    DECISION OF THE EEA JOINT COMMITTEE No 34/2020

    of 20 March 2020

    amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2023/348]

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

    Whereas:

    (1)

    Commission Implementing Regulation (EU) 2019/716 of 30 April 2019 amending Implementing Regulations (EU) No 22/2013 and (EU) No 540/2011 as regards the conditions of approval of the active substance cyflumetofen (1) is to be incorporated into the EEA Agreement.

    (2)

    Commission Implementing Regulation (EU) 2019/1589 of 26 September 2019 amending Implementing Regulation (EU) No 540/2011 as regards the extension of the approval periods of the active substances amidosulfuron, beta-cyfluthrin, bifenox, chlorotoluron, clofentezine, clomazone, cypermethrin, daminozide, deltamethrin, dicamba, difenoconazole, diflubenzuron, diflufenican, fenoxaprop-P, fenpropidin, fludioxonil, flufenacet, fosthiazate, indoxacarb, lenacil, MCPA, MCPB, nicosulfuron, picloram, prosulfocarb, pyriproxyfen, thiophanate-methyl, triflusulfuron and tritosulfuron (2) is to be incorporated into the EEA Agreement.

    Commission Implementing Regulation (EU) 2019/1605 of 27 September 2019 approving the low-risk active substance Bacillus subtilis strain IAB/BS03, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market, and amending the Annex to Commission Implementing Regulation (EU) No 540/2011 (3) is to be incorporated into the EEA Agreement.

    (4)

    Commission Implementing Regulation (EU) 2019/1690 of 9 October 2019 renewing the approval of the active substance alpha-cypermethrin, as a candidate for substitution, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market, and amending the Annex to Commission Implementing Regulation (EU) No 540/2011 (4) is to be incorporated into the EEA Agreement.

    (5)

    Annex II to the EEA Agreement should therefore be amended accordingly,

    HAS ADOPTED THIS DECISION:

    Article 1

    Chapter XV of Annex II to the EEA Agreement shall be amended as follows:

    1.

    The following indents are added in point 13a (Commission Implementing Regulation (EU) No 540/2011):

    ‘—

    32019 R 0716: Commission Implementing Regulation (EU) 2019/716 of 30 April 2019 (OJ L 122, 10.5.2019, p. 39),

    32019 R 1589: Commission Implementing Regulation (EU) 2019/1589 of 26 September 2019 (OJ L 248, 27.9.2019, p. 24),

    32019 R 1605: Commission Implementing Regulation (EU) 2019/1605 of 27 September 2019 (OJ L 250, 30.9.2019, p. 49),

    32019 R 1690: Commission Implementing Regulation (EU) 2019/1690 of 9 October 2019 (OJ L 259, 10.10.2019, p. 2).’

    2.

    The following is added in point 13zx (Commission Implementing Regulation (EU) No 22/2013):

    ‘, as amended by:

    32019 R 0716: Commission Implementing Regulation (EU) 2019/716 of 30 April 2019 (OJ L 122, 10.5.2019, p. 39).’

    3.

    The following points are inserted after point 13zzzzzzzzzzh (Commission Implementing Regulation (EU) 2019/1138):

    32019 R 1605: Commission Implementing Regulation (EU) 2019/1605 of 27 September 2019 approving the low-risk active substance Bacillus subtilis strain IAB/BS03, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market, and amending the Annex to Commission Implementing Regulation (EU) No 540/2011 (OJ L 250, 30.9.2019, p. 49).

    32019 R 1690: Commission Implementing Regulation (EU) 2019/1690 of 9 October 2019 renewing the approval of the active substance alpha-cypermethrin, as a candidate for substitution, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market, and amending the Annex to Commission Implementing Regulation (EU) No 540/2011 (OJ L 259, 10.10.2019, p. 2).’

    Article 2

    The texts of Implementing Regulations (EU) 2019/716, (EU) 2019/1589, (EU) 2019/1605 and (EU) 2019/1690 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 21 March 2020, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
