    European Parliament legislative resolution of 5 February 2013 on the proposal for a regulation of the European Parliament and of the Council laying down specific measures for agriculture in favour of the smaller Aegean islands (COM(2010)0767 — C7-0003/2011 — 2010/0370(COD))

    The European Parliament,

    —

    having regard to the Commission proposal to Parliament and the Council (COM(2010)0767),

    —

    having regard to Article 294(2), the first paragraph of Article 42 and Article 43(2) of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C7-0003/2011),

    —

    having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

    —

    having regard to the opinion of the European Economic and Social Committee of 15 March 2011 (1),

    —

    having regard to the undertaking given by the Council representative by letter of 19 November 2012 to approve Parliament’s position, in accordance with Article 294(4) of the Treaty on the Functioning of the European Union,

    —

    having regard to Rule 55 of its Rules of Procedure,

    —

    having regard to the report of the Committee on Agriculture and Rural Development (A7-0319/2011),

    1.

    Adopts the position at first reading hereinafter set out;

    2.

    Approves the joint declaration by Parliament, the Council and the Commission annexed to this resolution;

    3.

    Calls on the Commission to refer the matter to Parliament again if it intends to amend its proposal substantially or replace it with another text;

    4.

    Instructs its President to forward its position to the Council, the Commission and the national parliaments.

    Position of the European Parliament at first reading on 5 February 2013 with a view to the adoption of Regulation (EU) No …/2013 of the European Parliament and of the Council laying down specific measures for agriculture in favour of the smaller Aegean islands and repealing Council Regulation (EC) No 1405/2006

    (As an agreement was reached between Parliament and Council, Parliament's position corresponds to the final legislative act, Regulation (EU) No 229/2013.)

    Joint declaration of the European Parliament, the Council and the Commission

    In view of the specificities of the measures in favour of agriculture in the smaller Aegean Islands under the SAI scheme, the European Parliament, the Council and the Commission declare that the agreement reached on alignment issues for this regulation will not prejudge the position of any of the three Institutions on similar issues that may be brought for other EU legislation proposals.
