| Having regard to the Treaty establishing the European Community, and in particular Article 43 thereof, | o statistických zjišťováních o mléku a mléčných výrobcích |

| Whereas Council Directive 72/280/EEC of 31 July 1972 on the statistical surveys to be made by the Member States on milk and milk products (3) has been amended on several occasions; whereas, in the light of new amendments, it is in the interest of transparency to reformulate the provisions of the said Directive; | s ohledem na návrh Komise [1], |
| Whereas in order to carry out its duties under the Treaty and under Community provisions on the common organization of the market in milk and milk products the Commission needs reliable information about the production and use of milk and regular, reliable, short-term information about the delivery of milk to enterprises which treat or process milk and about the production of milk products in the Member States; | s ohledem na stanovisko Evropského parlamentu [2], |
| Whereas surveys on the production and use of milk on the farm should be conducted in accordance with uniform criteria and in greater detail, and monthly surveys should be made in all Member States in enterprises which process milk; | vzhledem k tomu, že směrnice Rady 72/280/EEC ze dne 31. července 1972 o statistických zjišťováních prováděných členskými státy o mléku a mléčných výrobcích [3] byla několikrát při různých příležitostech měněna; že v zájmu transparentnosti je s ohledem na nové změny potřeba, aby byla znovu formulována opatření této směrnice; |
| Whereas, in order to obtain comparable results, common criteria should be fixed as regards the scope of the survey, the characteristics to be noted and the survey procedure; | vzhledem k tomu, že pro plnění povinností stanovených Smlouvou a předpisy Společenství o společné organizaci trhu s mlékem a mléčnými výrobky potřebuje Komise spolehlivé informace o produkci a spotřebě mléka a potřebuje také pravidelné, spolehlivé a aktuální informace o dodávce mléka podnikům zpracovávajícím mléko a o produkci mléčných výrobků v členských státech; |
| Whereas experience acquired in implementing the previous rules has shown that it would be useful to simplify the provisions, in particular by abolishing the requirement to provide weekly results; | vzhledem k tomu, že je nezbytné provádět zjišťování o produkci a spotřebě mléka v zemědělských podnicích podle jednotných kritérií a podrobněji a ve všech členských státech je třeba provádět měsíční zjišťování v podnicích zpracovávajících mléko; |
| Whereas, in view of the growing importance of the milk-protein content of milk products the appropriate steps must be taken; | vzhledem k tomu, že obdržení srovnatelných výsledků vyžaduje, aby byla stanovena společná kritéria, pokud jde o rozsah zjišťování, sledované ukazatele a postup použitý při zjišťování; |
| Whereas, in order to facilitate implementation of the provisions of this Directive, it is appropriate to continue the close cooperation between the Member States and the Commission, particularly in the Standing Committee for Agricultural Statistics established by Decision 72/279/EEC (4), | vzhledem k tomu, že dosavadní zkušenosti získané při provádění uvedených ustanovení ukázaly, že by bylo užitečné tato ustanovení zjednodušit, zejména zrušením požadavku poskytování týdenních výsledků; |

| 1. shall survey the survey units specified in Article 2 for the data specified in Article 4, and shall inform the Commission of the monthly, annual and triennial results; | Článek 1 |

| The surveys referred to in Article 1 (1) shall cover: | 3. mohou se souhlasem Komise použít údaje z jiných administrativních zdrojů. |
| 1. undertakings or agricultural holdings which purchase whole milk or, in certain cases, milk products, either directly from agricultural holdings or from the undertakings referred to in point 2, with a view to transforming them into milk products; | Článek 2 |
| 2. undertakings which collect milk or cream in order to transfer it in whole or in part, without any processing, to the undertakings referred to in point 1. | Zjišťování uvedená v článku 1 se týkají: |
| Member States shall take all appropriate measures to prevent duplication of results as far as possible. | 1. společností nebo zemědělských podniků, které nakupují plnotučné mléko případně mléčné výrobky přímo od zemědělských podniků nebo od podniků uvedených v bodě 2 za účelem zpracování na mléčné výrobky; |
| Article 3 | 2. podniků, které shromažďují mléko nebo smetanu a dané množství úplně nebo částečně dodávají do podniků uvedených v bodě 1, aniž by samy dále mléko zpracovávaly. |
| 1. For the purpose of this Directive, 'milk` means the milk of cows, ewes, goats and buffaloes. The monthly surveys provided for in Article 4 (1) (a) shall cover only cow's milk and products manufactured exclusively from cow's milk. | Členské státy přijmou odpovídající opatření, aby co nejvíce zabránily dvojímu započítávání výsledků. |
| 2. The list of milk products covered by the surveys shall be adopted in accordance with the procedure laid down in Article 7. That list may be amended in accordance with the same procedure. | Článek 3 |
| 3. The standard definitions to be used for communicating the results for the various products shall be drawn up in accordance with the procedure laid down in Article 7. | 1. Pro účely této směrnice se "mlékem" rozumí mléko kravské, ovčí, kozí a buvolí. Měsíční zjišťování uvedená v čl. 4 odst. 1 písm. a) se týkají pouze mléka kravského a produktů vyrobených výhradně z kravského mléka. |
| Article 4 | 2. Seznam mléčných výrobků pokrytých zjišťováním se stanoví postupem podle článku 7. Tento seznam může být změněn totožným postupem. |
| 1. The surveys referred to in Article 1 (1) must permit at least the information mentioned in points (a), (b) and (c) below to be provided. | 3. Standardní definice používaná pro sdělování výsledků pro různé produkty se vypracuje postupem podle článku 7. |
| Questionnaires must be compiled in such a way as to avoid duplication. | Článek 4 |
| The information shall relate to: | 1. Zjišťování uvedená v čl. 1 odst. 1 musí umožňovat přinejmenším poskytování informací uvedených v písmenech a) až c). |
| (a) monthly: | Dotazníky je nezbytné sestavit tak, aby se zabránilo dvojímu započítávání. |
| (i) the quantity and fat content of the milk and cream collected and the protein content of the cows' milk collected; | Informace se týkají: |
| (ii) the quantity of certain fresh milk products processed and available for delivery and of certain manufactured dairy products; | a) měsíčně: |
| (b) annually: | i) množství a obsahu tuku v získaném mléce a smetaně a obsahu bílkovin v získaném kravském mléce; |
| (i) the quantity, fat content and protein content of the available milk and cream; | ii) množství určitých zpracovaných produktů z čerstvého mléka, které je k dispozici pro dodání, a množství některých zpracovaných mléčných výrobků; |
| (ii) the quantity of fresh milk products which have been processed and which are available for delivery, and of other manufactured dairy products, broken down by type; | b) ročně: |
| (iii) the use of raw materials in the form of whole milk and skimmed milk and the amount of fats used in the manufacture of dairy products; | i) množství, obsahu tuku a bílkovin v mléce a smetaně, které jsou k dispozici; |
| (c) triennially (as from 31 December 1997): | ii) množství zpracovaných produktů z čerstvého mléka, které je k dispozici, a ostatních mléčných výrobků členěných podle druhů; |
| the number of the survey units referred to in Article 2, broken down by size class. | iii) spotřebu surovin ve formě plnotučného odstředěného mléka a množství tuků použitých při produkci mléčných výrobků; |
| 2. With a view to analyzing, within three years of the entry into force of this Directive the possibility of extending the annual statistical information referred to in point (b) to include the protein content of the main milk products, Member States shall during that period conduct pilot surveys or studies on achieving that objective. In accordance with the procedure laid down in Article 7, the Commission shall establish a work programme for each of these three years. | c) jednou za tři roky (od 31. prosince 1997): |
| Member States shall submit annually to the Commission a report on the implementation of this programme, including the statistical data available and the information necessary for interpreting it. | počet zjišťovaných jednotek uvedených v článku 2 členěných podle velikostních tříd. |
| Article 5 | 2. S ohledem na analýzu možnosti rozšíření ročních statistických informací uvedených v písmenu b) o obsah bílkovin u hlavních mléčných výrobků provedou členské státy během tří let od vstupu této směrnice v platnost pilotní zjišťování nebo studie, pokud jde o možnost dosažení tohoto cíle. Postupem podle článku 7 stanoví Komise v každém z těchto tří let pracovní program. |
| 1. Without prejudice to the second subparagraph, the surveys referred to in Article 1 (1) shall be exhaustive in the case of dairies accounting for at least 95 % of the cow's milk collected by the Member State, with the balance being estimated on the basis of representative samples or other sources. | Členské státy poskytnou každoročně Komisi zprávu o provádění tohoto programu včetně dostupných statistických dat a potřebných informací za účelem její interpretace. |
| Member States may carry out the monthly surveys mentioned in Article 4 (1) (a) in the form of sample surveys. In that case the sampling error must not exceed 1 % of total national collection (with a confidence interval of 68 %). | Článek 5 |
| 2. Member States shall take all appropriate measures to obtain comprehensive and sufficiently accurate results. They shall forward to the Commission in the form of a methodological report all information enabling the accuracy of the results transmitted to be assessed, in particular: | 1. Aniž jsou dotčena ustanovení druhého pododstavce, provedou se zjišťování uvedená v čl. 1 odst. 1 ve formě úplných statistických zjišťování v případě mlékárenských podniků, které produkují alespoň 95 % kravského mléka v členském státě, tak, že bilance se odhadne na základě reprezentativních výběrových šetření nebo jiných zdrojů. |
| (a) the questionnaires used; | Členské státy mohou provádět měsíční zjišťování uvedená v čl. 4 odst. 1 písm. a) ve formě výběrových šetření. V tom případě nesmí výběrová chyba přesáhnout 1 % (s intervalem spolehlivosti 68 %) z celkového objemu dodávek v členském státě |
| (b) the precautions taken to avoid double counting; | 2. Členské státy přijmou veškerá vhodná opatření k získání úplných a dostatečně přesných výsledků. Předají Komisi ve formě metodické zprávy všechny informace umožňující ohodnocení přesnosti poskytnutých informací, zejména: |
| (c) the methods used for transposing the data obtained from the questionnaire to Community tables. | a) použité dotazníky; |
| The methodological reports, the availability and reliability of data and any other matter related to the implementation of this Directive shall be examined once a year in the relevant working party of the Standing Committee for Agricultural Statistics. The first methodological report shall be forwarded to the Commission at the latest by the end of the year following the entry into force of this Directive. | b) opatření přijatá pro zabránění dvojího započítávání; |
| Article 6 | c) metody použité pro převedení dat obdržených z dotazníků do tabulek Společenství. |
| 1. Tables for the transmission of data shall be prepared in accordance with the procedure laid down in Article 7. | Metodické zprávy, dostupnost a spolehlivost dat a všechny další otázky týkající se provádění této směrnice se vyhodnocují jednou za rok v odpovídající pracovní skupině Stálého výboru pro zemědělskou statistiku. První metodická zpráva se předá Komisi nejpozději koncem roku po vstupu této směrnice v platnost. |
| These tables may be amended in accordance with the same procedure. | Článek 6 |
| 2. Member States shall transmit the results referred to in paragraph 3, including data which are deemed confidential under national legislation or rules applied with regard to statistical confidentiality, in accordance with the provisions of Council Regulation (Euratom, EEC) No 1588/90 of 11 June 1990 on the transmission of data subject to statistical confidentiality to the Statistical Office of the European Communities (5). | 1. Tabulky pro přenos dat se připraví postupem podle článku 7. |
| 3. Member States shall send to the Commission as soon as possible after summarizing the information, and at the latest: | Tyto tabulky mohou být změněny stejným postupem. |
| (a) forty-five days after the end of the return month, the monthly results referred to in Article 4 (1) (a); | 2. Členské státy předají výsledky uvedené v odstavci 3, které se považují za důvěrné podle vnitrostátních právních předpisů nebo pravidel v souladu s ustanoveními nařízení Rady (Euratom, EHS) č. 1588/90 ze dne 11. června 1990 o předávání údajů, na které se vztahuje statistická důvěrnost, Statistickému úřadu Evropských společenství [5]. |
| (b) in June of the year following the return year: | 3. Členské státy zašlou Komisi co nejdříve po shromáždění údajů a nejpozději: |

| 4. The Commission shall collate the information sent by the Member States and notify them of the overall results. | - zprávu o provádění uvedenou v čl. 4 odst. 2; |

| 1. Where the procedure laid down in this Article is to be followed, the Chairman of the Standing Committee for Agricultural Statistics (hereinafter called 'the Committee`) shall refer the matter to the Committee, either on his own initiative or at the request of a representative of a Member State. | 4. Komise shrne informace zaslané členskými státy a oznámí jim celkové výsledky. |
| 2. The representative of the Commission shall submit to the Committee a draft of the measures to be taken. The Committee shall deliver its opinion on the draft within a time limit which the Chairman may lay down according to the urgency of the matter. The opinion shall be delivered by the majority laid down in Article 148 (2) of the Treaty in the case of decisions which the Council is required to adopt on a proposal from the Commission. The votes of the representatives of the Member States within the Committee shall be weighted in the manner set out in that Article. The Chairman shall not vote. | Článek 7 |
| 3. (a) The Commission shall adopt the measures envisaged if they are in accordance with the opinion of the committee. | 1. Má-li být zahájen postup podle tohoto článku, přednese věc Výboru pro zemědělskou statistiku (dále jen "výbor") jeho předseda, a to buď z vlastního podnětu, nebo na žádost zástupce některého členského státu. |
| (b) If the measures envisaged are not in accordance with the opinion of the Committee, or if no opinion is delivered, the Commission shall without delay submit to the Council a proposal relating to the measures to be taken. The Council shall act by a qualified majority. | 2. Zástupce Komise předloží výboru návrh opatření, která mají být přijata. Výbor zaujme stanovisko k návrhu ve lhůtě, kterou může předseda stanovit podle naléhavosti věci. Stanovisko se přijímá většinou podle čl. 148 odst. 2 Smlouvy pro přijímání rozhodnutí, která má Rada přijímat na návrh Komise. Hlasům zástupců členských států ve výboru je přidělena váha stanovená v uvedeném článku. Předseda nehlasuje. |
| (c) If, on the expiry of a period of three months from the date of referral of the proposal to the Council, the Council has not acted, the proposed measures shall be adopted by the Commission. | 3. a) Komise přijme zamýšlená opatření, jsou-li v souladu se stanoviskem výboru. |
| Article 8 | b) Pokud zamýšlená opatření nejsou v souladu se stanoviskem výboru nebo pokud výbor žádné stanovisko nezaujme, předloží Komise Radě neprodleně návrh opatření, která mají být přijata. Rada se usnese kvalifikovanou většinou. |
| No later than 1 July 1999, the Commission shall submit to the Council a report on experience acquired in implementing this Directive. At the same time it shall submit, in particular, the results of the analysis referred to in Article 4 (2) accompanied where appropriate by proposals regarding the definitive period. | c) Pokud se Rada neusnese ve lhůtě tří měsíců od data, kdy byl návrh Radě odkázán, přijme navrhovaná opatření Komise. |

| 1. Directive 72/280/EEC shall be repealed with effect from 1 January 1997. | Do 1. července 1999 předloží Komise Radě zprávu o zkušenostech získaných při provádění této směrnice. Současně předá zejména výsledky analýzy uvedené v čl. 4 odst. 2 a případně přiloží návrhy, pokud jde o poslední sledované období. |
| 2. The references to the repealed Directive 72/280/EEC shall be construed as referring to this Directive. | Článek 9 |
| Article 10 | 1. Směrnice 72/280/EHS se zrušuje od 1. ledna 1997. |
| 1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 1 January 1997. They shall forthwith inform the Commission thereof. | 2. Odkazy na zrušenou směrnici se považují za odkazy na tuto směrnice. |
| When Member States adopt these provisions, they shall contain a reference to this Directive or shall be accompanied by such reference on the occasion of their official publication. The methods of making such reference shall be laid down by Member States. | Článek 10 |
| 2. Member States shall communicate to the Commission the text of the main provisions of domestic law which they adopt in the field governed by this Directive. | 1. Členské státy uvedou v účinnost právní a správní předpisy nezbytné pro dosažení souladu s touto směrnicí nejpozději do 1. ledna 1997. Neprodleně o nich uvědomí Komisi. |
| Article 11 | Tato opatření přijatá členskými státy musí obsahovat odkaz na tuto směrnici nebo musí být takový odkaz učiněn při jejich úředním vyhlášení. Způsob odkazu si stanoví členské státy. |
| This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Communities. | 2. Členské státy sdělí Komisi znění hlavních ustanovení vnitrostátních právních předpisů, které přijmou v oblasti působnosti této směrnice. |

| This Directive is addressed to the Member States. | Tato směrnice vstupuje v platnost dvacátým dnem po jejím vyhlášení v Úředním věstníku Evropských společenství. |
