COUNCIL DIRECTIVE

of 27 July 1976

on the approximation of the laws of the Member States relating to the installation of lighting and light-signalling devices on motor vehicles and their trailers

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 100 thereof,

Having regard to the proposal from the Commission,

Having regard to the opinion of the European Parliament ( 1 ),

Having regard to the opinion of the Economic and Social Committee ( 2 ),

Whereas the technical requirements which motor vehicles must satisfy pursuant to national laws relate inter alia to the installation of lighting and light-signalling devices;

Whereas those requirements differ from one Member State to another; whereas it is therefore necessary that all Member States adopt the same requirements either in addition to or in place of their existing rules, in order, in particular, to allow the EEC type-approval proccedure which was the subject of Council Directive 70/156/EEC of 6 February 1970 on the approximation of the laws of the Member States relating to the type-approval of motor vehicles and their trailers ( 3 ), to be introduced in respect of each type of vehicle;

Whereas common requirements for the construction of lighting and light-signalling devices will be the subject of further special Directives;

Whereas approximation of the national laws relating to motor vehicles entails mutual recognition by the Member States of the checks carried out by each of them on the basis of the common requirements; whereas, if the system is to function properly, these requirements must be applied from the same date,

HAS ADOPTED THIS DIRECTIVE:

Article 1

For the purposes of this Directive, ‘vehicle’ means any vehicle to which Council Directive 70/156/EEC applies.

Article 2

1.  With effect from 1 January 1993, no Member State may:

 refuse, in respect of a type of vehicle, to grant EC type-approval, to issue the document referred to in the last indent of Article 10 (1) of Directive 70/156/EEC, or to grant national type-approval, or

 prohibit the entry into service of vehicles

on grounds relating to the installation of the lighting and light-signalling devices on this type of vehicle or on these vehicles if these devices are installed in accordance with the requirements of this Directive.

2.  With effect from 1 October 1993, Member States:

 shall no longer issue the document referred to in the last indent of Article 10 (1) of Directive 70/156/EEC, and

 may refuse to grant national type-approval

in respect of a type of vehicle on which the installation of the lighting and light-signalling devices is not in accordance with the requirements of this Directive.

3.  With effect from 1 October 1994, Member States may prohibit the first entry into service of vehicles on which the installation of these devices is not in accordance with the requirements of this Directive.

Article 3

►M7  A Member State which has granted EC type-approval shall take the necessary measures to ensure that it is informed of any modification to any of the parts or characteristics referred to in the definition of vehicle type with regard to the installation of lighting and light-signalling devices. ◄ The competent authorities of that Member State shall determine whether further tests should be carried out on the modified vehicle type and a fresh report drawn up. Where such tests reveal failure to comply with the requirements of this Directive, the modification shall not be approved.

Article 4

Any amendments necessary in order to adapt the content of the Annexes to this Directive to take account of technical progress shall be adopted in accordance with the procedure laid down in Article 13 of Directive 70/156/EEC.

Article 5

1.  Member States shall bring into force the legislative, regulatory and administrative provisions necessary in order to comply with this Directive before 1 January 1993 and shall forthwith inform the Commission thereof.

2.  When the Member States adopt these provisions they shall make a reference to this Directive in their official publication. The form of this reference shall be determined by the Member States.

3.  Member States shall ensure that the terms of the main provisions of national law which they adopt in the field covered by this Directive are communicated to the Commission.

ANNEX I

ADMINISTRATIVE PROVISIONS FOR TYPE-APPROVAL

1.   APPLICATION FOR EC TYPE-APPROVAL OF A VEHICLE TYPE

1.1.

The application for EC type-approval pursuant to Article 3 (4) of Directive 70/156/EEC of a vehicle type with regard to the installation of its lighting and light-signalling devices shall be submitted by the manufacturer.

1.2.

A model for the information document is given in Appendix 1.

1.3.

The following must be submitted to the technical service responsible for conducting the type-approval tests:

1.3.1.

a vehicle representative of the type to be approved.

2.   GRANTING OF EC TYPE-APPROVAL OF A VEHICLE TYPE

2.1.

If the relevant requirements are complied with, EC type-approval pursuant to Article 4 (3) of Directive 70/156/EEC shall be granted.

2.2.

A model for the EC type-approval certificate is given in Appendix 2.

2.3.

An approval number in accordance with Annex VII to Directive 70/156/EEC shall be assigned to each type of vehicle approved. The same Member State must not assign the same number to another type of vehicle.

3.   MODIFICATIONS OF THE TYPE AND AMENDMENTS TO APPROVALS

3.1.

In the case of modifications of the type approved pursuant to this Directive, the provisions of Article 5 of Directive 70/156/EEC shall apply.

4.   CONFORMITY OF PRODUCTION

4.1.

As a general rule, measures to ensure the conformity of production shall be taken in accordance with the provisions laid down in Article 10 of Directive 70/156/EEC.

4.2.

Specific requirements with respect to the tests to be carried out are laid down in Annex 9 of the documents referred to in item 1 of Annex II to this Directive.

ANNEX II

1. The technical requirements are those set out in paragraphs 2, 5 and 6 of UN/ECE Regulation No 48 ( 4 ) and Annexes 3 to 9 thereto.

2. For the purposes of the application of the provisions referred to in point 1, the following shall apply:

(a) ‘Unladen vehicle’ means a vehicle the mass of which is described in point 2.6 of Appendix 1 of Annex I to this Directive, without driver;

(b) ‘Communication form’ shall be understood as the type-approval-certificate set out in Appendix 2 of Annex I to this Directive;

(c) ‘Contracting Parties to the respective regulations’ shall be understood as Member States;

(d) the reference to Regulation No 3 shall be construed as reference to Directive 76/757/EEC;

(e) footnote (2) in paragraph 2.7.25 shall not apply;

(f) footnote (8) in paragraph 6.19 shall not apply;

(g) footnote (1) in Annex 5 shall be understood as follows: ‘For definitions of the categories, see Annex II A to Directive 70/156/EEC’.

3. Without prejudice to the requirements of Article 8(2)(a) and (c) and (3) of Directive 70/156/EEC, of this Annex and to any requirements in any of the separate directives, the installation of any other lighting or light-signalling device than those defined in paragraph 2.7 of UN/ECE Regulation No 48 is prohibited.
