In the first half of each year, the Commission shall present for examination by the SPC the guidelines for implementing the Community statistical programme, particularly the priorities envisaged for the actions to be undertaken. These priorities shall take account of financial constraints at both national and Community level and of the Community legal provisions governing such actions.

3. The representative of the Commission shall submit to the Committee a draft of the measures to be taken. The Committee shall deliver its opinion on the draft within a time limit which the chairman may lay down according to the urgency of the matter. The opinion shall be delivered by the majority laid down in Article 148(2) of the Treaty establishing the European Community in the case of decisions which the Council of the European Union is required to adopt on a proposal from the Commission. The votes of the representatives of the Member States within the Committee shall be weighted in the manner set out in that Article. The chairman shall not vote.

The European Parliament,

- having regard to the Commission proposal to the Council, COM(94)0078 - 94/0026(CNS) ((OJ C 106, 14.4.1994, p. 22.)),

- having been consulted by the Council pursuant to Article 213 of the EC Treaty (C3-0231/94),

- whereas the legal basis proposed is inadequate; whereas reference should also be made to Articles 43, 76, 87, 100, 100a and 113 of the EC Treaty,

- having regard to Rule 58 of its Rules of Procedure,

- having regard to the report of the Committee on Economic and Monetary Affairs and Industrial Policy and the opinion of the Committee on Legal Affairs and Citizens' Rights concerning the proposed legal basis (A4- 0071/95),

1. Approves the Commission proposal, subject to Parliament's amendments;

2. Asks to be consulted again should the Council intend to make substantial modifications to it;

3. Instructs its President to forward this opinion to the Council, the Commission and the parliaments of the Member States.
