    Draft Council Regulation amending Regulation (EC) No 2062/94 establishing a European Agency for Safety and Health at Work (COM(94)0651 - 4824/95 - C4- 0088/95 - 95/0809 (CNS))

    The draft was approved with the following amendments.

    (Amendment 4)

    ARTICLE 1(2)

    Article 8(2), first subparagraph (Regulation (EC) 2062/94)

    2. The members referred to in paragraph 1(a), (b) and (c) shall be appointed by the Council on the basis of one member for each Member State and for each of the abovementioned categories.

    2. The members referred to in paragraph 1(a), (b) and (c) shall be appointed by the Council, if possible on the basis of one member for each Member State and for each of the abovementioned categories.

    6. Decisions by the Administrative Board shall be taken by a majority of two thirds of the votes.

    The members referred to in paragraph 1(a) shall have two votes each.

    6. Decisions by the Administrative Board shall be taken by a majority of two thirds of the votes except for decisions taken pursuant to Article 13(3) and Article 15 in which case a majority of the members referred to in paragraph 1(a) shall also be necessary.

    The members referred to in paragraph 1(b), (c) and (d) shall have one vote each.

    Each member of the Administrative Board shall have one vote.

    ARTICLE 1(3a) (new)

    Article 16 (Regulation (EC) 2062/94)

    3a. Article 16 to read as follows:

    Professional Confidentiality

    Members of the Administrative Board, the Director, the staff and all other persons participating in the activities of the Agency shall be required, even after their duties have ceased, not to disclose information of the kind covered by the obligation of professional confidentiality with regard to individual casework. However, all other areas of the Agency's work shall be open to public scrutiny.

    (Consultation procedure)

    The European Parliament,

    - having regard to the Council draft, COM(94)0651 - 4824/95 - 95/0809(CNS),

    - having been consulted by the Council pursuant to Article 235 of the EC Treaty (C4-0088/95),

    - having regard to Rule 58 of its Rules of Procedure,

    - having regard to the report of the Committee on Social Affairs and Employment and the opinions of the Committee on Budgets and the Committee on Legal Affairs and Citizens' Rights (A4-0103/95),

    1. Approves the Council draft, subject to Parliament's amendments;

    2. Calls on the Commission to alter its proposal accordingly, pursuant to Article 189a of the EC Treaty;

    3. Calls on the Council to notify Parliament should it intend to depart from the text approved by Parliament;

    4. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal;

    5. Instructs its President to forward this opinion to the Council and Commission.
