on a Community position within the EU/Mexico Joint Council concerning the amendments to the Joint Council Decision 2/2000, as amended by Joint Council Decision No 3/2004 of 29 July 2004

EXPLANATORY MEMORANDUM

The EU/Mexico Free Trade area was established by decisions of the EU Mexico Joint Council. Consequently the necessary adaptations to the trade provisions, following the EU enlargement, are made by means of Joint Council decisions and have not been addressed in the Additional Protocol to the EU/Mexico Agreement that was submitted for Council approval via another procedure.

The EU/Mexico Joint Council Decision 2/2000 amended by Joint Council Decision 3/2004 provides for the liberalization of the trade in goods. Following the EU enlargement some adaptations are needed, in particular the addition of the entities of the New Member States to the relevant sections of Annex VI, Part B of Joint Council Decision 2/2000 and new language versions of certain expressions contained in Annex III to that same Decision No 2/2000.

On 23 October 2006 the Council authorised the Commission to negotiate those adaptations. Subsequent negotiations with Mexico resulted in an agreement to add of the entities of the New Member States the relevant sections of Annex VI and to open an import tariff quota for 2000 tonnes of bananas originating in Mexico with a duty rate of 70 EUR/tonne within the quota.

The Commission therefore recommends the Council to adopt the enclosed Council Decision as the EU common position on the proposed EU/Mexico Joint Council Decision in annex.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community and in particular Article 133 thereof, in conjunction with Article 300(2) first subparagraph, first sentence.

Having regard to the proposal from the Commission[1],

Whereas:

1. As from 1 January 2007, the Treaty establishing the European Community also applies in the territory of Romania and the Republic of Bulgaria, following their accession to the European Union.

2. The EU/Mexico Joint Council Decision 2/2000 as amended by Joint Council Decision NO 3/2004 of 29 July 2004 provides for the liberalization of trade in goods between the Parties. Following the EU enlargement to Romania and the Republic of Bulgaria some adaptations are needed, in particular the addition of the entities of the New Member States to the relevant sections of Annex VI, Part B of Joint Council Decision 2/2000.

3. On 23 October 2006 the Council authorised the Commission to negotiate those adaptations. DRAFT DECISION NO 2/2008 OF THE EU-MEXICO JOINT COUNCIL

Amending Joint Council Decision No 2/2000 of 23 March 2000, as amended by Joint Council Decision No 3/2004 of 29 July 2004

THE JOINT COUNCIL

Having regard to the Economic Partnership, Political Coordination and Cooperation Agreement between the European Community and its Member States, of the one part, and the United Mexican States, of the other part, (hereinafter the Agreement) signed in Brussels on 8 December 1997, and in particular Articles 5 and 10 in conjunction with Articles 47 and 56 thereof,

Whereas:

(1) Following the accession to the European Union of Republic of Bulgaria and Romania (hereinafter the new Member States) as of 1 January 2007, a Second Additional Protocol to the Agreement has been signed in Mexico on 29 November 2006 and entered into force on 1 March 2007.

(2) Under these conditions it is necessary to adapt, with effect from the date at which the new Member States acceded to the Agreement, certain provisions of Joint Council Decision No 2/2000 of 23 March 2000 as amended by Joint Council Decision No 3/2004 of 29 July 2004, concerning trade in goods, certification of origin and government procurement.

HAS DECIDED AS FOLLOWS:

Article 1

1. Annex I to Joint Council Decision 2/2000 is hereby amended in accordance with the provisions contained in Annex I to this Decision.

2. This article does not affect the content of the review clause set out in Article 10 of Joint Council Decision No 2/2000.

Article 2

Articles 17(4) and 18(2) and Appendix IV to Annex III to Joint Council Decision 2/2000 are hereby amended in accordance with the provisions of Annex II to this Decision.

Article 3

1. The entities of the new Member States listed in Annex III to this Decision are hereby added to the relevant sections of Annex VI, Part B of Joint Council Decision 2/2000.

2. The publications of the new Member States listed in Annex IV to this Decision are hereby added to Part B of Annex XIII to Joint Council Decision 2/2000.

Article 4

This Decision shall enter into force on the date of its adoption. It will be applied as from the date when the new Member States acceded to the Agreement.
