declare that, by failing to take all the measures necessary to comply with Article 4 of Council Directive 98/83/EC of 3 November 1998 on the quality of water intended for human consumption (1), the French Republic has failed to fulfil its obligations under that directive;

order the French Republic to pay the costs.

Pleas in law and main arguments

The quality of water intended for human consumption in France does not comply with the provisions of Directive 98/83 in so far as the thresholds laid down in that directive are regularly exceeded, as regards nitrates and pesticides, in the Deux-Sèvres, Charente-Maritime and Vendée Departments.
