Die Kommission möchte auf das Urteil „CIA Security“ verweisen, das am 30. April 1996 in der Rechtssache C-194/94 (Slg. I, S. 2201) erging. Nach Auffassung des Gerichtshofs sind Artikel 8 und 9 der Richtlinie 98/34/EG (ehemalige 83/189/EWG) so auszulegen, dass Dritte sich vor nationalen Gerichten auf diese Artikel berufen können; es obliegt dann den nationalen Gerichten sich zu weigern, die Anwendung einer einzelstaatlichen technischen Vorschrift zu erzwingen, die nicht gemäß der Richtlinie notifiziert wurde.
Dieses Urteil bestätigt die Mitteilung der Kommission vom 1. Oktober 1986 (ABl. Nr. C 245 vom 1.10.1986, S. 4).
Die Missachtung der Verpflichtung zur Notifizierung führt damit zur Unanwendbarkeit der betreffenden technischen Vorschriften, die somit gegenüber Dritten nicht durchsetzbar sind.
