    Transmissible spongiform encephalopathies ***I

    European Parliament legislative resolution on the proposal for a regulation of the European Parliament and of the Council amending Regulation (EC) No 999/2001 laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies (COM(2004)0775 — C6-0223/2004 — 2004/0270(COD))

    (Codecision procedure: first reading)

    The European Parliament,

    - having regard to the Commission proposal to the European Parliament and the Council (COM(2004) 0775) [1],

    - having regard to Article 251(2) and Article 152(4)(b) of the EC Treaty, pursuant to which the Commission submitted the proposal to Parliament (C6-0223/2004),

    - having regard to Rule 51 of its Rules of Procedure,

    - having regard to the report of the Committee on the Environment, Public Health and Food Safety (A6-0098/2005),

    1. Approves Article 1(14) and amends Article 2 of the Commission proposal;

    2. Will continue its examination of the remainder of the Commission proposal and adopt its first reading thereon at the earliest opportunity;

    3. Splits the proposal accordingly;

    4. Calls on the Commission and the Council to consider the amendments to the transitional regime of Regulation (EC) No 999/2001 and the substantive amendments to the Regulation in two separate Regulations;

    5. Calls on the Commission to refer the matter to Parliament again if it intends to amend the proposal substantially or replace it with another text;

    6. Instructs its President to forward its position to the Council and the Commission.
