1. Resumption of the session
The sitting opened at 15.05.
2. Approval of the Minutes of the previous sitting
The Minutes of the previous sitting were approved.
3. Composition of Parliament
Joan Calabuig Rull, Ana Mato Adrover, Cristóbal Montoro Romero, Luisa Fernanda Rudi Ubeda and Elena Valenciano Martínez-Orozco had given notification of their election as members of the Spanish Parliament with effect from 01.04.2008.
As this office was incompatible with that of a Member of the European Parliament under Article 7(2) of the Act concerning the election of the members of the European Parliament by direct universal suffrage, Parliament established the vacancies with effect from 01.04.2008.
The Spanish authorities had subsequently informed Parliament of the appointment as Members of the European Parliament, with effect from 07.04.2008, of:

The Finnish authorities had given notification of the appointment of Alexander Stubb as Minister for Foreign Affairs in the Finnish Government, and the appointment of Sirpa Pietikäinen as Member of the European Parliament replacing Alexander Stubb.
Pursuant to Article 7(1) of the Act concerning the election of the members of the European Parliament by direct universal suffrage and to Rule 4(1) of its Rules of Procedure, Parliament had established the vacancy of Alexander Stubb's seat and had noted the appointment of Sirpa Pietikäinen with effect from 04.04.2008.
Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made written declarations stating that they did not hold any office incompatible with that of Member of the European Parliament, the new Members referred to above would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.
4. Murder of the human rights activist Munir Said Thalib (written declaration)
Written declaration 0098/2007 submitted by Raül Romeva i Rueda, Eija-Riitta Korhola, Jules Maaten, Glyn Ford and Ana Maria Gomes on the murder of the human rights activist Munir Said Thalib had been signed by the majority of Parliament's component Members. Consequently, in accordance with Rule 116(4), it would be forwarded to its addressees and published, together with the names of the signatories, in the Texts Adopted of the sitting of 10.04.2008.
5. Subtitling of all public-service television programmes in the EU (written declaration)
Written declaration 0099/2007 submitted by Lidia Joanna Geringer de Oedenberg on the subtitling of all public-service television programmes in the EU had been signed by the majority of Parliament's component Members. Consequently, in accordance with Rule 116(4), it would be forwarded to its addressees and published, together with the names of the signatories, in the Texts Adopted of the sitting of 10.04.2008.

It had authorised the transfer in full under Article 24(2) of the Financial Regulation of 25.06.2002, as amended on 13.12.2006.
12. Action taken on Parliament's positions and resolutions
The Commission communication on the action taken on the positions and resolutions adopted by Parliament at the January I and II 2008 part-sessions was available.
The Commission communication on the action taken by the Commission on the European Parliament resolution of 12.12.2007 on the Commission legislative and work programme for 2008 was available.

14. Waiver of parliamentary immunity
Following Parliament's decision of 27.09.2005 to waive the parliamentary immunity of Marios Matsakis, the authorities of the Republic of Cyprus had notified Parliament under Rule 7(9) that all legal proceedings against Marios Matsakis had been dropped and that he was not currently the subject of any charge or investigation.
This notification would be sent for information to the AFET Committee.
15. Order of business
The next item was the order of business.
The final draft agenda of the April 2008 part-sessions (PE 404.066/PDOJ) had been distributed and the following amendments thereto had been proposed (Rule 132):

2. Article 10, paragraph 2, point (g)
The following terms shall be deleted:
‘in the case of a credit agreement of the kind referred to in Article 2(3), Member States may decide that the annual percentage rate of charge need not be provided;’
3. Article 10, paragraph 5, point (f)
The following terms shall be deleted:
‘in the case of a credit agreement of the kind referred to in Article 2(3),’
4. Article 14, paragraphs 1 and 2
Article 14, paragraphs 1 and 2 shall read:
‘1. The consumer shall have a period of fourteen calendar days in which to withdraw from the credit agreement without giving any reason.
That period of withdrawal shall begin:
(a) |
either from the day of the conclusion of the credit agreement, or |
(b) |
from the day on which the consumer receives the contractual terms and conditions and information in accordance with Article 10, if that day is later than the date referred to in point (a) of this subparagraph. |
2. Where in the case of a linked credit agreement, as defined in point (n) of Article 3, national legislation at the time of the entry into force of this Directive already provides that funds cannot be made available to the consumer before the expiry of a specific period, Member States may exceptionally provide that the period referred to in paragraph 1 of this Article may be reduced to this specific period at the explicit request of the consumer.’
5. Article 26
Article 26 shall read:
‘Where a Member State makes use of any of the regulatory choices referred to in Article 2(5) and 2(6), Article 4(1), point (c) of Article 4(2), Article 6(2), Article 10(1), point (g) of Article 10(2), Article 14(2) and Article 16(4), it shall inform the Commission thereof as well as of any subsequent changes. The Commission shall make that information public on a website or in another easily accessible way. Member States shall take the appropriate measures to diffuse that information amongst national creditors and consumers.’
6. Article 27, paragraph 2
Article 27, paragraph 2 shall read:
‘2. The Commission shall undertake every five years, and for the first time ... (1), a review of the thresholds laid down in this Directive and its annexes and the percentages used to calculate the compensation payable in the event of early repayment, assessing them in the light of economic trends in the Community and the situation of the market concerned. The Commission shall also monitor the effect of the existence of the regulatory choices referred to in Article 2(5) and 2(6), Article 4(1), point (c) of Article 4(2), Article 6(2), Article 10(1), point (g) of Article 10(2), Article 14(2) and Article 16(4) on the internal market and consumers. The results shall be made known to the European Parliament and the Council, accompanied where appropriate by a proposal to modify the thresholds and percentages as well as the abovementioned regulatory choices accordingly.
7. Annex I, part II, point (d), points (i) and (ii)
Annex I, part II, point (d), points (i) and (ii) shall read:
‘(i) |
that the credit is provided for a period of one year; and |
(ii) |
that the credit will be repaid in twelve equal instalments and at monthly intervals;’ |
8. Annex II, point 4, row 2
Annex II, point 4, row 2 shall read:
