7.   Approval by the Council of Parliament's positions adopted at first reading (Rule 66)

The Council had indicated, in accordance with Article 251(2) of the EC Treaty, its approval of the positions of Parliament adopted at first reading:

on 9 March 2004 with a view to the adoption of the European Parliament and Council Directive on the approximation of the laws of the Member States relating to electromagnetic compatibility and repealing Directive 89/336/EEC (2002/0306(COD));

on 30 March 2004 with a view to the adoption of the European Parliament and Council Directive on the harmonisation of transparency requirements with regard to information about issuers whose securities are admitted to trading on a regulated market and amending Directive 2001/34/EC (2003/0045(COD));

on 20 April 2004 with a view to the adoption of the European Parliament and Council Directive relating to arsenic, cadmium, mercury, nickel and polycyclic aromatic hydrocarbons in ambient air (2003/0164(COD));

on 22 April 2004 with a view to the adoption of the European Parliament and Council Regulation amending Council Regulation (EC) No 975/1999 laying down the requirements for the implementation of development cooperation operations which contribute to the general objective of developing and consolidating democracy and the rule of law and to that of respecting human rights and fundamental freedoms (2003/0250(COD)).

The acts in question were thus adopted, and would be signed by the President of Parliament, with the President of the Council, in accordance with Rule 68 of Parliament's Rules of Procedure.

8.   Order of business

The next item was the order of business.

The final draft agenda for the sitting of December (PDOJ 350.905) had been distributed. The following changes had been proposed under Rule 132:

The Verts/ALE Group requested that the Moscovici report (A6-0061/2004 on Romania's progress towards accession) be placed on the agenda of a later part-session.

The following spoke: Monica Frassoni, who moved the request on behalf of the Verts/ALE Group, and Hannes Swoboda, on behalf of the PSE Group.

Parliament rejected the request.

The PSE and ALDE Groups requested that the Coelho report (A6-0029/2004 on a Uniform format for visas/Uniform format for residence permits) be placed on the agenda of a later part-session.

The following spoke: Hannes Swoboda, who moved the request on behalf of the PSE Group, and Carlos Coelho (rapporteur).

Parliament approved the request by EV (141 for, 111 against, 7 abstentions).

The PSE and Verts/ALE Groups requested that the vote on the Coelho report (A6-0052/2004 on Crossborder vehicle crime) be taken during voting time on Wednesday pursuant to Rule 131.

Hannes Swoboda moved the request on behalf of the PSE Group.

Parliament approved the request.

The following spoke: Pasqualina Napoletano, on behalf of the PSE Group, who requested that the debate on the preparation of the European Council of 17 December 2004(Item 33 of the final draft agenda) include the issue of child prostitution in Cambodia; Hannes Swoboda, who suggested that the President write to the Cambodian Government to draw its attention to the matter (the President agreed to do so); and Marco Pannella, who thought the President should mention in his letter the general situation in Cambodia (the President declined to do so).
