    DECISION OF THE EEA JOINT COMMITTEE

    No 1/2011

    of 11 February 2011

    amending Annex II (Technical regulations, standards, testing and certification) and Annex IV (Energy) to the EEA Agreement

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

    Whereas:

    (1)

    Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 124/2009 of 4 December 2009 (1).

    (2)

    Annex IV to the Agreement was amended by Decision of the EEA Joint Committee No 69/2010 of 11 June 2010 (2).

    (3)

    Commission Regulation (EC) No 1275/2008 of 17 December 2008 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for standby and off mode electric power consumption of electrical and electronic household and office equipment (3) is to be incorporated into the Agreement.

    (4)

    Commission Regulation (EC) No 107/2009 of 4 February 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for simple set-top boxes (4) is to be incorporated into the Agreement.

    (5)

    Commission Regulation (EC) No 244/2009 of 18 March 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for non-directional household lamps (5) is to be incorporated into the Agreement.

    (6)

    Commission Regulation (EC) No 245/2009 of 18 March 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for fluorescent lamps without integrated ballast, for high intensity discharge lamps, and for ballasts and luminaires able to operate such lamps, and repealing Directive 2000/55/EC of the European Parliament and of the Council (6) is to be incorporated into the Agreement.

    (7)

    Commission Regulation (EC) No 278/2009 of 6 April 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for no-load condition electric power consumption and average active efficiency of external power supplies (7) is to be incorporated into the Agreement.

    (8)

    Commission Regulation (EC) No 640/2009 of 22 July 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for electric motors (8) is to be incorporated into the Agreement.

    (9)

    Commission Regulation (EC) No 641/2009 of 22 July 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for glandless standalone circulators and glandless circulators integrated in products (9) is to be incorporated into the Agreement.

    (10)

    Commission Regulation (EC) No 642/2009 of 22 July 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for televisions (10) is to be incorporated into the Agreement.

    (11)

    Commission Regulation (EC) No 643/2009 of 22 July 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for household refrigerating appliances (11) is to be incorporated into the Agreement.

    (12)

    Regulation (EC) No 245/2009 repeals, with effect from 13 April 2010, Directive 2000/55/EC of the European Parliament and of the Council (12) which is incorporated into the Agreement and is therefore to be repealed under the Agreement with effect from 13 April 2010.

    (13)

    Regulation (EC) No 643/2009 repeals, with effect from 1 July 2010, Directive 96/57/EC of the European Parliament and of the Council (13) which is incorporated into the Agreement and is therefore to be repealed under the Agreement with effect from 1 July 2010,

    HAS DECIDED AS FOLLOWS:

    Article 1

    Chapter IV of Annex II to the Agreement shall be amended as follows:

    1.

    the text of point 5 (Directive 96/57/EC of the European Parliament and of the Council) shall be deleted;

    2.

    the following points shall be inserted after point 7 (Commission Decision 2008/591/EC):

    32008 R 1275: Commission Regulation (EC) No 1275/2008 of 17 December 2008 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for standby and off mode electric power consumption of electrical and electronic household and office equipment (OJ L 339, 18.12.2008, p. 45), as amended by:

    32009 R 0641: Commission Regulation (EC) No 641/2009 of 22 July 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for glandless standalone circulators and glandless circulators integrated in products (OJ L 191, 23.7.2009, p. 35).

    15.

    32009 R 0642: Commission Regulation (EC) No 642/2009 of 22 July 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for televisions (OJ L 191, 23.7.2009, p. 42).

    16.

    32009 R 0643: Commission Regulation (EC) No 643/2009 of 22 July 2009 implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for household refrigerating appliances (OJ L 191, 23.7.2009, p. 53).’.

    Article 2

    Annex IV to the Agreement shall be amended as follows:

    1.

    the text of point 13 (Directive 96/57/EC of the European Parliament and of the Council) shall be deleted;

    2.

    the text of point 15 (Directive 2000/55/EC of the European Parliament and of the Council) shall be deleted;

    3.

    the following points shall be inserted after point 30 (Regulation (EC) No 106/2008 of the European Parliament and of the Council):

    Article 3

    The texts of Regulations (EC) No 1275/2008, (EC) No 107/2009, (EC) No 244/2009, (EC) No 245/2009, (EC) No 278/2009, (EC) No 640/2009, (EC) No 641/2009, (EC) No 642/2009 and (EC) No 643/2009 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 4

    This Decision shall enter into force on 12 February 2011, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

    Article 5

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
