Having regard to the Treaty establishing the European Community, and in particular Article 285(1) thereof,s ohledem na Smlouvu o založení Evropského společenství, a zejména na čl. 285 odst. 1 této smlouvy,

Whereas:vzhledem k těmto důvodům:
(1) | To ensure the coherence and comparability of European statistics produced in accordance with the principles laid down in Article 285(2) of the Treaty, cooperation and coordination should be reinforced between the authorities that contribute to the development, production and dissemination of European statistics.(1) | Pro zajištění soudržnosti a srovnatelnosti evropské statistiky vypracovávané ve shodě se zásadami stanovenými v čl. 285 odst. 2 Smlouvy je třeba posilovat spolupráci a koordinaci mezi orgány, které přispívají k vývoji, vypracovávání a šíření evropské statistiky.
(2) | To that effect, the cooperation and coordination of those authorities should be developed in a more systematic and organised manner with full respect to the national and Community powers and institutional arrangements and taking into account the need to revise the existing basic legal framework in order to adapt it to the current reality, to better respond to future challenges, and to ensure a better harmonisation of European statistics.(2) | Za tímto účelem by se měla systematičtěji a organizovaněji rozvíjet spolupráce a koordinace těchto orgánů, a to při plném uznání pravomocí a institucionálních uspořádání členských států a Společenství a s ohledem na potřebu revize stávajícího základního právního rámce za účelem jeho přizpůsobení současné realitě, zlepšení schopnosti reagovat na budoucí výzvy a zajištění lepší harmonizace evropské statistiky.
(3) | It is therefore necessary to consolidate the activities of the European Statistical System (ESS) and to improve its governance, in particular with a view to further clarifying the respective roles of the national statistical institutes (NSIs) and other national authorities, and of the Community statistical authority.(3) | Proto je nezbytné konsolidovat činnosti Evropského statistického systému (ESS) a zlepšit jeho správu, zejména s cílem dále vyjasnit příslušné úlohy národních statistických úřadů (NSÚ) a jiných vnitrostátních orgánů a statistického úřadu Společenství.
(4) | Because of the specificity of the NSIs and the other national authorities responsible in each Member State for developing, producing and disseminating European statistics, they should be able to receive grants without a call for proposals in accordance with Article 168(1)(d) of Commission Regulation (EC, Euratom) No 2342/2002 of 23 December 2002 laying down detailed rules for the implementation of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (4).(4) | Vzhledem ke specifické povaze NSÚ a jiných vnitrostátních orgánů, které v každém členském státě odpovídají za vývoj, vypracovávání a šíření evropské statistiky, by NSÚ a tyto orgány měly mít možnost přijímat granty bez výzvy k předložení návrhů podle čl. 168 odst. 1 písm. d) nařízení Komise (ES, Euratom) č. 2342/2002 ze dne 23. prosince 2002 o prováděcích pravidlech k nařízení Rady (ES, Euratom) č. 1605/2002, kterým se stanoví finanční nařízení o souhrnném rozpočtu Evropských společenství (4).
(5) | Taking into account the financial burden-sharing between the budgets of the European Union and the Member States relating to the implementation of the statistical programme, the Community should also, in accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (5), make financial contributions to the NSIs and other national authorities in order to cover fully the incremental costs that the NSIs and other national authorities may incur in the execution of the temporary direct statistical actions decided by the Commission.(5) | Vzhledem k finanční zátěži, která souvisí s prováděním statistického programu a o kterou se dělí rozpočty Evropské unie a členských států, by Společenství v souladu s nařízením Rady (ES, Euratom) č. 1605/2002 ze dne 25. června 2002, kterým se stanoví finanční nařízení o souhrnném rozpočtu Evropských společenství (5), mělo NSÚ a jiným vnitrostátním orgánům poskytnout finanční příspěvky na plné pokrytí dodatečných nákladů, které mohou NSÚ nebo jiným vnitrostátním orgánům vzniknout při provádění přechodných přímých statistických akcí určených Komisí.
(6) | The statistical authorities of the Member States of the European Free Trade Association party to the Agreement on the European Economic Area (6) and of Switzerland should, as provided respectively for in the Agreement on the European Economic Area, in particular Article 76 thereof and Protocol 30 to that Agreement, and in the Agreement between the European Community and the Swiss Confederation on cooperation in the field of statistics (7), in particular Article 2 thereof, be closely associated with the reinforced cooperation and coordination.(6) | Statistické orgány členských států Evropského sdružení volného obchodu, které jsou stranami Dohody o Evropském hospodářském prostoru (6), a Švýcarska by měly být, jak je stanoveno v Dohodě o Evropském hospodářském prostoru, zejména v článku 76 uvedené dohody a protokolu 30 k uvedené dohodě, a v Dohodě mezi Evropským společenstvím a Švýcarskou konfederací o spolupráci v oblasti statistiky (7), zejména v článku 2 uvedené dohody, úzce přidruženy k posílené spolupráci a koordinaci.
(7) | Furthermore, it is important to ensure close cooperation and appropriate coordination between the ESS and the European System of Central Banks (ESCB), notably to foster the exchange of confidential data between the two systems for statistical purposes, in the light of Article 285 of the Treaty and of Article 5 of the Protocol (No 18) on the Statute of the European System of Central Banks and the European Central Bank annexed to the Treaty.(7) | Dále je důležité zajistit úzkou spolupráci a vhodnou koordinaci mezi ESS a Evropským systémem centrálních bank (ESCB), zejména posílit výměnu důvěrných údajů pro statistické účely mezi těmito dvěma systémy, s ohledem na článek 285 Smlouvy a článek 5 Protokolu (č. 18) o statutu Evropského systému centrálních bank a Evropské centrální banky připojeného ke Smlouvě.
(8) | European statistics will thus be developed, produced and disseminated by both the ESS and the ESCB but under separate legal frameworks reflecting their respective governance structures. This Regulation should therefore apply without prejudice to Council Regulation (EC) No 2533/98 of 23 November 1998 concerning the collection of statistical information by the European Central Bank (8).(8) | Evropská statistika se tak bude rozvíjet, vypracovávat a šířit jak prostřednictvím ESS, tak ESCB, ale v samostatných právních rámcích odrážejících příslušné správní struktury. Toto nařízení by se tedy mělo použít, aniž by tím bylo dotčeno nařízení Rady (ES) č. 2533/98 ze dne 23. listopadu 1998 o shromažďování statistických informací Evropskou centrální bankou (8).
(9) | Consequently, and although the members of the ESCB do not participate in the production of European statistics pursuant to this Regulation, following an agreement between a national central bank and the Community statistical authority, within their respective spheres of competence and without prejudice to national arrangements between the national central bank and the NSI or other national authorities, data produced by the national central bank may, however, be used, directly or indirectly, by NSIs, other national authorities and the Community statistical authority, for the production of European statistics. Similarly, the members of the ESCB may, within their respective spheres of competence, use, directly or indirectly, data produced by the ESS, as long as the necessity has been justified.(9) | V důsledku toho, a ačkoli se členové ESCB neúčastní vypracovávání evropské statistiky v souladu s tímto nařízením, mohou NSÚ, jiné vnitrostátní orgány a statistický úřad Společenství údaje vypracované národními centrálními bankami přímo či nepřímo používat při vypracovávání evropské statistiky, a to na základě dohody mezi národní centrální bankou a statistickým úřadem Společenství v rámci jejich příslušných pravomocí a aniž by byla dotčena vnitrostátní ujednání mezi národními centrálními bankami a NSÚ či jinými vnitrostátními orgány. Podobně mohou členové ESCB v rámci svých příslušných pravomocí používat přímo či nepřímo údaje, které vytváří ESS, pokud je taková potřeba odůvodněná.
(10) | In the general context of the relations between the ESS and the ESCB, the Committee on monetary, financial and balance of payments statistics established by Council Decision 2006/856/EC (9) plays an important role, in particular through the assistance provided to the Commission in drawing up and implementing work programmes concerning monetary, financial and balance of payments statistics.(10) | V obecném kontextu vztahů mezi ESS a ESCB hraje významnou roli Výbor pro měnovou a finanční statistiku a statistiku platební bilance zřízený rozhodnutím Rady 2006/856/ES (9), a to zejména poskytováním pomoci Komisi při přípravě a provádění pracovních programů týkajících se měnové a finanční statistiky a statistiky platební bilance.
(11) | International recommendations and best practices should be taken into account in the development, production and dissemination of European statistics.(11) | Při vývoji, vypracovávání a šíření evropské statistiky by se měly zohlednit mezinárodní doporučení a osvědčené postupy.
(12) | It is important to ensure close cooperation and appropriate coordination between the ESS and other actors in the international statistical system in order to promote the use of international concepts, classifications and methods, in particular with a view to ensuring more coherence and better comparability between statistics at a global level.(12) | Je důležité zajistit úzkou spolupráci a vhodnou koordinaci mezi ESS a jinými účastníky mezinárodního statistického systému s cílem podporovat využití mezinárodních konceptů, klasifikací a metod, zejména s cílem zajistit větší soudržnost a lepší srovnatelnost mezi statistikami na světové úrovni.
(13) | In order to align concepts and methodologies in statistics, an adequate interdisciplinary cooperation with academic institutions should be developed.(13) | V zájmu sladění konceptů a metodik ve statistice by měla být rozvinuta dostatečná mezioborová spolupráce s akademickými institucemi.
(14) | The operation of the ESS also needs to be reviewed as more flexible development, production and dissemination methods of European statistics and clear priority-setting are required in order to reduce the burden on respondents and members of the ESS and improve the availability and timeliness of European statistics. A European approach to statistics should be designed to this end.(14) | Rovněž je třeba přezkoumat fungování ESS, protože jsou zapotřebí pružnější metody vývoje, vypracovávání a šíření evropské statistiky a jasně stanovené priority, aby se snížilo zatížení respondentů a členů ESS a zlepšila dostupnost a včasnost evropské statistiky. Za tímto účelem by měl být navržen „evropský přístup ke statistice“.
(15) | While European statistics are usually based on national data produced and disseminated by the national statistical authorities of all Member States, they may also be produced from non-published national contributions, subsets of national contributions, specifically designed European statistical surveys or harmonised concepts or methods.(15) | Ačkoliv je evropská statistika obvykle založena na vnitrostátních údajích vypracovávaných a šířených vnitrostátními statistickými orgány všech členských států, může být rovněž vypracovávána z nezveřejněných vnitrostátních příspěvků, částí vnitrostátních příspěvků, zvlášť navržených evropských statistických zjišťování nebo harmonizovaných konceptů či metod.
(16) | In those specific cases, and where duly justified, it should be possible to implement a European approach to statistics, which consists of a pragmatic strategy to facilitate the compilation of European statistical aggregates, representing the European Union as a whole or the euro area as a whole, which are of particular importance for Community policies.(16) | V těchto zvláštních, řádně odůvodněných případech by mělo být možné realizovat „evropský přístup ke statistice“, který spočívá v pragmatické strategii pro snadnější sestavování evropských statistických souhrnů, jež reprezentují Evropskou unii jako celek nebo eurozónu jako celek, které jsou zvláště důležité pro politiky Společenství.
(17) | Joint structures, tools and processes could also be established or further developed through collaborative networks, involving the NSIs or other national authorities and the Community statistical authority and facilitating specialisation by certain Member States in specific statistical activities for the benefit of the ESS as a whole. These collaborative networks between partners of the ESS should aim to avoid duplication of work and therefore increase efficiency and reduce the response burden on economic operators.(17) | Lze rovněž zavést či dále rozvíjet společné struktury, nástroje a procesy prostřednictvím sítí spolupráce, které zahrnují NSÚ či jiné vnitrostátní orgány a statistický úřad Společenství a usnadňují specializaci některých členských států na konkrétní statistické činnosti ve prospěch ESS jako celku. Cílem těchto sítí spolupráce mezi partnery ESS by mělo být odstranění duplicity práce, čímž by se zvyšovala účinnost a snížilo zatížení hospodářských subjektů při plnění zpravodajské povinnosti.
(18) | At the same time, particular attention should be paid to coherent treatment of data collected from a variety of surveys. To this end, interdisciplinary working groups should be established.(18) | Současně je třeba věnovat zvláštní pozornost soudržnému zacházení se sebranými údaji z různých zjišťování. Za tím účelem by měly být zřízeny mezioborové pracovní skupiny.
(19) | The improved regulatory environment for European statistics should, in particular, respond to the need to minimise the response burden on survey respondents and contribute to the more general objective of a reduction of administrative burdens arising at European level, in line with the Presidency Conclusions of the European Council of 8 and 9 March 2007. The important role played by the NSIs and other national authorities in minimising burdens on European businesses at national level should, however, also be emphasised.(19) | Zlepšené regulativní prostředí pro evropskou statistiku by mělo zvláště reagovat na potřebu snížit zatížení respondentů při plnění zpravodajské povinnosti a přispívat k obecnějšímu cíli snižování administrativní zátěže vznikající na evropské úrovni, v souladu se závěry předsednictví ze zasedání Evropské rady ze dne 8. a 9. března 2007. Je však také zapotřebí zdůraznit důležitou úlohu, kterou hrají při minimalizaci zatížení evropských podniků na vnitrostátní úrovni NSÚ a jiné vnitrostátní orgány.
(20) | In order to enhance trust in European statistics, the national statistical authorities should in each Member State, as should the Community statistical authority within the Commission, enjoy professional independence and ensure impartiality and high quality in the production of European statistics, in accordance with the principles laid down in Article 285(2) of the Treaty as well as the principles further elaborated in the European statistics Code of Practice endorsed by the Commission in its Recommendation of 25 May 2005 on the independence, integrity and accountability of the national and Community statistical authorities (incorporating the European statistics Code of Practice). The Fundamental Principles of Official Statistics adopted by the United Nations Economic Commission for Europe on 15 April 1992 and by the United Nations Statistical Commission on 14 April 1994 should also be taken into account.(20) | Aby se posílila důvěra v evropskou statistiku, vnitrostátní statistické orgány v každém členském státě by měly, podobně jako statistický úřad Společenství v rámci Komise, požívat profesionální nezávislosti a měla by být zajištěna nestrannost a vysoká kvalita při vypracovávání evropské statistiky v souladu se zásadami stanovenými v čl. 285 odst. 2 Smlouvy a se zásadami dále rozvinutými v Kodexu evropské statistiky, který potvrdila Komise ve svém doporučení ze dne 25. května 2005 o nezávislosti, bezúhonnosti a odpovědnosti vnitrostátních statistických úřadů a statistického úřadu Společenství (do něhož je Kodex evropské statistiky začleněn). Rovněž by se mělo přihlédnout k Hlavním zásadám oficiálních statistik přijatým Evropskou hospodářskou komisí OSN dne 15. dubna 1992 a Statistickou komisí OSN dne 14. dubna 1994.
(21) | This Regulation ensures the right to respect for private and family life and to the protection of personal data, as set out in Articles 7 and 8 of the Charter of Fundamental Rights of the European Union (10).(21) | Toto nařízení zajišťuje právo na respektování soukromého a rodinného života a právo na ochranu osobních údajů podle článků 7 a 8 Listiny základních práv Evropské unie (10).
(22) | This Regulation also ensures the protection of individuals as regards the processing of personal data and specifies, as far as European statistics are concerned, the rules laid down in Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (11) and in Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data (12).(22) | Toto nařízení rovněž zajišťuje ochranu jednotlivců, pokud jde o zpracovávání osobních údajů, a konkrétně stanoví, pokud jde o evropskou statistiku, pravidla uvedená ve směrnici Evropského parlamentu a Rady 95/46/ES ze dne 24. října 1995 o ochraně fyzických osob v souvislosti se zpracováním osobních údajů a o volném pohybu těchto údajů (11) a v nařízení Evropského parlamentu a Rady (ES) č. 45/2001 ze dne 18. prosince 2000 o ochraně fyzických osob v souvislosti se zpracováním osobních údajů orgány a institucemi Společenství a o volném pohybu těchto údajů (12).
(23) | The confidential information which the national and Community statistical authorities collect for the production of European statistics should be protected, in order to gain and maintain the confidence of the parties responsible for providing that information. The confidentiality of data should satisfy the same principles in all the Member States.(23) | Důvěrné informace, které sbírají statistické orgány členských států a Společenství za účelem vypracování evropské statistiky, je třeba chránit, aby byla získána a zachována důvěra stran odpovídajících za poskytování těchto informací. Důvěrnost údajů by se měla řídit stejnými zásadami ve všech členských státech.
(24) | For that purpose, it is necessary to establish common principles and guidelines ensuring the confidentiality of data used for the production of European statistics and the access to those confidential data with due account for technical developments and the requirements of users in a democratic society.(24) | Za tímto účelem je nezbytné stanovit společné zásady a pokyny, které zajistí důvěrnost údajů používaných pro vypracovávání evropské statistiky a přístup k těmto důvěrným údajům s náležitým přihlédnutím k technickému rozvoji a požadavkům uživatelů v demokratické společnosti.
(25) | The availability of confidential data for the needs of the ESS is of particular importance in order to maximise the benefits of the data with the aim of increasing the quality of European statistics and to ensure a flexible response to the newly emerging Community statistical needs.(25) | Dostupnost důvěrných údajů pro potřeby ESS je mimořádně důležitá pro maximalizaci prospěchu z údajů s cílem zvýšit kvalitu evropské statistiky a pro zajištění pružné odezvy na nové potřeby statistiky Společenství.
(26) | The research community should enjoy wider access to confidential data used for the development, production and dissemination of European statistics, for analysis in the interest of scientific progress in Europe. Access to confidential data by researchers for scientific purposes should therefore be improved without compromising the high level of protection that confidential statistical data require.(26) | Vědecká obec by měla mít širší přístup k důvěrným údajům používaným pro vývoj, vypracovávání a šíření evropské statistiky pro účely analýz v zájmu vědeckého pokroku v Evropě. Přístup výzkumných pracovníků k důvěrným údajům pro vědecké účely by se proto měl zlepšit, aniž by došlo k narušení vysoké úrovně ochrany, kterou důvěrné statistické údaje vyžadují.
(27) | The use of confidential data for purposes that are not exclusively statistical, such as administrative, legal or tax purposes, or for the verification against the statistical units should be strictly prohibited.(27) | Použití důvěrných údajů pro jiné než výlučně statistické účely, jako jsou správní, právní nebo daňové účely, nebo pro ověřování vůči statistickým jednotkám by mělo být přísně zakázáno.
(28) | This Regulation should apply without prejudice to Directive 2003/4/EC of the European Parliament and of the Council of 28 January 2003 on public access to environmental information (13) and to Regulation (EC) No 1367/2006 of the European Parliament and of the Council of 6 September 2006 on the application of the provisions of the Aarhus Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters to Community institutions and bodies (14).(28) | Toto nařízení by se mělo použít, aniž by byla dotčena směrnice Evropského parlamentu a Rady 2003/4/ES ze dne 28. ledna 2003 o veřejném přístupu k informacím o životním prostředí (13) a nařízení Evropského parlamentu a Rady (ES) č. 1367/2006 ze dne 6. září 2006 o použití ustanovení Aarhuské úmluvy o přístupu k informacím, účasti veřejnosti na rozhodování a přístupu k právní ochraně v záležitostech životního prostředí na orgány a subjekty Společenství (14).
(29) | Since the objective of this Regulation, namely the establishment of a legal framework for the development, production and dissemination of European statistics, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. In accordance with the principle of proportionality, as set out in that Article, this Regulation does not go beyond what is necessary in order to achieve that objective, and is therefore without prejudice to national modalities, roles, and conditions specific to national statistics.(29) | Jelikož cíle tohoto nařízení, totiž zřízení právního rámce pro vývoj, vypracovávání a šíření evropské statistiky, nemůže být uspokojivě dosaženo na úrovni členských států, a proto jej může být lépe dosaženo na úrovni Společenství, může Společenství přijmout opatření v souladu se zásadou subsidiarity stanovenou v článku 5 Smlouvy. V souladu se zásadou proporcionality stanovenou v uvedeném článku toto nařízení nepřekračuje rámec toho, co je nezbytné k dosažení tohoto cíle, a nedotýká se tedy vnitrostátních forem, pravidel a podmínek vlastních vnitrostátním statistikám.
(30) | The measures necessary for the implementation of this Regulation should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission (15).(30) | Opatření nezbytná k provedení tohoto nařízení by měla být přijata v souladu s rozhodnutím Rady 1999/468/ES ze dne 28. června 1999 o postupech pro výkon prováděcích pravomocí svěřených Komisi (15).
(31) | In particular, the Commission should be empowered to adopt measures concerning the quality criteria for European statistics and to establish the modalities, rules and conditions under which access can be given to confidential data for scientific purposes at Community level. Since those measures are of general scope and are designed to amend non-essential elements of this Regulation by supplementing it with new non-essential elements, they must be adopted in accordance with the regulatory procedure with scrutiny provided for in Article 5a of Decision 1999/468/EC.(31) | Zejména je třeba zmocnit Komisi k přijetí opatření týkajících se kritérií kvality evropské statistiky a ke stanovení forem, pravidel a podmínek, za nichž lze poskytnout přístup k důvěrným údajům pro vědecké účely na úrovni Společenství. Jelikož tato opatření mají obecný význam a jejich účelem je změnit jiné než podstatné prvky tohoto nařízení jeho doplněním o nové jiné než podstatné prvky, musí být přijata regulativním postupem s kontrolou stanoveným v článku 5a rozhodnutí 1999/468/ES.
(32) | The measures set out in this Regulation should replace those in Regulation (EC, Euratom) No 1101/2008 of the European Parliament and of the Council (16), Council Regulation (EC) No 322/97 (17) and Council Decision 89/382/EEC, Euratom (18). Those acts should therefore be repealed. The implementing measures set out in Commission Regulation (EC) No 831/2002 of 17 May 2002 implementing Council Regulation (EC) No 322/97 on Community Statistics, concerning access to confidential data for scientific purposes (19) and Commission Decision 2004/452/EC of 29 April 2004 laying down a list of bodies whose researchers may access confidential data for scientific purposes (20) should continue to apply.(32) | Opatření stanovená tímto nařízením by měla nahradit opatření stanovená v nařízení Evropského parlamentu a Rady (ES, Euratom) č. 1101/2008 (16), nařízení Rady (ES) č. 322/97 (17) a rozhodnutí Rady 89/382/EHS, Euratom (18). This Regulation establishes a legal framework for the development, production and dissemination of European statistics.Toto nařízení stanoví právní rámec pro vývoj, vypracovávání a šíření evropské statistiky.
In compliance with the principle of subsidiarity and in accordance with the independence, integrity and accountability of the national and the Community authorities, European statistics are relevant statistics necessary for the performance of the activities of the Community. European statistics are determined in the European statistical programme. They shall be developed, produced and disseminated in conformity with the statistical principles as set out in Article 285(2) of the Treaty and further elaborated in the European statistics Code of Practice in accordance with Article 11. Statistical principlesStatistické zásady
1.   The development, production and dissemination of European statistics shall be governed by the following statistical principles:1.   Vývoj, vypracovávání a šíření evropské statistiky se řídí těmito statistickými zásadami:
(a) | ‘professional independence’, meaning that statistics must be developed, produced and disseminated in an independent manner, particularly as regards the selection of techniques, definitions, methodologies and sources to be used, and the timing and content of all forms of dissemination, free from any pressures from political or interest groups or from Community or national authorities, without prejudice to institutional settings, such as Community or national institutional or budgetary provisions or definitions of statistical needs;a) | „profesionální nezávislostí“, kterou se rozumí, že se statistika musí vyvíjet, vypracovávat a šířit nezávisle, zejména pokud jde o výběr používaných technik, definic, metodik a zdrojů a o načasování a obsah všech forem šíření, bez jakýchkoliv tlaků politických či zájmových skupin nebo orgánů Společenství či vnitrostátních orgánů, aniž jsou dotčeny institucionální rámce, jakými jsou institucionální nebo rozpočtová ustanovení či definice statistických potřeb, ať již na úrovni Společenství, či na vnitrostátní úrovni;
(b) | ‘impartiality’, meaning that statistics must be developed, produced and disseminated in a neutral manner, and that all users must be given equal treatment;b) | „nestranností“, kterou se rozumí, že se statistika musí vyvíjet, vypracovávat a šířit neutrálním způsobem a že se všem uživatelům musí dostat rovného zacházení;
(c) | ‘objectivity’, meaning that statistics must be developed, produced and disseminated in a systematic, reliable and unbiased manner; it implies the use of professional and ethical standards, and that the policies and practices followed are transparent to users and survey respondents;c) | „objektivitou“, kterou se rozumí, že se statistika musí vyvíjet, vypracovávat a šířit systematicky, spolehlivě a nepředpojatě; to předpokládá používání profesionálních a etických norem a skutečnost, že dodržované politiky a postupy jsou pro uživatele a respondenty zjišťování transparentní;
(d) | ‘reliability’, meaning that statistics must measure as faithfully, accurately and consistently as possible the reality that they are designed to represent and implying that scientific criteria are used for the selection of sources, methods and procedures;d) | „spolehlivostí“, kterou se rozumí, že statistika musí měřit co nejvěrněji, nejpřesněji a nejsoustavněji skutečnost, kterou má podle zadání představovat, a to za předpokladu, že se pro výběr zdrojů, metod a postupů používají vědecká kritéria;
(e) | ‘statistical confidentiality’, meaning the protection of confidential data related to single statistical units which are obtained directly for statistical purposes or indirectly from administrative or other sources and implying the prohibition of use for non-statistical purposes of the data obtained and of their unlawful disclosure;e) | „statistickou důvěrností“, kterou se rozumí ochrana důvěrných údajů o jednotlivých statistických jednotkách, získaných přímo pro statistické účely nebo nepřímo z administrativních nebo jiných zdrojů, a to za předpokladu, že je zakázáno používat získané údaje pro jiné než statistické účely a jejich nedovolené zpřístupňování;
(f) | ‘cost effectiveness’, meaning that the costs of producing statistics must be in proportion to the importance of the results and the benefits sought, that resources must be optimally used and the response burden minimised. The information requested shall, where possible, be readily extractable from available records or sources.f) | „efektivitou nákladů“, kterou se rozumí, že náklady na vypracovávání statistiky musí být přiměřené důležitosti výsledků a přínosů, o něž se usiluje, přičemž se musí optimálně využívat zdrojů a minimalizovat zatížení respondentů. The statistical principles set out in this paragraph are further elaborated in the Code of Practice in accordance with Article 11.Statistické zásady stanovené v tomto odstavci jsou dále rozpracovány v kodexu v souladu s článkem 11.

For the purposes of this Regulation, the following definitions shall apply:Pro účely tohoto nařízení se rozumí
1. | ‘statistics’ means quantitative and qualitative, aggregated and representative information characterising a collective phenomenon in a considered population;1) | „statistikou“ kvantitativní a kvalitativní souhrnná a reprezentativní informace charakterizující kolektivní jev v dotčené populaci;
2. | ‘development’ means the activities aiming at setting up, strengthening and improving the statistical methods, standards and procedures used for the production and dissemination of statistics as well as at designing new statistics and indicators;2) | „vývojem“ činnosti prováděné s cílem stanovit, posílit a zlepšit statistické metody, standardy a postupy používané pro vypracovávání a šíření statistik, a dále pro navrhování nových statistik a ukazatelů;
3. | ‘production’ means all the activities related to the collection, storage, processing, and analysis necessary for compiling statistics;3) | „vypracováváním“ veškeré činnosti související se sběrem, uchováváním, zpracováváním a analýzou, které jsou nezbytné pro sestavování statistik;
4. | ‘dissemination’ means the activity of making statistics and statistical analysis accessible to users;4) | „šířením“ zpřístupňování statistik a statistických analýz uživatelům;
5. | ‘data collection’ means surveys and all other methods of deriving information from different sources, including administrative sources;5) | „sběrem údajů“ zjišťování a všechny jiné metody získávání informací z různých zdrojů, včetně administrativních zdrojů;
6. | ‘statistical unit’ means the basic observation unit, namely a natural person, a household, an economic operator and other undertakings, referred to by the data;6) | „statistickou jednotkou“ základní jednotka zjišťování, tedy fyzická osoba, domácnost, hospodářský subjekt a jiné podniky, ke kterým se údaje vztahují;
7. | ‘confidential data’ means data which allow statistical units to be identified, either directly or indirectly, thereby disclosing individual information. To determine whether a statistical unit is identifiable, account shall be taken of all relevant means that might reasonably be used by a third party to identify the statistical unit;7) | „důvěrnými údaji“ údaje, které umožňují přímou či nepřímou identifikaci statistických jednotek, čímž se zpřístupní individuální informace. Při rozhodování o tom, zda lze statistickou jednotku považovat za identifikovatelnou, se berou v úvahu všechny přiměřené prostředky, jejichž použití k identifikaci dané statistické jednotky třetí osobou lze rozumně předpokládat;
8. | ‘use for statistical purposes’ means the exclusive use for the development and production of statistical results and analyses;8) | „použitím pro statistické účely“ výhradní použití pro vývoj a vypracovávání statistických výsledků a analýz;
9. | ‘direct identification’ means the identification of a statistical unit from its name or address, or from a publicly accessible identification number;9) | „přímou identifikací“ identifikace statistické jednotky z jejího jména nebo adresy nebo z veřejně dostupného identifikačního čísla;
10. | ‘indirect identification’ means the identification of a statistical unit by any other means than by way of direct identification;10) | „nepřímou identifikací“ identifikace statistické jednotky jakýmikoliv jinými prostředky než přímou identifikací;
11. | ‘officials of the Commission (Eurostat)’ means the officials of the Communities, within the meaning of Article 1 of the Staff Regulations of Officials of the European Communities, working at the Community statistical authority;11) | „úředníky Komise (Eurostatu)“ úředníci Společenství ve smyslu článku 1 služebního řádu úředníků Evropských společenství, kteří pracují ve statistickém úřadu Společenství;

The European Statistical SystemEvropský statistický systém
The European Statistical System (ESS) is the partnership between the Community statistical authority, which is the Commission (Eurostat), and the national statistical institutes (NSIs) and other national authorities responsible in each Member State for the development, production and dissemination of European statistics.Evropský statistický systém (ESS) je partnerství tvořené statistickým úřadem Společenství, kterým je Komise (Eurostat), a národními statistickými úřady (NSÚ) a jinými vnitrostátními orgány, jež v jednotlivých členských státech odpovídají za vývoj, vypracovávání a šíření evropské statistiky.

National statistical institutes and other national authoritiesNárodní statistické úřady a jiné vnitrostátní orgány
1.   The national statistical authority designated by each Member State as the body having the responsibility for coordinating all activities at national level for the development, production and dissemination of European statistics (the NSI) shall act as the contact point for the Commission (Eurostat) on statistical matters. The Member States shall take the necessary measures to ensure the application of this provision.1.   NSÚ určené jednotlivými členskými státy jako subjekty, které odpovídají za koordinaci všech činností na vnitrostátní úrovni pro vývoj, vypracovávání a šíření evropské statistiky, působí jako kontaktní místo pro Komisi (Eurostat) v otázkách statistiky. Členské státy přijmou nezbytná opatření, aby zajistily uplatnění tohoto ustanovení.
2.   The Commission (Eurostat) shall maintain and publish on its website a list of NSIs and other national authorities responsible for the development, production and dissemination of European statistics as designated by Member States.2.   Komise (Eurostat) vede seznam NSÚ a jiných vnitrostátních orgánů odpovídajících za vývoj, vypracovávání a šíření evropské statistiky, určených členskými státy, a zveřejní tento seznam na své internetové stránce.
3.   The NSIs and the other national authorities included in the list referred to in paragraph 2 of this Article may receive grants without a call for proposals, in accordance with Article 168(1)(d) of Regulation (EC, Euratom) No 2342/2002.3.   NSÚ a jiné vnitrostátní orgány zařazené na seznam uvedený v odstavci 2 tohoto článku mohou přijímat granty bez výzvy k předložení návrhů v souladu s čl. 168 odst. 1. písm. d) nařízení (ES, Euratom) č. 2342/2002.

Commission (Eurostat)Komise (Eurostat)
1.   The Community statistical authority, as designated by the Commission to develop, produce and disseminate European statistics, shall be referred to as ‘the Commission (Eurostat)’ in this Regulation.1.   Statistický úřad Společenství určený Komisí pro vývoj, vypracovávání a šíření evropské statistiky je v tomto nařízení dále označován jako „Komise (Eurostat)“.
2.   At Community level, the Commission (Eurostat) shall ensure the production of European statistics according to established rules and statistical principles. In this respect, it shall have the sole responsibility for deciding on processes, statistical methods, standards and procedures, and on the content and timing of statistical releases.2.   Na úrovni Společenství zajišťuje Komise (Eurostat) vypracovávání evropské statistiky podle zavedených pravidel a statistických zásad. V tomto ohledu má výlučnou odpovědnost za rozhodování o procesech, statistických metodách, standardech a postupech a o obsahu a načasování vydávání statistických zpráv.
3.   Without prejudice to Article 5 of the Protocol on the Statute of the European System of Central Banks (ESCB) and the European Central Bank, the Commission (Eurostat) shall coordinate the statistical activities of the institutions and bodies of the Community, in particular with a view to ensuring consistency and quality of the data and minimising reporting burden. To that end, the Commission (Eurostat) may invite any institution or body of the Community to consult or cooperate with it for the purpose of developing methods and systems for statistical purposes in their respective field of competence. Any of those institutions or bodies which propose to produce statistics shall consult the Commission (Eurostat) and take into account any recommendation that it may make to this effect.3.   Aniž je dotčen článek 5 Protokolu o statutu Evropského systému centrálních bank (ESCB) a Evropské centrální banky, Komise (Eurostat) koordinuje statistické činnosti orgánů a institucí Společenství, zejména za účelem zajištění soudržnosti a kvality údajů a minimalizace zátěže výkaznictví. V tomto smyslu může Komise (Eurostat) vyzvat jakýkoli orgán nebo instituci Společenství ke konzultaci nebo spolupráci za účelem vývoje metod a systémů pro statistické účely v rámci jejich příslušných pravomocí. Každý z těchto orgánů nebo institucí, který navrhuje vypracování statistiky, konzultuje s Komisí (Eurostatem) a vezme v úvahu jakékoliv její doporučení, které může k tomuto účelu vydat.

European Statistical System CommitteeVýbor pro evropský statistický systém
1.   The European Statistical System Committee (ESS Committee) is hereby established. It shall provide professional guidance to the ESS for developing, producing and disseminating European statistics in line with the statistical principles set out in Article 2(1).1.   Zřizuje se Výbor pro evropský statistický systém (dále jen „výbor pro ESS“). Poskytuje ESS odborné vedení pro vývoj, vypracovávání a šíření evropské statistiky v souladu se statistickými zásadami uvedenými v čl. 2. odst. 1.
2.   The ESS Committee shall be composed of the representatives of the NSIs who are national specialists for statistics. It shall be chaired by the Commission (Eurostat).2.   Výbor pro ESS se skládá ze zástupců NSÚ, kteří jsou odborníky členských států v oblasti statistiky. Předsedá mu Komise (Eurostat).
3.   The ESS Committee shall adopt its rules of procedure, which shall reflect its tasks.3.   Výbor pro ESS přijme svůj jednací řád, který odráží jeho úkoly.
4.   The ESS Committee shall be consulted by the Commission in regard to:4.   Komise konzultuje s Výborem pro evropský statistický systém, pokud jde o
(a) | the measures which the Commission intends to take for the development, production and dissemination of European statistics, their justification on a cost-effectiveness basis, the means and timetables for achieving them, the response burden on survey respondents;a) | opatření, která má Komise v úmyslu učinit pro vývoj, vypracovávání a šíření evropské statistiky, jejich zdůvodnění na základě efektivity nákladů, prostředky a harmonogramy pro jejich dosažení a zatížení respondentů při plnění zpravodajské povinnosti;

European statistics Code of PracticeKodex evropské statistiky
1.   The Code of Practice shall aim at ensuring public trust in European statistics by establishing how European statistics are to be developed, produced and disseminated in conformity with the statistical principles as set out in Article 2(1) and best international statistical practice.1.   Cílem kodexu je zajistit důvěru veřejnosti v evropskou statistiku tím, že stanoví, jak se má evropská statistika vyvíjet, vypracovávat a šířit v souladu se statistickými zásadami stanovenými v čl. 2 odst. 1 a osvědčenými mezinárodními statistickými postupy.
2.   The Code of Practice shall be reviewed and updated as necessary by the ESS Committee. The Commission shall publish amendments thereto.2.   Kodex je podle potřeby přezkoumáván a aktualizován výborem pro ESS. Komise zveřejňuje změny kodexu.

Statistical qualityStatistická kvalita
1.   To guarantee the quality of results, European statistics shall be developed, produced and disseminated on the basis of uniform standards and of harmonised methods. In this respect, the following quality criteria shall apply:1.   Pro zaručení kvality výsledků se evropská statistika vyvíjí, vypracovává a šíří na základě jednotných standardů a harmonizovaných metod. V této souvislosti se použijí tato kritéria kvality:
(a) | ‘relevance’, which refers to the degree to which statistics meet current and potential needs of the users;a) | „relevance“ označuje míru, v jaké statistiky uspokojují stávající a potenciální potřeby uživatelů;
(b) | ‘accuracy’, which refers to the closeness of estimates to the unknown true values;b) | „přesnost“ označuje blízkost odhadů neznámým skutečným hodnotám;
(c) | ‘timeliness’, which refers to the period between the availability of the information and the event or phenomenon it describes;c) | „včasnost“ označuje dobu mezi dostupností informace a událostí nebo jevem, který popisuje;
(d) | ‘punctuality’, which refers to the delay between the date of the release of the data and the target date (the date by which the data should have been delivered);d) | „dochvilnost“ označuje časovou prodlevu mezi datem zveřejnění údajů a cílovým datem (datem, kdy měly být údaje dodány);
(e) | ‘accessibility’ and ‘clarity’, which refer to the conditions and modalities by which users can obtain, use and interpret data;e) | „dostupnost“ a „srozumitelnost“ označují, za jakých podmínek a v jaké formě mohou uživatelé údaje získat, používat a vykládat;
(f) | ‘comparability’, which refers to the measurement of the impact of differences in applied statistical concepts, measurement tools and procedures where statistics are compared between geographical areas, sectoral domains or over time;f) | „srovnatelnost“ označuje měření dopadu rozdílů mezi použitými statistickými koncepty, nástroji a postupy měření, srovnávají-li se statistiky mezi zeměpisnými oblastmi, odvětvími nebo v čase;
(g) | ‘coherence’, which refers to the adequacy of the data to be reliably combined in different ways and for various uses.g) | „soudržnost“ označuje skutečnost, zda lze údaje spolehlivě různými způsoby a pro různé účely kombinovat.
2.   In applying the quality criteria laid down in paragraph 1 of this Article to the data covered by sectoral legislation in specific statistical domains, the modalities, structure and periodicity of quality reports provided for in sectoral legislation shall be defined by the Commission in accordance with the regulatory procedure referred to in Article 27(2).2.   Při uplatňování kritérií kvality stanovených v odstavci 1 tohoto článku na údaje spadající do odvětvových právních předpisů v konkrétních statistických oblastech stanoví Komise regulativním postupem podle čl. 27 odst. 2 formy, strukturu a periodicitu zpráv o kvalitě stanovených odvětvovými právními předpisy.
Specific quality requirements, such as target values and minimum standards for the statistical production, may be laid down in sectoral legislation. Where sectoral legislation does not so provide, measures may be adopted by the Commission. Those measures, designed to amend non-essential elements of this Regulation by supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 27(3).Konkrétní požadavky na kvalitu, například cílové hodnoty a minimální standardy pro vypracovávání statistik, mohou stanovit odvětvové právní předpisy. Pokud tak odvětvové právní předpisy nestanoví, opatření může přijmout Komise. Tato opatření, jež mají za účel změnit jiné než podstatné prvky tohoto nařízení jeho doplněním, se přijímají regulativním postupem s kontrolou podle čl. 27 odst. 3.
3.   Member States shall provide the Commission (Eurostat) with reports on the quality of the data transmitted. The Commission (Eurostat) shall assess the quality of data transmitted and shall prepare and publish reports on the quality of European statistics.3.   Členské státy dodají Komisi (Eurostatu) zprávy o kvalitě předávaných údajů. Komise (Eurostat) posoudí kvalitu předaných údajů a připraví a zveřejní zprávy o kvalitě evropské statistiky.

1.   The European statistical programme shall provide the framework for the development, production and dissemination of European statistics, the main fields and the objectives of the actions envisaged for a period not exceeding five years. It shall be decided upon by the European Parliament and the Council. Its impact and cost effectiveness shall be assessed, involving independent experts.1.   Evropský statistický program poskytuje rámec pro vývoj, vypracovávání a šíření evropské statistiky, hlavní oblasti a cíle akcí plánovaných na dobu nepřekračující pět let. Rozhoduje o něm Evropský parlament a Rada. Jeho dopad a efektivita nákladů se posuzuje za účasti nezávislých odborníků.
2.   The European statistical programme shall lay down priorities concerning the needs for information for the purpose of carrying out the activities of the Community. Those needs shall be weighed against the resources needed at Community and national level to provide the required statistics, and also against the response burden and the respondent's associated costs.2.   Evropský statistický program stanoví priority, které se týkají potřeb informací za účelem provádění činností Společenství. Tyto potřeby jsou posuzovány s ohledem na zdroje, které jsou na úrovni Společenství i na vnitrostátní úrovni potřebné k poskytnutí požadovaných statistik, a rovněž s ohledem na zatížení respondentů a na náklady, které v této souvislosti vzniknou respondentům.
3.   The Commission shall introduce initiatives to set priorities and reduce the response burden for all or part of the European statistical programme.3.   Komise zavede iniciativy, jejichž cílem je stanovit priority a snížit zatížení respondentů, a to pro celý evropský statistický program, nebo pro jeho část.
4.   The Commission shall submit the draft European statistical programme to the ESS Committee for prior examination.4.   Komise předloží výboru pro ESS návrh evropského statistického programu k předběžnému přezkoumání.
5.   For each European statistical programme, the Commission shall, after consulting the ESS Committee, present an intermediate progress report and a final evaluation report and shall submit them to the European Parliament and to the Council.5.   Pro každý evropský statistický program Komise po konzultaci s výborem pro ESS předloží Evropskému parlamentu a Radě průběžnou zprávu o pokroku a závěrečnou hodnotící zprávu.

Implementation of the European statistical programmeProvádění evropského statistického programu
1.   The European statistical programme shall be implemented by individual statistical actions which shall be decided:1.   Evropský statistický program se provádí prostřednictvím jednotlivých statistických akcí, o nichž rozhoduje
(a) | by the European Parliament and the Council;a) | Evropský parlament a Rada;
(b) | by the Commission, in specific and duly justified cases, in particular to meet unexpected needs, in accordance with the provisions in paragraph 2; orb) | ve zvláštních a řádně odůvodněných případech Komise, zejména za účelem splnění neočekávaných požadavků, v souladu s odstavcem 2, nebo
(c) | by means of agreement between the NSIs or other national authorities and the Commission (Eurostat), within their respective spheres of competence. Such agreements shall be in writing.c) | vzájemná dohoda mezi NSÚ či jinými vnitrostátními orgány a Komisí (Eurostatem) v rámci jejich příslušných pravomocí. Tyto dohody se uzavírají písemnou formou.
2.   The Commission may decide on a temporary direct statistical action in accordance with the regulatory procedure referred to in Article 27(2) provided that:2.   Komise může rozhodnout o přechodné přímé statistické akci regulativním postupem podle čl. 27 odst. 2, pokud
(a) | the action does not provide for data collection covering more than three reference years;a) | akce nestanovuje sběr údajů za více než tři referenční roky;
(b) | the data are already available or accessible within the NSIs and other national authorities responsible, or can be obtained directly, using the appropriate samples for the observation of the statistical population at European level with the adequate coordination with the NSIs and other national authorities; andb) | údaje jsou již dostupné nebo přístupné v rámci příslušných NSÚ či jiných vnitrostátních orgánů nebo je lze získat přímo pomocí vhodných vzorků populace pro statistická zjišťování na evropské úrovni, přičemž je prováděna přiměřená koordinace s NSÚ a jinými vnitrostátními orgány, a

3.   In putting forward an action to be decided under paragraph 1(a) or (b), the Commission shall provide information on:3.   Při předkládání akcí, o nichž má být rozhodnuto podle odst. 1 písm. a) a b), Komise poskytne informace o

Collaborative networksSítě spolupráce
In the individual statistical actions, synergies shall be developed, when possible, within the ESS through collaborative networks, by the sharing of expertise and results or by fostering specialisation on specific tasks. To this end, an adequate financial structure shall be developed.Jednotlivé statistické akce se rozvíjejí pokud možno v součinnosti v rámci ESS prostřednictvím sítí spolupráce, sdílením odborných znalostí a výsledků nebo prohloubením specializací na konkrétní úkoly. Za tímto účelem se vytvoří odpovídající finanční struktura.
The outcome of those actions, such as joint structures, tools, processes and methods shall be made available throughout the ESS. The initiatives for the creation of collaborative networks as well as the outcomes shall be examined by the ESS Committee.Výsledek těchto akcí, jako jsou společné struktury, nástroje, procesy a metody, je zpřístupněn v rámci ESS. (a) | maximising the availability of statistical aggregates at European level and improving the timeliness of European statistics;a) | maximalizace dostupnosti statistických souhrnů na evropské úrovni a zlepšení včasnosti evropské statistiky;
(b) | reducing the burden on the respondents, the NSIs and other national authorities based on a cost-effectiveness analysis.b) | snížení zatížení respondentů, NSÚ a jiných vnitrostátních orgánů založené na analýze efektivity nákladů.
2.   The cases where the European approach to statistics is relevant include:2.   K případům, v nichž je evropský přístup ke statistice důležitý, patří

3.   Measures to implement the European approach to statistics shall be carried out with the full involvement of Member States. The measures for the implementation of the European approach to statistics shall be laid down in the individual statistical actions referred to in Article 14(1).3.   Do opatření k provádění evropského přístupu ke statistice jsou plně zapojeny členské státy. Tato opatření k provádění evropského přístupu ke statistice se stanoví v rámci jednotlivých statistických akcí uvedených v čl. 14 odst. 1.
4.   If necessary, a coordinated release and revision policy shall be established in cooperation with Member States.4.   V případě potřeby se ve spolupráci s členskými státy vypracuje koordinovaná politika zveřejňování a revizí.

Annual work programmeRoční pracovní program
Each year, before the end of May, the Commission shall submit to the ESS Committee its work programme for the following year. The Commission shall take the utmost account of the comments of the ESS Committee. That work programme shall be based on the European statistical programme and shall indicate, in particular:Komise každoročně do konce měsíce května předkládá svůj pracovní program na následující rok výboru pro ESS. 1.   The dissemination of European statistics shall be undertaken in full compliance with the statistical principles, as set out in Article 2(1), particularly in respect of protecting statistical confidentiality and ensuring equality of access as required under the principle of impartiality.1.   Šíření evropské statistiky se provádí v plném souladu se statistickými zásadami stanovenými v čl. 2 odst. 1, zejména s ohledem na ochranu statistické důvěrnosti a zajištění rovnosti přístupu, jak to vyžaduje zásada nestrannosti.
2.   The dissemination of European statistics shall be carried out by the Commission (Eurostat), the NSIs and other national authorities, within their respective spheres of competence.2.   Šíření evropské statistiky provádějí Komise (Eurostat), NSÚ a jiné vnitrostátní orgány v rámci svých příslušných pravomocí.

Data on individual statistical units may be disseminated in the form of a public use file consisting of anonymised records which have been prepared in such a way that the statistical unit cannot be identified, either directly or indirectly, when account is taken of all relevant means that might reasonably be used by a third party.Údaje o jednotlivých statistických jednotkách mohou být šířeny ve formě souboru k veřejnému použití, který obsahuje anonymizované záznamy připravené tak, že nelze, ať už přímo, či nepřímo, identifikovat statistické jednotky, vezmou-li se v úvahu všechny přiměřené prostředky, jejichž použití třetí stranou lze rozumně předpokládat.
If the data have been transmitted to the Commission (Eurostat) the explicit approval of the NSI or other national authority which provided the data is required.Pokud byly údaje předány Komisi (Eurostatu), vyžaduje se výslovný souhlas NSÚ či jiného vnitrostátního orgánu, který údaje poskytl.

Protection of confidential dataOchrana důvěrných údajů
1.   The following rules and measures shall apply to ensure that confidential data are exclusively used for statistical purposes and to prevent their unlawful disclosure.1.   Následující pravidla a opatření se použijí k zajištění výlučného používání důvěrných údajů pro statistické účely a k zabránění jejich nedovoleného zpřístupnění.
2.   Confidential data obtained exclusively for the production of European statistics shall be used by the NSIs and other national authorities and by the Commission (Eurostat) exclusively for statistical purposes unless the statistical unit has unambiguously given its consent to the use for any other purposes.2.   Důvěrné údaje získané výhradně za účelem vypracovávání evropské statistiky používají NSÚ či jiné vnitrostátní orgány a Komise (Eurostat) výhradně pro statistické účely, pokud statistická jednotka nevyjádřila jednoznačný souhlas s použitím těchto údajů k jakýmkoliv jiným účelům.
3.   Statistical results which may make it possible to identify a statistical unit may be disseminated by the NSIs and other national authorities and the Commission (Eurostat) in the following exceptional cases:3.   Statistické výsledky, které mohou umožňovat identifikaci statistické jednotky, mohou být šířeny NSÚ či jinými vnitrostátními orgány a Komisí (Eurostatem) v těchto výjimečných případech:
(a) | where specific conditions and modalities are determined by an act of the European Parliament and of the Council acting in accordance with Article 251 of the Treaty and the statistical results are amended in such a way that their dissemination does not prejudice statistical confidentiality whenever the statistical unit has so requested; ora) | jestliže jsou konkrétní podmínky a formy stanoveny aktem Evropského parlamentu a Rady přijatým v souladu s článkem 251 Smlouvy a statistické výsledky se pozmění takovým způsobem, aby jejich šířením nebyla dotčena statistická důvěrnost, pokud o to statistická jednotka požádá, nebo

4.   Within their respective spheres of competence, the NSIs and other national authorities and the Commission (Eurostat) shall take all necessary regulatory, administrative, technical and organisational measures to ensure the physical and logical protection of confidential data (statistical disclosure control).4.   NSÚ či jiné vnitrostátní orgány a Komise (Eurostat) přijmou v rámci svých příslušných pravomocí veškerá nezbytná právní, správní, technická a organizační opatření, aby zajistily fyzickou a logickou ochranu důvěrných údajů (řízení rizika prozrazení statistických údajů).
The NSIs and other national authorities and the Commission (Eurostat) shall take all necessary measures to ensure the harmonisation of principles and guidelines as regards the physical and logical protection of confidential data. Those measures shall be adopted by the Commission in accordance with the regulatory procedure referred to in Article 27(2).NSÚ či jiné vnitrostátní orgány a Komise (Eurostat) učiní všechna nezbytná opatření, aby zajistily harmonizaci zásad a pokynů týkajících se fyzické a logické ochrany důvěrných údajů. Tato opatření přijímá Komise regulativním postupem podle čl. 27 odst. 2.
5.   Officials and other staff of the NSIs and other national authorities having access to confidential data shall be subject to compliance with such confidentiality, even after cessation of their functions.5.   Úředníci a ostatní zaměstnanci NSÚ či jiných vnitrostátních orgánů mající přístup k důvěrným údajům jsou povinni zachovávat důvěrnost těchto údajů, a to i po skončení své funkce.

Transmission of confidential dataPředávání důvěrných údajů
1.   Transmission of confidential data from an ESS authority, as referred to in Article 4, that collected the data to another ESS authority may take place provided that this transmission is necessary for the efficient development, production and dissemination of European statistics or for increasing the quality of European statistics.1.   Předávání důvěrných údajů orgánem ESS uvedeným v článku 4, který údaje sebral, jinému orgánu ESS je přípustné, jestliže je toto předávání nezbytné pro účinný vývoj, vypracovávání a šíření evropské statistiky nebo pro zvýšení kvality evropské statistiky.
2.   Transmission of confidential data between an ESS authority that collected the data and an ESCB member may take place provided that this transmission is necessary for the efficient development, production and dissemination of European statistics or for increasing the quality of European statistics, within the respective spheres of competence of the ESS and the ESCB, and that this necessity has been justified.2.   Předávání důvěrných údajů mezi orgánem ESS, který údaje sebral, a členem ESCB je přípustné, jestliže je toto předávání nezbytné pro účinný vývoj, vypracovávání a šíření evropské statistiky nebo pro zvýšení kvality evropské statistiky v příslušných oblastech působnosti ESS a ESCB a jestliže byla tato nezbytnost odůvodněna.
3.   Any further transmission beyond the first transmission shall require the explicit authorisation of the authority that collected the data.3.   Pro každé následné předání navazující na první předání se vyžaduje výslovné povolení orgánu, který údaje sebral.
4.   National rules on statistical confidentiality shall not be invoked to prevent the transmission of confidential data under paragraphs 1 and 2 where an act of the European Parliament and of the Council acting in accordance with Article 251 of the Treaty provides for the transmission of such data.4.   Vnitrostátní pravidla týkající se statistické důvěrnosti nelze uplatnit proti předávání důvěrných údajů podle odstavců 1 a 2, pokud je toto předávání stanoveno aktem Evropského parlamentu a Rady přijatým v souladu s článkem 251 Smlouvy.
5.   Confidential data transmitted in accordance with this Article shall be used exclusively for statistical purposes and only accessible to staff working in statistical activities within their specific domain of work.5.   Důvěrné údaje předávané podle tohoto článku se používají výhradně pro statistické účely a přístup k nim mají pouze pracovníci, kteří provádějí statistické činnosti v rámci svého příslušného pracovního oboru.
6.   The provisions on statistical confidentiality provided for in this Regulation shall apply to all confidential data transmitted within the ESS and between the ESS and the ESCB.6.   Ustanovení o statistické důvěrnosti stanovená v tomto nařízení se vztahují na všechny důvěrné údaje předávané v rámci ESS a mezi ESS a ESCB.

1.   Confidential data shall be accessible, subject to the exceptions laid down in paragraph 2, only to officials of the Commission (Eurostat) within their specific domain of work.1.   Důvěrné údaje jsou přístupné, s výhradou výjimek stanovených v odstavci 2, pouze úředníkům Komise (Eurostatu) v rámci jejich příslušného pracovního oboru.
2.   The Commission (Eurostat) may in exceptional cases grant access to confidential data to its other staff and to other natural persons working for the Commission (Eurostat) under contract within their specific domain of work.2.   Komise (Eurostat) může ve výjimečných případech udělit přístup k důvěrným údajům svým ostatním zaměstnancům a jiným fyzickým osobám pracujícím pro Komisi (Eurostat) na smluvním základě v rámci jejich příslušného pracovního oboru.
3.   Persons having access to confidential data shall use these data exclusively for statistical purposes. They shall be subject to this restriction even after cessation of their functions.3.   Osoby mající přístup k důvěrným údajům použijí tyto údaje výhradně pro statistické účely. Tomuto omezení podléhají i po skončení svých funkcí.

Access to confidential data for scientific purposesPřístup k důvěrným údajům pro vědecké účely
Access to confidential data which only allow for indirect identification of the statistical units may be granted to researchers carrying out statistical analyses for scientific purposes by the Commission (Eurostat) or by the NSIs or other national authorities, within their respective spheres of competence. If the data have been transmitted to the Commission (Eurostat) the approval of the NSI or other national authority which provided the data is required.Komise (Eurostat) nebo NSÚ či jiné vnitrostátní orgány mohou v rámci svých příslušných pravomocí udělit výzkumným pracovníkům provádějícím statistické analýzy pro vědecké účely přístup k důvěrným údajům, které umožňují pouze nepřímou identifikaci statistických jednotek. Pokud jsou údaje předávány Komisi (Eurostatu), vyžaduje se souhlas NSÚ či jiného vnitrostátního orgánu, který údaje poskytl.
The modalities, rules and conditions for access at Community level shall be established by the Commission. Those measures, designed to amend non-essential elements of this Regulation by supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 27(3).Formy, pravidla a podmínky přístupu na úrovni Společenství stanoví Komise. Tato opatření, jež mají za účel změnit jiné než podstatné prvky tohoto nařízení jeho doplněním, se přijímají regulativním postupem s kontrolou podle čl. 27 odst. 3.

In order to reduce the burden on respondents, the NSIs and other national authorities and the Commission (Eurostat) shall have access to administrative data sources, from within their respective public administrative system, to the extent that these data are necessary for the development, production and dissemination of European statistics.Aby se snížilo zatížení respondentů, mají NSÚ či jiné vnitrostátní orgány a Komise (Eurostat) přístup ke zdrojům administrativních údajů, a to v rámci jejich příslušného systému veřejné správy, v míře nezbytné pro vývoj, vypracovávání a šíření evropské statistiky.
The practical arrangements and the conditions for achieving effective access shall be determined where necessary by each Member State and the Commission, within their respective spheres of competence.Jednotlivé členské státy a Komise stanoví v případě nutnosti v rámci svých příslušných pravomocí praktická opatření a podmínky pro dosažení účinného přístupu.

Data from public sourcesÚdaje z veřejných zdrojů
Data obtained from sources lawfully available to the public and which remain available to the public according to national legislation shall not be considered confidential for the purpose of dissemination of statistics obtained from those data.Údaje získané ze zdrojů, které jsou podle právních předpisů dostupné veřejnosti a které podle vnitrostátních právních předpisů zůstávají veřejnosti dostupné, se nepovažují za důvěrné pro účely šíření statistik získaných z těchto údajů.

Violation of statistical confidentialityPorušení statistické důvěrnosti
Member States and the Commission shall take appropriate measures to prevent and sanction any violations of statistical confidentiality.Členské státy a Komise přijmou vhodná opatření k zabránění jakémukoliv porušení statistické důvěrnosti a k postihům za tato porušení.
