[pic] | EUROPEAN COMMISSION | Brussels, 29.10.2010 COM(2010) 615 final Proposal for a DECISION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on the mobilisation of the European Globalisation Adjustment Fund in accordance with point 28 of the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management (application EGF/2010/016 ES/Aragón Retail trade from Spain) EXPLANATORY MEMORANDUM Point 28 of the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management[1] allows for the mobilisation of the European Globalisation Adjustment Fund (EGF) through a flexibility mechanism, within the annual ceiling of EUR 500 million over and above the relevant headings of the financial framework. The rules applicable to the contributions from the EGF are laid down in Regulation (EC) No 1927/2006 of the European Parliament and of the Council of 20 December 2006 on establishing the European Globalisation Adjustment Fund[2]. On 6 May 2010, Spain submitted application EGF/2010/016 ES/Aragón Retail for a financial contribution from the EGF, following redundancies in 593 enterprises operating in the NACE Revision 2 Division 47 ('Retail trade, except for motor vehicles and motorcycles')[3] in the NUTS II region of Aragón (ES24) in Spain. After a thorough examination of this application, the Commission has concluded in accordance with Article 10 of Regulation (EC) No 1927/2006 that the conditions for a financial contribution under this Regulation are met. The application was presented to the Commission on 6 May 2010 and supplemented by additional information up to 1 July 2010. 2. The application meets the conditions for deploying the EGF as set out in Article 2(b) of Regulation (EC) No 1927/2006, and was submitted within the deadline of 10 weeks referred to in Article 5 of that Regulation. Link between the redundancies and major structural changes in world trade patterns due to globalisation or the global financial and economic crisis 3. In order to establish the link between the redundancies and the global financial and economic crisis, Spain argues that the financial crisis led to a liquidity shortage among financial institutions and concerns over their solvency. These concerns were subsequently transmitted to the ‘real economy’ (i.e. the non-financial sectors), as credit facilities were withdrawn and business and consumer confidence fell. Rising unemployment – which in Spain is close to 20 %, i.e. double the EU-27 or the Euro zone[5] – and reductions in working hours (no overtime, reduced working week, temporary stoppages etc), coupled with the scarcity of credit and concerns over possible further contractions in the labour market, explain the downturn in retail sales. The decline in the volume of retail sales during the recession followed a similar pattern as other economic activities, falling for seven successive quarters from the peak recorded in the first quarter of 2008. In Spain the volume of retail sales fell more sharply than the EU27 average. In accordance with Article 7 of Regulation (EC) No 1927/2006, Spain has confirmed that a policy of equality between women and men as well as non-discrimination has been applied, and will continue to apply, during the various stages of the implementation of and, in particular, in access to the EGF. Description of the territory concerned and its authorities and stakeholders 8. The territory concerned by the redundancies is the autonomous community of Aragón. Most of the territory of the region has a lower population density than the EU average (112 inhabitants per km2) while 60 % of the total population of the territory is concentrated in the town of Zaragoza and its surrounding area. Aragon's economy based traditionally in cereal crops and sheep farming has been transformed over the last two/three decades by the rise of the industrial sector, services and trade, and followed by tourism, in particular winter sports tourism. Most of Aragon's industrial activity is located in Zaragoza. The local industrial boom has been accompanied by a strong expansion of the service sector. Distribution and the new shopping and leisure centres based also in Zaragoza have become important sources of employment. Aragón accounts for the 3 % of the Spanish GDP. 9. The main stakeholders are the Departamento de Economía, Hacienda y Empleo del Gobierno de Aragón (Finance and Employment Regional Ministry) and the Instituto Aragonés de Empleo-INAEM (labour services of the Aragón autonomous government); the trade unions Confederación Sindical de Comisiones Obreras CC.OO Aragón and Unión General de Trabajadores-UGT Aragón; and four employers' organizations: Confederación de Empresarios de Aragón-CREA, Confederación de la Pequeña y Mediana Empresa Aragonesa-CEPYME Aragón, Confederación de Empresarios del Comercio-CEC and Federación de Empresarios del Comercio de Aragón-CEMCA. Expected impact of the redundancies as regards local, regional or national employment 10. The Spanish authorities argue that the redundancies in the retail sector will aggravate the unemployment situation, which has already deteriorated as a result of the financial and economic crisis. In the Autonomous region of Aragón, the unemployment rate increased from 6,2 % in Q3/2008 to 12 % in Q3/2009. In February 2010 unemployment in the services sector represented 56 % of the total unemployment in the region. 11. Due to the low population density in most of the territory concerned by this application (between 3 and 54 inhabitants per km2) and the risk of depopulation, layoffs have a highly negative impact on this region and might jeopardize the efforts made to encourage the population to remain in the territory. Co-ordinated package of personalised services to be funded and a breakdown of its estimated costs, including its complementarity with actions funded by the Structural Funds 12. All the following measures combine to form a co-ordinated package of personalised services aimed at re-integrating the workers into the labour market. They are organised in four areas: Guidance, counselling and job search. - Welcome session, occupational guidance and profiling : The first measure provided to all participants includes the profiling of the workers as well as information on available jobs, on skills and training requirements, on available training programmes and on incentives. - Training in job search techniques, self-employment and social skills : The workers will participate in workshops focused on self-employment and the promotion of entrepreneurship or they will be trained in job-search skills. This measure will aim to improve the self-knowledge of the participant and to reinforce their self-esteem. Training and re-training - General training and re-training : This measure offers diverse paths of training. The workers will be given the opportunity to follow one or more of these training courses: (1) Information and communication technologies (ICT) basic or intermediate training; (2) Training in vocational skills: The participants in this measure will be trained in job-skills currently in demand; (3) Training for professional qualifications: The training course will be designed to cater for the identified needs of local enterprises, which will in turn undertake to employ some of the workers who participate in this action. - Training in personal development : The participants will be trained in transversal skills, including decision-making process, conflict resolution, adaptability to change, etc. This measure aims to improve the self-esteem of its participants and their interpersonal communication skills or other transversal skills, in order to facilitate their reinsertion into the labour market. Reintegration into employment - Intensive job-search assistance : This will involve an intensive employment searching (including active research of the local and regional employment opportunities, exploring new openings for employment such as organic trade, etc) and the matching of available jobs with the job seekers. - Tutoring after reintegration into work : This will prevent possible problems arising in the new jobs: the workers reintegrated into employment will be guided during the first three months in their new jobs. Incentives - Participation incentive : To encourage their participation in the measures, the workers will receive a lump sum of EUR 200 conditional upon their participation in the measures of the EGF package. - Assistance for carers of dependent persons : Workers with dependent persons (children, elderly or disabled persons) will receive a lump sum of EUR 200 as a contribution to the expenses for carers of dependent persons conditional upon their participation in the measures. This aims to cover the additional costs faced by the workers with caring responsibilities in order to avail themselves of training or other measures. - Outplacement incentives : A wage subsidy of EUR 300 per month for a maximum of three months will be paid to workers who return to employment. The subsidy is designed to encourage their quick reintegration into the labour market and to stimulate workers, particularly those who are older, to remain in the labour market. - The expenditure for implementing the EGF, which is included in the application in accordance with Article 3 of Regulation (EC) No 1927/2006, covers preparatory, management and control activities as well as information and publicity. - The personalised services presented by the Spanish authorities are active labour market measures within the eligible actions defined by Article 3 of Regulation (EC) No 1927/2006. The Spanish authorities estimate the total costs of these services at EUR 2 358 000 and the expenditure for implementing the EGF at EUR 42 000 (1,75 % of the total amount). The total contribution requested from the EGF is EUR 1 560 000 (65 % of the total costs). Spain confirms that the measures described above are complementary with actions funded by the Structural Funds. Spain will put in place the necessary control procedures to eliminate any risk of double funding and will also ensure a clear audit trail for EGF funded activities. Spain also confirms that no other EU funding is sought or used for these activities. 14. The three ESF operational programmes (2007-13) co-financing actions in Aragón are: ESF Pluri-regional Operational Programme Adaptability and Employment, ESF Operational Programme Anti-discrimination and ESF Operational Programme for Aragón. Although some of the EGF measures could be similar to ESF measures there is a difference: EGF measures have a uniqueness and special character (they address a sector and a particular population) and they are tailor-made and have an intensive format. 15. Continuous follow-up of ESF and EGF actions pursuing similar purposes and the workers concerned will avoid any overlap between ESF and EGF measures. Date(s) on which the personalised services to the affected workers were started or are planned to start 16. Spain started the personalised services to the affected workers included in the co-ordinated package proposed for co-financing to the EGF on 1 May 2010. This date therefore represents the beginning of the period of eligibility for any assistance that might be awarded from the EGF. Procedures for consulting the social partners 17. The social partners CREA, CEPYME Aragón, UGT and CCOO[7] were consulted twice: on 29 November 2009 and on 8 February 2010, in the framework of the Guidance Committee for Intermediation and Job Placement of the Economic and Social Agreement for the Development of Aragón 2008-2011. In the first meeting the social partners agreed to the submission of another application for EGF, encouraged by the high degree of satisfaction of the participants in the EGF measures provided to redundant workers of the automotive industry[8]. In the second meeting the draft application was discussed. 18. The Spanish authorities confirmed that the requirements laid down in national and Community legislation concerning collective redundancies have been complied with. Information on actions that are mandatory by virtue of national law or pursuant to collective agreements 19. As regards the criteria contained in Article 6 of Regulation (EC) No 1927/2006, the Spanish authorities in their application: 20. confirmed that the financial contribution from the EGF does not replace measures which are the responsibility of companies by virtue of national law or collective agreements; 21. demonstrated that the actions provide support for individual workers and are not to be used for restructuring companies or sectors; 22. confirmed that the eligible actions referred to above do not receive assistance from other Community financial instruments. Management and control systems 23. Spain has notified the Commission that the financial contribution will be managed and controlled by the same bodies that manage and control the ESF. The Instituto Aragonés de Empleo (INAEM) will be the intermediate body for the managing authority. Financing 24. On the basis of the application from Spain, the proposed contribution from the EGF to the coordinated package of personalised services is EUR 1 560 000, representing 65 % of the total cost. The Commission's proposed allocation from the Fund is based on the information made available by Spain. 25. Considering the maximum possible amount of a financial contribution from the EGF under Article 10(1) of Regulation (EC) No 1927/2006, as well as the scope for reallocating appropriations, the Commission proposes to mobilise the EGF for the total amount referred above, to be allocated under heading 1a of the financial framework. 26. The proposed amount of financial contribution will leave more than 25 % of the maximum annual amount earmarked for the EGF available for allocations during the last four months of the year, as required by Article 12(6) of Regulation (EC) No 1927/2006. 27. By presenting this proposal to mobilise the EGF, the Commission initiates the simplified trialogue procedure, as required by Point 28 of the Inter institutional Agreement of 17 May 2006, with a view to securing the agreement of the two arms of the budgetary authority on the need to use the EGF and the amount required. The Commission invites the first of the two arms of the budgetary authority that reaches agreement on the draft mobilisation proposal, at appropriate political level, to inform the other arm and the Commission of its intentions. In case of disagreement by either of the two arms of the budgetary authority, a formal trialogue meeting will be convened. 28. The Commission presents separately a transfer request in order to enter in the 2010 budget specific commitment and payment appropriations, as required in Point 28 of the Interinstitutional Agreement of 17 May 2006. Source of payment appropriations 29. In the current state of implementation, it is foreseeable that the payment appropriations available in 2010 under the budget line 01.0404 "Competitiveness and Innovation Framework Programme - Entrepreneurship and innovation programme" will not be fully used this year. 30. The line covers expenditure related to the implementation of the financial instrument of this programme, the main objective of which is to facilitate the access of SMEs to finance. Some time lag exists between transfers to the trust accounts managed by the European Investment Fund and disbursement to the beneficiaries. The financial crisis has a major effect on the forecasts in terms of disbursements for 2010. As a result, in order to avoid excessive balances on the trust accounts, the methodology for calculation of payment appropriations has been reviewed, taking into account the expected disbursements. The amount of EUR 1 560 000 can therefore be made available for transfer. Proposal for a DECISION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on the mobilisation of the European Globalisation Adjustment Fund in accordance with point 28 of the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management (application EGF/2010/016 ES/Aragón Retail trade from Spain) THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the Functioning of the European Union, Having regard to the Inter-institutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management[9], and in particular point 28 thereof, Having regard to Regulation (EC) No 1927/2006 of the European Parliament and of the Council of 20 December 2006 establishing the European Globalisation Adjustment Fund[10], and in particular Article 12(3) thereof, Having regard to the proposal from the European Commission[11], Whereas: (1) The European Globalisation Adjustment Fund (EGF) was established to provide additional support for workers made redundant as a result of major structural changes in world trade patterns due to globalisation and to assist them with their reintegration into the labour market. (2) The scope of the EGF was broadened for applications submitted from 1 May 2009 to include support for workers made redundant as a direct result of the global financial and economic crisis. (3) The Interinstitutional Agreement of 17 May 2006 allows the mobilisation of the EGF within the annual ceiling of EUR 500 million. (4) Spain submitted an application to mobilise the EGF, in respect of redundancies in 593 enterprises operating in the NACE Revision 2 Division 47 ('Retail trade, except for motor vehicles and motorcycles') in the NUTS II region of Aragón (ES24), on 6 May 2010 and supplemented it by additional information up to 1 July 2010. This application complies with the requirements for determining the financial contributions as laid down in Article 10 of Regulation (EC) No 1927/2006. The Commission therefore proposes to mobilise an amount of EUR 1 560 000. (5) The EGF should, therefore, be mobilised in order to provide a financial contribution for the application submitted by Spain. HAVE DECIDED AS FOLLOWS: Article 1 For the general budget of the European Union for the financial year 2010, the European Globalisation Adjustment Fund (EGF) shall be mobilised to provide the sum of EUR 1 560 000 in commitment and payment appropriations.
