    COMMISSION IMPLEMENTING REGULATION (EU) 2023/2414

    of 25 October 2023

    correcting Implementing Regulation (EU) 2023/1441 on detailed arrangements for the conduct of proceedings by the Commission pursuant to Regulation (EU) 2022/2560 of the European Parliament and of the Council on foreign subsidies distorting the internal market

    THE EUROPEAN COMMISSION,

    Having regard to the Treaty on the Functioning of the European Union,

    Having regard to Regulation (EU) 2022/2560 of the European Parliament and of the Council of 14 December 2022 on foreign subsidies distorting the internal market (1), and in particular Article 47(1) thereof,

    After consulting the Foreign Subsidies Advisory Committee,

    Whereas:

    (1)

    The French language version of Commission Implementing Regulation (EU) 2023/1441 (2) contains an error in point 3.1 of Annex II concerning notifications of foreign financial contributions, which changes the sense of the provision. The other language versions are not affected.

    (2)

    Implementing Regulation (EU) 2023/1441 also contains an error in note (***) of Table 1 in Annex II, which concerns the ranges that are to be used in that Table to provide an overview of the total estimated financial contributions granted per third country. That error affects all language versions.

    (3)

    Implementing Regulation (EU) 2023/1441 should therefore be corrected accordingly.

    (4)

    Since Article 29 of Regulation (EU) 2022/2560 on prior notification or declaration of foreign financial contributions is to apply from 12 October 2023 as provided for in Article 54(4) of that Regulation, this Regulation should enter into force immediately,

    HAS ADOPTED THIS REGULATION:

    Article 1

    Annex II to Implementing Regulation (EU) 2023/1441 is corrected as follows:

    (1)

    (does not concern the English language);

    (2)

    in Table 1, note (***) is replaced by the following:

    ‘(***)

    		 Use the following ranges: “EUR 4-50 million”, “EUR > 50-100 million”, “EUR > 100-500 million”, “EUR > 500-1 000 million”, “more than EUR 1 000 million”.’

    Article 2

    This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

    This Regulation shall be binding in its entirety and directly applicable in all Member States.
