    Proposal for a Council Directive on the approximation of the laws of the Member States relating to roadworthiness tests for motor vehicles and their trailers (COM(95)0415 - C4-0467/95 - 95/0226(SYN))

    The proposal was approved with the following amendments:

    Whereas each Member State must ensure, within its own area of jurisdiction, that roadworthiness tests are conducted methodically and to a high standard;

    Whereas the Commission must monitor closely the practical application of this Directive and report to the European Parliament and the Council at regular intervals on its findings;

    Whereas during 1996 the Commission is to present a report to the European Parliament and the Council on the feasibility of extending road-worthiness tests to two and three-wheeled vehicles;

    Article 2

    Roadworthiness tests within the meaning of this Directive shall be carried out by the State or by bodies or establishments designated and directly supervised by the State.

    Roadworthiness tests within the meaning of this Directive shall be carried out by the State, or by public organizations entrusted with the task, or by bodies or establishments designated and directly supervised by the State, including duly authorized private bodies. In particular, when establishments designated as vehicle testing centres also operate as motor vehicle repair workshops, the Member States shall ensure the objectivity and high quality of vehicle testing.

    After a reasonable period of engine conditioning (taking account of the vehicle manufacturer's recommendations) the carbon monoxide (CO) content of the exhaust gases is measured when the engine is idling (no load).

    The carbon monoxide (CO) content of the exhaust gases is measured when the engine is idling (no load) beginning with a cold start and after engine conditioning in accordance with the manufacturer's recommendations.

    (Cooperation procedure: first reading)

    The European Parliament,

    - having regard to the Commission proposal to the Council, COM(95)0415 - 95/0226(SYN),

    - having been consulted by the Council pursuant to Articles 189c and 75 of the EC Treaty (C4-0467/95),

    - having regard to Rule 58 of its Rules of Procedure,

    - having regard to the report of the Committee on Transport and Tourism and the opinion of the Committee on Economic and Monetary Affairs and Industrial Policy (A4-0010/96),

    1. Approves the Commission proposal, subject to Parliament's amendments;

    2. Calls on the Commission to amend its proposal accordingly, pursuant to Article 189a(2) of the EC Treaty;

    3. Calls on the Council to incorporate Parliament's amendments in the common position that it adopts in accordance with Article 189c(a) of the EC Treaty;

    4. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal;

    5. Instructs its President to forward this opinion to the Council and Commission.
