    DECISION OF THE EEA JOINT COMMITTEE

    No 28/2014

    of 14 February 2014

    amending Annex XIII (Transport) to the EEA Agreement

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

    Whereas:

    (1)

    Commission Implementing Regulation (EU) No 409/2013 of 3 May 2013 on the definition of common projects, the establishment of governance and the identification of incentives supporting the implementation of the European Air Traffic Management Master Plan (1) is to be incorporated into the EEA Agreement.

    (2)

    Annex XIII to the EEA Agreement should therefore be amended accordingly,

    HAS ADOPTED THIS DECISION:

    Article 1

    The following point is inserted after point 66ua (Commission Regulation (EU) No 176/2011) of Annex XIII to the EEA Agreement:

    ‘66ub.

    		 32013 R 0409: Commission Implementing Regulation (EU) No 409/2013 of 3 May 2013 on the definition of common projects, the establishment of governance and the identification of incentives supporting the implementation of the European Air Traffic Management Master Plan (OJ L 123, 4.5.2013, p. 1).’

    Article 2

    The text of Implementing Regulation (EU) No 409/2013 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 15 February 2014, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1), or on the day of the entry into force of Decision of the EEA Joint Committee No 228/2013 of 13 December 2013 (2), whichever is the later.

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
