Having regard to Directive 2014/40/EU of the European Parliament and of the Council of 3 April 2014 on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco and related products and repealing Directive 2001/37/EC (1), and in particular Article 10(4) thereof,ob upoštevanju Direktive 2014/40/EU Evropskega parlamenta in Sveta z dne 3. aprila 2014 o približevanju zakonov in drugih predpisov držav članic o proizvodnji, predstavitvi in prodaji tobačnih in povezanih izdelkov in razveljavitvi Direktive 2001/37/ES (1) ter zlasti člena 10(4) Direktive,
Whereas:ob upoštevanju naslednjega:
(1) | Directive 2014/40/EU established new rules on health warnings, including combined health warnings, to be placed on tobacco products for smoking. The combined health warnings should contain one of the text warnings listed in Annex I to that Directive, a corresponding colour photograph specified in the picture library in Annex II to that Directive, and smoking cessation information. They should cover 65 % of the external front and back surfaces of unit packets and any outside packaging.(1) | Direktiva 2014/40/EU je določila nova pravila o zdravstvenih opozorilih, vključno s sestavljenimi zdravstvenimi opozorili, ki jih je treba natisniti na tobačne izdelke za kajenje. Sestavljena zdravstvena opozorila bi morala vsebovati eno od besedilnih opozoril, naštetih v Prilogi I k navedeni direktivi, ustrezno barvno fotografijo, določeno v knjižnici slik v Prilogi II k navedeni direktivi, in informacije o opuščanju kajenja. (2) | The technical specifications for the layout, design and shape of the combined health warnings, taking into account different packet shapes, should be established. In particular, the positioning of the photograph, the text warning and the cessation information within the combined health warning, the size of those elements, the format, colours and fonts to be used should be specified in order to ensure that each element is fully visible.(2) | Treba bi bilo določiti tehnične specifikacije za razporeditev, zasnovo in obliko sestavljenih zdravstvenih opozoril ob upoštevanju različnih oblik zavojčkov. (3) | Given the different packet shapes and sizes on the market, it is appropriate to require that combined health warnings be laid out in a stacked or side-by-side format. Where the height of the combined health warning is greater than 70 % of its width, a stacked format should be used. Where the height of the combined health warning is greater than 20 % but less than 65 % of its width, a side-by-side format should be used. Where the height of the combined health warning is greater than or equal to 65 % but less than or equal to 70 % of its width, manufacturers of tobacco products should be allowed to choose which format to use, as long as all the elements of the combined health warning remain fully visible and are not distorted.(3) | Glede na različne oblike in velikosti zavojčkov na trgu je primerno zahtevati, da so sestavljena zdravstvena opozorila razporejena v navpični ali vzporedni postavitvi. Če višina sestavljenega zdravstvenega opozorila presega 70 % njegove širine, bi bilo treba uporabiti navpično postavitev. (4) | In order to ensure that the photograph is the most salient element of the combined health warning, it should be positioned at the top of combined health warnings in the stacked format and on the left half of combined health warnings in the side-by-side format. The photograph should also be the largest element in the combined health warning.(4) | Da bi zagotovili, da je fotografija najopaznejši element sestavljenega zdravstvenega opozorila, jo je treba pri navpični postavitvi natisniti na vrh sestavljenega zdravstvenega opozorila in pri vzporedni postavitvi na levo polovico sestavljenega zdravstvenega opozorila. (5) | Where, due to the shape of the unit packet or outside packaging, the combined health warning is significantly wider than it is high, it is, however, appropriate to provide for special rules concerning the size of the elements of the combined health warning, in order to ensure that the photograph is not distorted upon scaling and that the text warning and cessation information remain fully visible and readable.(5) | Če je zaradi oblike zavojčka ali zunanje embalaže sestavljeno zdravstveno opozorilo veliko širše, kot je visoko, pa je primerno določiti posebna pravila glede velikosti elementov sestavljenega zdravstvenega opozorila, da bi zagotovili, da fotografija ni popačena zaradi prilagajanja obliki in da besedilno opozorilo ter informacije o opuščanju kajenja ostanejo v celoti vidni in čitljivi.
(6) | In order to ensure visibility and clarity of the combined health warning, rules should be laid down concerning colours, minimum resolution, font and space between lines. Unavoidable print tolerances are considered acceptable.(6) | Da bi zagotovili, da so sestavljena zdravstvena opozorila vidna in jasna, bi bilo treba določiti pravila glede barv, najmanjše ločljivosti, pisave in razmika med vrsticami. (7) | It is appropriate to provide for special rules concerning combined health warnings to be placed on the front of unit packets with a flip-top lid where the lid covers a surface area that is larger or smaller than the 50 % of the surface area foreseen for the photograph and the opening of the flip-top lid would lead to a split of either the photograph, the text warning or the cessation information. In these cases it is appropriate to provide for more flexible rules as regards the size of each of the three elements of the combined health warning. Manufacturers or importers should also be allowed to reduce the font size and the space between lines in the text warning and in the cessation information where the combined health warning on the front of such packets is in more than one language or where this is unavoidable on tobacco products for smoking other than cigarettes, roll-your-own tobacco and waterpipe tobacco, provided that all elements remain fully visible.(7) | Primerno je določiti posebna pravila glede sestavljenih zdravstvenih opozoril na sprednji strani zavojčkov s pokrovčkom, pri katerih pokrovček pokriva površino, ki je večja ali manjša od 50 % površine, predvidene za fotografijo, in bi se ob odprtju pokrovčka prelomila fotografija, besedilno opozorilo ali informacije o opuščanju kajenja. V teh primerih je ustrezno določiti prožnejša pravila glede velikosti vsakega od treh elementov sestavljenega zdravstvenega opozorila. Proizvajalci ali uvozniki bi morali imeti tudi možnost, da zmanjšajo velikost črk in razmik med vrsticami v besedilnem opozorilu in informacijah o opuščanju kajenja, kjer je sestavljeno zdravstveno opozorilo na sprednji strani takšnih zavojčkov v več kot enem jeziku ali kjer je to neizogibno na tobačnih izdelkih za kajenje razen cigaret, tobaka za zvijanje in tobaka za vodne pipe, pod pogojem, da vsi elementi ostanejo v celoti vidni.

This Decision establishes rules on the layout, design and shape of combined health warnings for tobacco products for smoking.Ta sklep določa pravila o razporeditvi, zasnovi in obliki sestavljenih zdravstvenih opozoril za tobačne izdelke za kajenje.
Article 2Člen 2
Layout and shape of the combined health warningRazporeditev in oblika sestavljenih zdravstvenih opozoril
1.   Where the height of the combined health warning is greater than 70 % of its width, manufacturers shall lay out the combined health warnings in a stacked format as illustrated in section 1 of the Annex.1.   Če višina sestavljenega zdravstvenega opozorila presega 70 % njegove širine, proizvajalci sestavljena zdravstvena opozorila razporedijo v navpični postavitvi, kot je prikazano v oddelku 1 Priloge.
Where the height of the combined health warning is greater than 20 % but less than 65 % of its width, manufacturers shall lay out the combined health warnings in a side-by-side format as illustrated in section 2 of the Annex.Če višina sestavljenega zdravstvenega opozorila presega 20 %, vendar znaša manj kot 65 % njegove širine, proizvajalci sestavljena zdravstvena opozorila razporedijo v vzporedni postavitvi, kot je prikazano v oddelku 2 Priloge.

2.   Where a stacked format is used, the photograph shall be placed at the top of the combined health warning, with the text warning and cessation information printed underneath as illustrated in section 1 of the Annex. The photograph shall occupy 50 %, the text warning 38 % and the cessation information 12 % of the surface area of the combined health warning inside the outer black border.2.   Kadar je uporabljena navpična postavitev, se fotografija razporedi na vrh sestavljenega zdravstvenega opozorila, spodaj pa se natisnejo besedilno opozorilo in informacije o opuščanju kajenja, kot je prikazano v oddelku 1 Priloge. Fotografija pokriva 50 %, besedilno opozorilo 38 % in informacije o opuščanju kajenja 12 % površine sestavljenega zdravstvenega opozorila znotraj zunanjega črnega okvirja.
Where the side-by-side format is used, the photograph shall be placed on the left half of the combined health warning, with the text warning at the top right and the cessation information at the bottom right of the warning as illustrated in section 2 of the Annex. The photograph shall occupy 50 %, the text warning 40 % and the cessation information 10 % of the surface area of the combined health warning inside the outer black border.Kadar je uporabljena vzporedna postavitev, se fotografija razporedi na levo polovico sestavljenega zdravstvenega opozorila, besedilno opozorilo zgoraj desno in informacije o opuščanju kajenja spodaj desno v opozorilu, kot je prikazano v oddelku 2 Priloge. 3.   Where, due to the shape of the unit packet or outside packaging, the height of the combined health warning is less than or equal to 20 % of its width, the combined health warning shall be laid out in a side-by-side extra-wide format as illustrated in section 3 of the Annex. The photograph shall occupy 35 %, the text warning 50 % and the cessation information 15 % of the surface area of the combined health warning inside the outer black border.3.   Če je zaradi oblike zavojčka ali zunanje embalaže višina sestavljenega zdravstvenega opozorila manjša od ali enaka 20 % njegove širine, se sestavljeno zdravstveno opozorilo razvrsti v vzporedni posebno široki postavitvi, kot je prikazano v oddelku 3 Priloge. Fotografija pokriva 35 %, besedilno opozorilo 50 % in informacije o opuščanju kajenja 15 % površine sestavljenega zdravstvenega opozorila znotraj zunanjega črnega okvirja.
Article 3Člen 3
Design of the combined health warningZasnova sestavljenih zdravstvenih opozoril
1.   The combined health warning shall be printed in four-colour CMYK. All elements in black shall be C0, M0, Y0 and K100 and those in warm yellow shall be C0, M10, Y100 and K0.1.   Sestavljena zdravstvena opozorila se natisnejo v štiribarvnem modelu CMYK. Vsi elementi v črni barvi so C0, M0, Y0 in K100, tisti v topli rumeni barvi pa C0, M10, Y100 in K0.
The combined health warning shall be reproduced at a minimum resolution of 300 dpi when printed in actual size.Sestavljeno zdravstveno opozorilo se natisne z najmanjšo ločljivostjo 300 dpi, ko je natisnjeno v dejanski velikosti.
2.   The text warning shall be printed in white on a black background.2.   Besedilno opozorilo se natisne v beli barvi na črni podlagi.
Where tobacco products for smoking are intended to be placed on the market in Member States with more than one official language, the text warning in the first language shall be printed in white, the text warning in the second language shall be printed in warm yellow and the text warning in the third language, if applicable, shall be printed in white.Kadar so tobačni izdelki za kajenje namenjeni za dajanje na trg v državah članicah z več kot enim uradnim jezikom, se besedilno opozorilo v prvem jeziku natisne v beli barvi, besedilno opozorilo v drugem jeziku se natisne v topli rumeni barvi in besedilno opozorilo v tretjem jeziku, če je to primerno, se natisne v beli barvi.

3.   Where a side-by-side, stacked reversed or side-by-side extra-wide format is used, a 1 mm black border shall be printed between the cessation information and the photograph within the cessation information panel.3.   Kadar je uporabljena vzporedna postavitev, navpična postavitev s spremenjeno razporeditvijo ali vzporedna posebno široka postavitev, se med informacijami o opuščanju kajenja in fotografijo v polju z informacijami o opuščanju kajenja natisne črn okvir, širok 1 mm.
4.   The manufacturers or importers shall ensure that the photograph:4.   Proizvajalci ali uvozniki zagotovijo, da (je) fotografija:

5.   The manufacturers shall ensure that:5.   Proizvajalci zagotovijo, da:

(b) | the text warning and cessation information are printed in Neue Frutiger Condensed Bold;(b) | so besedilno opozorilo in informacije o opuščanju kajenja natisnjeni v pisavi Neue Frutiger Condensed Bold;
(c) | the text warning is printed in a uniform font size;(c) | je besedilno opozorilo natisnjeno v enotni velikosti črk;
(d) | the font size of the text warning and of the cessation information is as large as possible to ensure maximum visibility of the text;(d) | so črke besedilnega opozorila in informacij o opuščanju kajenja kar največje, da se zagotovi največja možna vidnost besedila;
(e) | the minimum font size of the text warning is 6 pt and the minimum font size of the cessation information is 5 pt;(e) | je najmanjša velikost črk besedilnega opozorila 6 pt, najmanjša velikost črk informacij o opuščanju kajenja pa 5 pt;
(f) | the space between lines is 2 pt larger than the font size of the text warning and is 1 to 2 pt larger than the font size of the cessation information;(f) | je razmik med vrsticami za 2 pt večji od velikosti črk besedilnega opozorila in 1 do 2 pt večji od velikosti črk informacij o opuščanju kajenja;

By way of derogation from points (e) and (f), manufacturers or importers of tobacco products for smoking other than cigarettes, roll-your-own tobacco and waterpipe tobacco may reduce the font size or space between the lines of the text warning and cessation information where unavoidable, provided that all elements of the combined health warning remain fully visible.Z odstopanjem od točk (e) in (f) lahko proizvajalci ali uvozniki tobačnih izdelkov za kajenje razen cigaret, tobaka za zvijanje in tobaka za vodne pipe zmanjšajo velikost črk ali razmik med vrsticami besedilnega opozorila in informacij o opuščanju kajenja, če je to neizogibno, pod pogojem, da vsi elementi sestavljenega zdravstvenega opozorila ostanejo v celoti vidni.
Article 4Člen 4
Special rules for certain unit packets with a flip-top lidPosebna pravila za nekatere zavojčke s pokrovčkom
1.   By way of derogation from the first subparagraph of Article 2(2), the following rules shall apply to combined health warnings to be placed on the front of unit packets having a flip-top lid:1.   Z odstopanjem od prvega pododstavka člena 2(2) se uporabljajo naslednja pravila za sestavljena zdravstvena opozorila, ki se natisnejo na sprednji strani zavojčkov s pokrovčkom:
(a) | where the lid is smaller than the surface area foreseen for the photograph in Article 2(2) and compliance with that provision would result in the photograph being split upon opening: | (i) | the text warning shall be placed at the top of the combined health warning, with the cessation information and photograph underneath as illustrated in section 4 of the Annex; and | (ii) | the photograph shall occupy at least 50 % of the surface area of the combined health warning, the text warning at least 30 % and the cessation information at least 10 % but no more than 12 % of the surface area of the combined health warning inside the outer black border;(a) | če je pokrovček manjši od površine, predvidene za fotografijo v členu 2(2), in bi upoštevanje te določbe povzročilo, da se ob odprtju prelomi fotografija: | (i) | se besedilno opozorilo razvrsti na vrh sestavljenega zdravstvenega opozorila, spodaj pa se natisnejo informacije o opuščanju kajenja in fotografija, kot je prikazano v oddelku 4 Priloge; in | (ii) | fotografija pokriva vsaj 50 % površine sestavljenega zdravstvenega opozorila, besedilno opozorilo vsaj 30 % in informacije o opuščanju kajenja vsaj 10 %, vendar ne več kot 12 % površine sestavljenega zdravstvenega opozorila znotraj zunanjega črnega okvirja;

Manufacturers shall ensure that none of the three elements of the combined health warning is split upon opening of the unit packet.Proizvajalci zagotovijo, da se ob odprtju zavojčka ne prelomi noben od treh elementov sestavljenega zdravstvenega opozorila.
2.   By way of derogation from Article 3(5)(e) and (5)(f), manufacturers or importers of cigarettes, roll-your-own tobacco and waterpipe tobacco in unit packets with a flip-top lid may reduce the font size or space between the lines of the text warning and cessation information on the front of packages where the combined health warning is in more than one language, provided that all elements of the combined health warning remain fully visible.2.   Z odstopanjem od člena 3(5)(e) in (f) lahko proizvajalci ali uvozniki cigaret, tobaka za zvijanje in tobaka za vodne pipe v zavojčkih s pokrovčkom zmanjšajo velikost črk ali razmik med vrsticami besedilnega opozorila in informacij o opuščanju kajenja na sprednji strani zavojčka, če je sestavljeno zdravstveno opozorilo v več kot enem jeziku, pod pogojem, da vsi elementi sestavljenega zdravstvenega opozorila ostanejo v celoti vidni.
