    Form of order sought

    A declaration that, by failing to adopt all the laws, regulations and administrative provisions necessary to comply with Directive 2004/24/EC (1) of the European Parliament and of the Council of 31 March 2004 amending, as regards traditional herbal medicinal products, Directive 2001/83/EC on the Community code relating to medicinal products for human use, the Kingdom of Spain has failed to fulfil its obligations under Article 2 of that directive;

    an order that the Kingdom of Spain should pay the costs.

    Pleas in law and main arguments

    The period prescribed for transposition into domestic law of Directive 2004/24/EC expired on 30 October 2005.
