DECISION OF THE EEA JOINT COMMITTEE
No 61/2010
of 11 June 2010
amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,
Whereas:

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 42/2010 of 30 April 2010 (1). |
(2) |
Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 42/2010 of 30 April 2010. |
(3) |
Commission Regulation (EC) No 1097/2009 of 16 November 2009 amending Annex II to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for dimethoate, ethephon, fenamiphos, fenarimol, methamidophos, methomyl, omethoate, oxydemeton-methyl, procymidone, thiodicarb and vinclozolin in or on certain products (2), as corrected by OJ L 307, 21.11.2009, p. 9, is to be incorporated into the Agreement. |
(4) |
Commission Directive 2009/163/EU of 22 December 2009 amending Directive 94/35/EC of the European Parliament and of the Council on sweeteners for use in foodstuffs with regard to neotame (3) is to be incorporated into the Agreement. |
(5) |
This Decision is not to apply to Liechtenstein, |
HAS DECIDED AS FOLLOWS:
Article 1
The following indent shall be added in point 40 (Regulation (EC) No 396/2005 of the European Parliament and of the Council) of Chapter II of Annex I to the Agreement:

Article 2
Chapter XII of Annex II to the Agreement shall be amended as follows:

Article 3
The texts of Regulation (EC) No 1097/2009, as corrected by OJ L 307, 21.11.2009, p. 9, and Directive 2009/163/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 4
This Decision shall enter into force on 12 June 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).
Article 5
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
