amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 64/2001 of 19 June 2001(1).

(2) Commission Directive 2000/51/EC of 26 July 2000 amending Directive 95/31/EC laying down specific criteria of purity concerning sweeteners for use in foodstuffs(2) is to be incorporated into the Agreement.

(3) Commission Directive 2000/63/EC of 5 October 2000 amending Directive 96/77/EC laying down specific purity criteria on food additives other than colours and sweeteners(3) is to be incorporated into the Agreement.

(4) Commission Regulation (EC) No 1565/2000 of 18 July 2000 laying down the measures necessary for the adoption of an evaluation programme in application of Regulation (EC) No 2232/96 of the European Parliament and of the Council(4) is to be incorporated into the Agreement.

(5) Commission Directive 96/77/EC of 2 December 1996 laying down specific purity criteria on food additives other than colours and sweeteners(5) and Commission Directive 98/86/EC of 11 November 1998 amending Directive 96/77/EC laying down specific purity criteria on food additives other than colours and sweeteners(6) have previously been incorrectly incorporated as amending acts in point 46 in Chapter XII of Annex II to the Agreement and should be moved to a new point,

HAS DECIDED AS FOLLOWS:

Article 1

The following indent shall be added in point 46a (Commission Directive 95/31/EC) in Chapter XII of Annex II to the Agreement: "- 32000 L 0051: Commission Directive 2000/51/EC of 26 July 2000 (OJ L 198, 4.8.2000, p. 41)."

Article 2

The following points shall be inserted after point 54ze (Commission Decision 2000/49/EC) in Chapter XII of Annex II to the Agreement: "54zf. 396 L 0077: Commission Directive 96/77/EC of 2 December 1996 laying down specific purity criteria on food additives other than colours and sweeteners (OJ L 339, 30.12.1996, p. 1), as amended by:

- 398 L 0086: Commission Directive 98/86/EC of 11 November 1998 (OJ L 334, 9.12.1998, p. 1),

- 32000 L 0063: Commission Directive 2000/63/EC of 5 October 2000 (OJ L 277, 30.10.2000, p. 1).

54zg. 32000 R 1565: Commission Regulation (EC) No 1565/2000 of 18 July 2000 laying down the measures necessary for the adoption of an evaluation programme in application of Regulation (EC) No 2232/96 of the European Parliament and of the Council (OJ L 180, 19.7.2000, p. 8)."

Article 3

The texts of Commission Directives 2000/51/EC and 2000/63/EC and Commission Regulation (EC) No 1565/2000 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 4

This Decision shall enter into force on 29 September 2001, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(7).

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
