under the conditions specified in that Regulation, catches in that
fishery are to be retained on board, recorded, landed and counted against the
quotas. (7) In view of the start of
the 2014/15 fishing season and for the purpose of the annual reporting of
catches, this Regulation should enter into force as soon as possible after its
publication and should apply from 1 July 2014, HAS ADOPTED THIS REGULATION: Article 1
Fishing opportunities for anchovy in the Bay of Biscay The total allowable catch (TAC) and its
allocation between Member States for the fishing season running from 1 July
2014 until 30 June 2015 for the stock of anchovy in ICES Subarea VIII, as
defined in Regulation (EC) No 218/2009 of the European Parliament and of the
Council[3],

Special provisions on allocations of fishing opportunities The allocation of fishing opportunities
among Member States as set out in Article 1 shall be without prejudice to: (a) exchanges made pursuant to
Article 16(8) of Regulation (EU) No 1380/2013; (b) deductions and reallocations made
pursuant to Article 37 of Council Regulation (EC) No 1224/2009[4]; (c) reallocations made pursuant to
Article 10(4) of Council Regulation (EC) No 1006/2008[5]; (d) additional landings allowed under
Article 3 of Regulation (EC) No 847/96; (e) quantities withheld in accordance
with Article 4 of Regulation (EC) No 847/96; (f) deductions made pursuant to
Articles 105, 106 and 107 of Regulation (EC) No 1224/2009; (g) quota transfers and exchanges
pursuant to Article 20 of Council Regulation (EU) No 43/2014.[6] Article 3
Year-to-year management The stock referred to in paragraph 1 shall
be considered subject to an analytical TAC for the purposes of Regulation (EC)
No 847/96. Article 3(2) and (3) and Article 4 of that Regulation shall apply. Article 4
Landing of catches and by-catches before 1 January 2015 From 1 July 2014 until 31 December 2014,
fish from the stock referred to in Article 1 shall be retained on board or
landed only if: (a) the catches have been taken by
vessels flying the flag of a Member State having a quota and that quota is not
exhausted; or (b) the catches consist of a share in
a Union quota which has not been allocated by quota among Member States, and
that Union quota has not been exhausted. Article 5
Data transmission When, pursuant to Articles 33 and 34 of
Regulation (EC) No 1224/2009, Member States submit to the Commission data
relating to landings of quantities of stocks caught, they shall use the stock
code “ANE/08”. Article 6
Entry into force This Regulation shall enter into force the
day following that of its publication in the Official Journal of the
European Union. It shall apply from 1 July 2014 until 30
June 2015. This Regulation shall be binding
in its entirety and directly applicable in all Member States. Done at Brussels, For
