COMMON POSITION of 9 July 1998 defined by the Council on the basis of Article J.2 of the Treaty on European Union, concerning Belarus (98/448/CFSP)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article J.2 thereof,

Whereas the Government of Belarus has taken certain measures or allowed certain measures to be carried out affecting the residences of ambassadors from several Member States of the European Union at the Drozdy diplomatic compound in Minsk;

Whereas these measures, in particular the beginning of construction and repair work on the site, the interruption of power and water supply, and the blocking of access for cars, make any use of the residences concerned impossible and therefore severely impede the performance of the diplomatic missions concerned;

Whereas the European Union considers that these measures taken by or with the consent of the Government of Belarus constitute an infringement of the Vienna Convention on Diplomatic Relations and are contrary to the principle of friendly relations among States;

Whereas the Member States of the European Union, in a spirit of loyalty and mutual solidarity, have decided to react to the behaviour of the Government of Belarus;

Whereas the Member States of the European Union have decided to recall their Ambassadors from Minsk for consultations;

Whereas the Member States of the European Union have also decided to requested Belarussian Ambassadors accredited to them to return to Minsk for reporting;

Whereas the Government of Belarus has subsequently allowed the premises of the Missions of several Member States to be entered without the consent of the Heads of Mission concerned;

Whereas these actions constitute a further infringement of the Vienna Convention on Diplomatic Relations;

Whereas the European Union, while reaffirming its interest in a continued constructive dialogue with Belarus, considers the behaviour of the Government of Belarus unlawful and unacceptable;

Whereas the European Union has decided to adopt the measures indicated below as a reaction to the violation of the premises of the missions concerned;

Whereas the European Union will closely monitor the development of the situation in Belarus, with a view to taking further measures if necessary,

HAS DEFINED THIS COMMON POSITION:

Article 1

1. The persons listed in the Annex shall be reported for the purposes of non-admission in the Member States of the European Union.

2. The same measures will also apply to other persons not listed in the Annex but falling under the categories listed therein.

Article 2

Relations with international organisations having their seat in the Member States and with which Belarus maintains diplomatic relations shall not be affected by the restrictions referred to in Article 1.

Article 3

The implementation of this common position will be monitored by the Presidency, to which the Member States and the Commission will regularly report. It will be reviewed in the light of the development of the situation in Belarus, with a view to adopting more stringent measures if necessary and to updating the list of persons as appropriate.

Article 4

This common position shall take effect on the day of its adoption.

Article 5

This common position shall be published in the Official Journal.
