    COUNCIL DECISION (CFSP) 2023/2205

    of 25 September 2023

    on the signing, and provisional application, and conclusion of the Agreement between the European Union and the Republic of Moldova on the status of the European Union Partnership Mission in Moldova (EUPM Moldova)

    THE COUNCIL OF THE EUROPEAN UNION,

    Having regard to the Treaty on European Union, and in particular Article 37 thereof, in conjunction with Article 218(5) and (6) of the Treaty on the Functioning of the European Union,

    Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

    Whereas:

    (1)

    On 24 April 2023, the Council adopted Decision (CFSP) 2023/855 (1), establishing a civilian European Union Partnership Mission in Moldova (EUPM Moldova).

    (2)

    On 22 May 2023, the Council adopted Decision (CFSP) 2023/993 (2), launching EUPM Moldova.

    (3)

    On 26 June 2023, the Council authorised the High Representative of the Union for Foreign Affairs and Security Policy to open negotiations with the Republic of Moldova with a view to the conclusion of an agreement on the status of EUPM Moldova.

    (4)

    An agreement has been negotiated between the Union and the Republic of Moldova on the basis of the authorisation granted by the Council on 26 June 2023.

    (5)

    The Agreement between the Union and the Republic of Moldova on the status of the European Union Partnership Mission in Moldova (EUPM Moldova) (the ‘Agreement’) should be approved on behalf of the Union.

    (6)

    The Agreement should be applied on a provisional basis, pending the completion of the procedures necessary for its entry into force,

    HAS ADOPTED THIS DECISION:

    Article 1

    The Agreement between the European Union and the Republic of Moldova on the status of the European Union Partnership Mission in Moldova (EUPM Moldova) (3) (the ‘Agreement’) is hereby approved on behalf of the Union.

    Article 2

    The President of the Council is hereby authorised to designate the person(s) empowered to sign the Agreement in order to bind the Union.

    Article 3

    The Agreement shall be applied on a provisional basis as from the signature thereof, pending the completion of the procedures necessary for its entry into force.

    Article 4

    The President of the Council shall, on behalf of the Union, give the notification provided for in Article 19, paragraph 2, of the Agreement (4).

    Article 5

    This Decision shall enter into force on the date of its adoption.
