Notice concerning the anti-dumping measures in force in respect of imports into the Community of hardboard originating, inter alia, in Poland: modification of the name of a company with an individual duty rate from which an undertaking was accepted (2004/C 16/07) Imports of hardboard originating, inter alia, in Poland are subject to definitive anti-dumping duties, imposed by Council Regulation (EC) No 194/1999(1) as amended by Council Regulation (EC) No 1899/2001(2). An undertaking was accepted by Commission Decision 1999/71/EC(3) as amended by Commission Decision 2001/707/EC(4) from Alpex-Karlino SA, a Polish company, whose exports to the Community of hardboard are subject to an individual anti-dumping duty rate of 22,4 % by the aforementioned Regulation. The company has informed the Commission that it has changed its name into Pyty-Karlino SA. The company has asked the Commission to confirm that the change of name does not affect the right of the company to benefit from the individual duty rate applied to the company under its previous name of Alpex-Karlino SA nor the right to benefit from the undertaking given by the company, in respect of product types covered by the undertaking, under its previous name. The Commission has examined the information supplied, which demonstrates that all the company's activities linked to the manufacturing, sales and exports of hardboard are unaffected by the change of name. The Commission therefore concludes that the change of name in no way affects the findings of Council Regulation (EC) No 194/1999 and Commission Decision 1999/71/EC. In view of the absence of any substantive change of circumstances, the reference to Alpex-Karlino SA should be read as Pyty-Karlino SA in Articles 1(2) and 2(3) of Council Regulation (EC) No 194/1999 and in Article 1(1) of Commission Decision 1999/71/EC. The Taric additional codes 8479 and 8511 previously attributed to Alpex-Karlino SA shall be replaced by the Taric additional code attributed to Pyty-Karlino SA (ex: Alpex-Karlino SA).
