    DECISION OF THE EEA JOINT COMMITTEE

    No 84/2007

    of 6 July 2007

    amending Annex VI (Social security) to the EEA Agreement

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

    Whereas:

    (1)

    Annex VI to the Agreement was amended by Decision of the EEA Joint Committee No 118/2006 of 22 September 2006 (1).

    (2)

    Council Regulation (EEC) No 574/72 of 21 March 1972 fixing the procedure for implementing Regulation (EEC) No 1408/71 on the application of social security schemes to employed persons and their families moving within the Community (2) is incorporated into the Agreement.

    (3)

    The title of Regulation (EEC) No 574/72 was amended by Council Regulation (EEC) No 3795/81 (3) extending it to self-employed persons and members of their families.

    (4)

    Changes shall be made in Annexes 2, 3, 4 and 10 to Regulation (EEC) No 574/72 with regard to Liechtenstein, due to organisational changes in the Liechtenstein public administration.

    (5)

    Changes shall be made in Annex 5 to Regulation (EEC) No 574/72 with regard to Norway, due to a new reimbursement agreement which Norway has concluded with the Netherlands and which entered into force on 1 January 2007, and a non-reimbursement agreement which Norway has concluded with Portugal and which entered into force on 1 June 2006.

    (6)

    The English denominations for the Icelandic ‘tryggingastofnun rikisins’ as well as the Liechtenstein ‘Amt für Volkswirtschaft’ have changed,

    HAS DECIDED AS FOLLOWS:

    Article 1

    Annex VI to the Agreement shall be amended as follows:

    1.

    point 2 (Council Regulation (EEC) No 574/72) shall be amended as follows:

    (i)

    in part 1 (Sickness and maternity) and part 4 (Accidents at work and occupational diseases) of section ‘ZB. LIECHTENSTEIN’ in adaptation (b) the words ‘the Amt für Volkswirtschaft (Office of National Economy)’ shall be replaced by the words ‘Amt für Gesundheit (Office for Health)’;

    (ii)

    in part 5 (Unemployment) of section ‘ZB. LIECHTENSTEIN’ in adaptation (b) the words ‘Office of National Economy’ shall be replaced by the words ‘Office of Economic Affairs’;

    (iii)

    in part 1 (Sickness, maternity, accidents at work and occupational diseases, unemployment) of section ‘ZB. LIECHTENSTEIN’ in adaptation (c) and (f) the word ‘, unemployment’ shall be deleted;

    (iv)

    in part 1 (Sickness, maternity, accidents at work and occupational diseases, unemployment) of section ‘ZB. LIECHTENSTEIN’ in adaptations (c) and (f) as well as in parts 1(b), 2(b), 5, 6 and 7 of section ‘ZB. LIECHTENSTEIN’ in adaptation (m) the words ‘Amt für Volkswirtschaft (Office of National Economy)’ shall be replaced by the words ‘Amt für Gesundheit (Office for Health)’;

    (v)

    in part 3 of section ‘ZB. LIECHTENSTEIN’ in adaptation (m) the words ‘Amt für Volkswirtschaft’ shall be replaced by the words ‘Amt für Gesundheit’ and the words ‘Office of National Economy’ shall be replaced by the words ‘Office for Health’;

    (vi)

    in part 2(b) and part 3(b) of section ‘ZB. LIECHTENSTEIN’ in adaptations (c) and (f) the words ‘Amt für Volkswirtschaft (Office of National Economy)’ shall be replaced by the words ‘FMA Finanzmarktaufsicht Liechtenstein (Financial Market Authority Liechtenstein)’;

    (vii)

    the following shall be added at the end of section ‘ZB. LIECHTENSTEIN’ in adaptations (c) and (f):

    ‘5.

    Unemployment:

    Amt für Volkswirtschaft (Office of Economic Affairs).’;

    (viii)

    the text of point 370. (NORWAY — NETHERLANDS) in adaptation (g) shall be replaced by the following:

    ‘Agreement of 23 January 2007 on the reimbursement of costs for benefits in kind provided under Regulations (EEC) Nos 1408/71 and 574/72.’;

    (ix)

    the text of point 373. (NORWAY — PORTUGAL) in adaptation (g) shall be replaced by the following:

    ‘Arrangement of 24 November 2000 under Articles 36(3) and 63(3) of Regulation (EEC) No 1408/71 and Article 105(2) of Regulation (EEC) No 574/72 on the reciprocal waiving of the reimbursement of costs of benefits in kind for sickness, maternity, accidents at work and occupational diseases and the costs incurred for administrative checks and medical examinations provided under these Regulations.’;

    2.

    in point 3.38 (Decision No 151) the words ‘Amt für Volkswirtschaft (Office of National Economy)’ under section ‘15. Liechtenstein’ shall be replaced by the words ‘Amt für Gesundheit (Office for Health)’;

    3.

    the words ‘the State Social Security Institute’ throughout the Annex shall be replaced by the words ‘Social Insurance Administration’.

    Article 2

    This Decision shall enter into force on 7 July 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

    Article 3

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
