    EXPLANATORY MEMORANDUM

    Following the outcome of the elections that took place recently, the Federal Republic of Yugoslavia is in a new political situation marked by a clear will to change. When the political circumstances are right, it may be necessary, in order to contribute to the consolidation of democracy and the rule of law, to lift the petroleum embargo against the Federal Republic of Yugoslavia, as soon as possible.

    The present proposal for an (EC) Regulation is intended to implement that objective in the legal order of the Community.

    Proposal for a COUNCIL REGULATION repealing Regulation (EC) No 2111/1999 prohibiting the sale and supply of petroleum and certain petroleum products to certain parts of the Federal Republic of Yugoslavia (FRY)

    THE COUNCIL OF THE EUROPEAN UNION,

    Having regard to the Treaty establishing the European Community, and in particular Article 301 thereof,

    Having regard to Common Position XXXXXX [1] of XX October 2000 defined by the Council on the basis of Article 15 of the Treaty on European Union, concerning the supply and sale of petroleum and petroleum products to the Federal Republic of Yugoslavia (FRY),

    Whereas:

    (1) Following the outcome of the elections that took place recently, the Federal Republic of Yugoslavia is in a new political situation marked by a clear will to change, and, in these circumstances a lifting of the oil embargo against the Ferderal Republic of Yugoslavia may contribute to the consolidation of democracy and the rule of law.

    HAS ADOPTED THIS REGULATION:

    Article 1

    Regulation (EC) No 2111/1999 [3] shall be repealed.

    Article 2

    This Regulation shall enter into force on the day of its publication in the Official Journal of the European Communities.

    This Regulation shall be binding in its entirety and directly applicable in all Member States.
