1.   Resumption of session

The sitting opened at 15.05.

2.   Approval of Minutes of previous sitting

The Minutes of the previous sitting were approved.

3.   Membership of Parliament

Bogdan Klich and Barbara Kudrycka had been appointed to the Polish Government with effect from 16.11.2007.

Under Rule 3(2), second subparagraph, of its Rules of Procedure, Parliament noted the appointments and established the vacancies with effect from 16.11.2007, under Article 7(1) of the Act concerning the election of representatives of the European Parliament by direct universal suffrage and under Rule 4(1).

Gitte Seeberg and Anders Samuelsen had been elected to the Danish Parliament with effect from 27.11.2007.

Under Rule 3(2), second subparagraph, of its Rules of Procedure, Parliament noted the appointments and established the vacancies with effect from 27.11.2007, under Article 7(1) of the Act concerning the election of representatives of the European Parliament by direct universal suffrage and under Rule 4(1).

4.   Verification of credentials

The President made the following announcement.

On 15 November 2007, the judge hearing the application for interim measures at the Court of First Instance of the European Communities issued an order suspending the European Parliament decision of 24 May 2007 on the verification of the credentials of Mr Beniamino Donnici. It is, of course, my responsibility to apply this court ruling immediately.

This order rules that the legal situations of Mr Beniamino Donnici and Mr Achille Occhetto that existed before the adoption of the decision in question are re-established with effect from 15 November 2007.

Therefore, pursuant to this order and under Rule 3(2) of the Rules of Procedure, Mr Donnici takes his seat in Parliament and on its bodies and enjoys all the rights attaching thereto at least until the expiration of that order.

On a recommendation by the JURI Committee, I have asked the Legal Service to bring an appeal before the Court of Justice against the order of the judge hearing the application for interim measures at the Court of First Instance.

6.   Texts of agreements forwarded by the Council

The Council had forwarded certified true copies of the following:

agreement between the European Community and the Swiss Confederation in the audiovisual field, establishing the terms and conditions for the participation of the Swiss Confederation in the community programme MEDIA 2007;

agreement between the European Community and the Republic of Moldova on the readmission of persons residing without authorisation;

agreement between the European Community and the Republic of Moldova on the facilitation of the issuance of visas;

agreement between the European Community and the Republic of Montenegro on the readmission of persons residing without authorisation;

agreement between the European Community and Bosnia and Herzegovina on the readmission of persons residing without authorisation;

agreement between the European Community and the Republic of Serbia on the readmission of persons residing without authorisation;

protocol to the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the State of Israel, of the other part, to take account of the accession of the Republic of Bulgaria and Romania to the European Union.

7.   Action taken on Parliament's positions and resolutions

The Commission communication on the action taken on the positions and resolutions adopted by Parliament at the September I and II 2007 part-sessions had been distributed.

8.   Proclamation of consensus on humanitarian aid (motions for resolutions tabled)
