    THE EUROPEAN COMMISSION,

    Having regard to the Treaty on the Functioning of the European Union,

    Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (Animal Health Law) 1 , and in particular Articles 213(2), 224(4), 238(3) and 239(3) thereof,

    Having regard to Regulation (EU) 2017/625 of the European Parliament and of the Council of 15 March 2017 on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products, amending Regulations (EC) No 999/2001, (EC) No 396/2005, (EC) No 1069/2009, (EC) No 1107/2009, (EU) No 1151/2012, (EU) No 652/2014, (EU) 2016/429 and (EU) 2016/2031 of the European Parliament and of the Council, Council Regulations (EC) No 1/2005 and (EC) No 1099/2009 and Council Directives 98/58/EC, 1999/74/EC, 2007/43/EC, 2008/119/EC and 2008/120/EC and repealing Regulations (EC) No 854/2004 and (EC) No 882/2004 of the European Parliament and of the Council, Council Directives 89/608/EEC, 89/662/EEC, 90/425/EEC, 91/496/EEC, 96/23/EC, 96/93/EC and 97/78/EC and Council Decision 92/438/EEC (Official Controls Regulation) 2 , and in particular points (a) and (c) of the first paragraph of Article 90 thereof,

    Whereas:

    (1)Regulation (EU) 2016/429 (the ‘Animal Health Law’) lays down rules on animal diseases that are transmissible to animals or to humans, including rules for the animal health certificates required to accompany the entry into the Union and movements within the Union of consignments of aquatic animals and certain products of animal origin from aquatic animals.

    (2)Those requirements are further specified in Commission Delegated Regulations (EU) 2020/990 3 and (EU) 2020/692 4 . Therefore, as this Regulation lays down model official certificates for aquatic animals and products of animal origin from aquatic animals, those requirements should take into account the rules laid down in these Delegated Regulations.

    (3)Article 213(2) of the Animal Health Law empowers the Commission to lay down by means of implementing acts, rules concerning model health certificates for certain movements of aquatic animals, namely movements into disease-free Member States, zones or compartments or into Member States, zones or compartments which are subject to an eradication programme, or authorised movements from a restricted zone which is subject to emergency measures or disease control measures. Article 224(4) of the Animal Health Law sets out similar provisions as regards certain products of animal origin from aquatic animals.

    (4)Article 238(3) of the Animal Health Law empowers the Commission to lay down by means of implementing acts, rules concerning models of animal health certificates, declarations and other documents for the entry into the Union of aquatic animals and Article 239(3) of the Animal Health Law for aquatic animals for which the Union is not the final destination.

    (5)The Official Controls Regulation lays down rules for the performance of official controls and other official activities performed by the competent authorities of the Member States in order to verify compliance with Union legislation in the area of, among others, food safety at all stages of production, processing and distribution, and animal health. That Regulation provides for certain rules on official certification when the rules referred to in its Article 1(2) require the issuance of official certificates.

    (6)In particular, point (a) of the first paragraph of Article 90 of the Official Controls Regulation empowers the Commission to lay down by means of implementing acts, rules concerning model official certificates, for the issuance of such certificates, and on the format and type of these certificates. Point 27 of Article 3 of the Official Controls Regulation provides that ‘official certificate’ means a paper or electronic document signed by the certifying officer and providing assurance concerning compliance with one or more requirements as laid down in the rules referred to in Article 1(2) of that Regulation.

    (7)The rules referred to in Article 1(2) of the Official Controls Regulation include animal health requirements, but also, inter alia, rules in the area of food safety and animal welfare. In the interests of legal clarity, and in order to minimise administrative burden during the issuance of certificates, model official certificates should therefore be considered to contain, where applicable, the relevant animal health certificate for a particular commodity.

    (8)The Official Controls Regulation and the Animal Health Law already provide a number of definitions that apply for the purposes of this Regulation. In addition, this Regulation should also have regard to the definitions laid down in Commission Delegated Regulations (EU) 2020/990, (EU) 2020/691 5 , and (EU) 2020/692.

    (9)Model official certificates for movements within the Union and the entry into the Union of consignments of aquatic animals and certain products of animal origin from aquatic animals should contain details of the consignment and specific health information certified by the competent authorities. In case of movements within the Union, model official certificates should also contain a part designated to record official controls carried out during such movements and at the place of destination, as well as the results of those official controls.

    (10)Model official certificates set out in this Regulation for the movement within the Union of aquatic animals and certain products of animal origin from aquatic animals should be drawn up on the basis of the model official certificates for movement of animals and products in the Union set out in Chapter 1 of Annex I to Commission Implementing Regulation (EU) C(2020)8100 6 .

    (11)Model official certificates for the entry into the Union of aquatic animals set out in this Regulation should be drawn up on the basis of the model official certificates for the entry into the Union of animals, products of animal origin, composite products, germinal products, animal by-products, sprouts for human consumption and seeds intended for the production of sprouts for human consumption set out in Chapter 3 of Annex I to Commission Implementing Regulation (EU) C(2020)8100.

    (12)The Official Controls Regulation provides that consignments of animals and goods are to be accompanied by an official certificate issued either on paper or in electronic form. Therefore, it is appropriate to establish common requirements as regards the issuance of official certificates for aquatic animals and certain products of animal origin from aquatic animals in both forms in addition to the requirements laid down in Chapter VII of Title II of Regulation (EU) 2017/625. These common requirements should be set out in this Regulation.

    (13)The Official Controls Regulation provides that the Information Management System for Official Controls (IMSOC) is to allow for the production, handling and transmission of official certificates, including in electronic form. Commission Implementing Regulation (EU) 2019/1715 7 provide that TRACES is the IMSOC component enabling the entire process of certificate production to be performed electronically, thus preventing possible fraudulent or deceptive practices in respect of the official certificates. To this end, this Regulation should lay down model official certificates that are compatible with TRACES.

    (14)Point (c) of the first paragraph of Article 90 of the Official Controls Regulation empowers the Commission to lay down by means of implementing acts rules concerning the procedures to be followed for the issuance of replacement certificates. Therefore, it is appropriate to establish common requirements as regards replacement of certificates and these common requirements should be set out in this Regulation.

    (15)To avoid misuse and abuse, it is important to define the cases where a replacement certificate may be issued and the requirements that need to be met by such certificates. The cases should be limited to obvious administrative errors, such as in transposed numbers in the container number or seal number, spelling errors in addresses or in product descriptions, or in cases where the initial certificate has been damaged or lost.

    (16)Given that this Regulation lays down model official certificates and a model declaration that replace models laid down in Commission Regulation (EC) No 1251/2008 8 , that Regulation should be repealed.

    (17)It is appropriate to introduce a transitional period of three months to take into account the shipment of consignments of aquatic animals and products of animal origin from aquatic animals accompanied by certificates issued in accordance with models applicable before the date of application of this Regulation.

    (18)As the Animal Health Law applies with effect from 21 April 2021, this Regulation should also apply from that date.

    (19)The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

    HAS ADOPTED THIS REGULATION:

    Article 1

    Subject matter and scope

    1.This Regulation lays down:

    (a)rules for the uniform application of Articles 88 and 89 of Regulation (EU) 2017/625 as regards the signature and issuance of official certificates for movements within the Union and the entry into the Union of consignments of aquatic animals and certain products of animal origin from aquatic animals and the guarantees of reliability for those official certificates;

    (b)requirements for the replacement of the official certificates referred to in point (a).

    2.This Regulation also sets out:

    (a)model official certificates for movements within the Union of consignments of certain categories of aquatic animals and certain products of animal origin from aquatic animals (Annex I);

    (b)model official certificate for the entry into the Union of consignments of certain categories of aquatic animals (Annex II);

    (c)a model declaration accompanying official certificates for transport of consignments of certain aquatic animals entering the Union by sea (Annex III).

    Article 2

    Definitions

    For the purposes of this Regulation, the following definitions shall apply:

    (1)‘official certification’ means the official certification procedure as defined in point (25) of Article 3 of Regulation (EU) 2017/625;

    (2)‘official certificate’ means a paper or electronic document signed by the certifying officer or official veterinarian providing assurance concerning compliance with one or more requirements laid down in the rules referred to in Article 1(2) of Regulation (EU) 2017/625;

    (3)‘competent authorities’ means competent authorities as defined in point (3) of Article 3 of Regulation (EU) 2017/625;

    (4)‘aquatic animals’ means aquatic animals as defined in point (3) of Article 4 of Regulation (EU) 2016/429;

    (5)‘aquaculture’ means aquaculture as defined in point (6) of Article 4 of Regulation (EU) 2016/429;

    (6)‘aquaculture animals’ means any aquatic animals as defined in point (7) of Article 4 of Regulation (EU) 2016/429;

    (7)‘container’ means container as defined in point (1) of Article 2 of Regulation (EU) 2020/990;

    (8)‘well-boat’ means a well-boat as defined in point (2) of Article 2 of Regulation (EU) 2020/990;

    (9)‘fishing bait’ means fishing bait as defined in point (4) of Article 2 of Regulation (EU) 2020/990;

    (10)‘national measures’ means national measures as defined in point (5) of Article 2 of Regulation (EU) 2020/990;

    (11)‘habitat’ means habitat as defined in point (6) of Article 2 of Regulation (EU) 2020/990;

    (12)‘listed third country, territory or zone thereof’ means a third country, territory, zone or compartment as defined in point (1) of Article 2 of Regulation (EU) 2020/692;

    (13)‘disease-free Member State, zone or compartment’ means a Member State, zone or compartment as defined in point (7) of Article 2 of Regulation (EU) 2020/990;

    (14)‘eradication programme’ means a eradication programme as defined in point (8) of Article 2 of Regulation (EU) 2020/990;

    Article 3

    Completion of official certificates for consignments of aquatic animals and products of animal origin from aquatic animals

    1.Official certificates for the movement within the Union of consignments of aquatic animals and consignments of products of animal origin from aquatic animals, set out in Annex I to this Regulation, shall be completed by the operator responsible for consignment or official veterinarian as laid down in Article 4(1) of Implementing Regulation (EU) C(2020)8100.

    2.Official certificates for the entry into the Union of consignments of aquatic animals and consignments of products of animal origin from aquatic animals, set out in Annex II to this Regulation, shall be completed by the operator responsible for consignment or official veterinarian as laid down in Article 4(2) of Implementing Regulation (EU) C(2020)8100.

    Article 4

    Requirements for official certificates referred to in Article 1(2)

    1. Official certificates shall meet the following requirements:

    (a)the certificate shall bear the signature of the certifying officer and the official stamp. The colour of the signature shall be different to the colour of the printing. This requirement also applies to stamps other than those embossed or watermarked;

    (b)where the model official certificate contains multiple or alternative statements, the statements which are not relevant shall be crossed out, initialled and stamped by the certifying officer, or completely removed from the certificate;

    (c)the certificate shall consist of one of the following:

    (i)a single sheet of paper;

    (ii)several sheets of paper where all sheets are indivisible and constitute an integrated whole;

    (iii)a sequence of pages with each page numbered so as to indicate that it is a particular page in a finite sequence;

    (d)where the certificate consists of a sequence of pages as referred to in point (c)(iii), of this paragraph, each page shall bear the unique code referred to in Article 89(1)(a) of Regulation (EU) 2017/625, the signature of the certifying officer and the official stamp;

    (e)the certificate shall accompany the consignment until it reaches the place of destination, or until the border control post where the consignment is subjected to official controls in the case of entry into the Union;

    (f)the certificate shall be issued before the consignment to which it relates leaves the control of the competent authorities issuing the certificate;

    (g)in the case of official certificates for the entry into the Union, the certificate shall be drawn up in the official language, or in one of the official languages, of the Member State of the border control post of first arrival into the Union. 

    2.By way of derogation to point (g) of paragraph, a Member State may consent to official certificates being drawn up in another official language of the Union, and accompanied, if necessary, by an authenticated translation.

    3.Points (a) to (e) of paragraph 1 of this Article do not apply to electronic official certificates issued in accordance with the requirements of Article 39 of Implementing Regulation (EU) 2019/1715.

    4.Points (b), (c) and (d) of paragraph 1 do not apply to official certificates issued in paper and completed in, and printed from, TRACES.

    Article 5

    Replacement official certificates referred to in Article 1(2)

    1.Competent authorities may issue a replacement certificate only in the case of administrative errors in the initial certificate or where the initial certificate has been damaged or lost.

    2.The replacement certificate shall not modify information in the initial certificate concerning the identification of the consignment, its traceability and the guarantees provided for the consignment.

    3.The replacement certificate presented to the competent authorities shall:

    (a)make clear reference to the unique code referred to in Article 89(1)(a) of Regulation (EU) 2017/625 and the date of issue of the initial certificate, and clearly state that it replaces the initial certificate;

    (b)have a new certificate number different to that of the initial certificate;

    (c)carry the date when it was issued, as opposed to the date of issue of the initial certificate;

    (d)be an original document issued in paper, except in the case of electronic replacement certificates submitted in TRACES.

    4.Replacement certificates are not required to be issued when information concerning the consignee, the importer, the entry border control post or the transport details change after the certificate has been issued in the case of entry into the Union. In such cases, the operator responsible for the consignment must inform the competent authority of the Member State of entry accordingly.

    Article 6

    Model official certificates for the movement within the Union of certain categories of aquatic animals and products of animal origin from aquatic animals

    The official certificates referred to in Article 1(2)(a) to be used for the movement within the Union of consignments certain categories of aquatic animals and products of animal origin from aquatic animals shall correspond to one of the following models, depending on the aquatic animals and categories of products concerned:

    (a)AQUA-INTRA-ESTAB drawn up in accordance with the model set out in Chapter 1 of Annex I, for aquatic animals intended for aquaculture establishments;

    (b)AQUA-INTRA-RELEASE drawn up in accordance with the model set out in Chapter 2 of Annex I, for aquatic animals intended for release into the wild;

    (c)AQUA-INTRA-HC drawn up in accordance with the model set out in Chapter 3 of Annex I, for aquatic animals intended for human consumption;

    (d)AQUA-INTRA-RESTRICT drawn up in accordance with the model set out in Chapter 4 of Annex I, for aquatic animals subjected to movement restrictions or emergency measures regarding listed or emerging diseases;

    (e)AQUA-INTRA-BAIT drawn up in accordance with the model set out in Chapter 5 of Annex I, for aquatic animals intended for use as live fishing bait;

    (f)PAO-AQUA-INTRA-PROCESS drawn up in accordance with the model set out in Chapter 6 of Annex I, for products of animal origin from aquaculture animals other than live aquaculture animals, intended for further processing;

    (g)PAO-AQUA-INTRA-RESTRICT drawn up in accordance with the model set out in Chapter 7 of Annex I, for products of animal origin from aquaculture animals other than live aquaculture animals subjected to movement restrictions or emergency measures regarding listed diseases or emerging diseases.

    Article 7

    Model official certificate for the entry into the Union of aquatic animals intended for aquaculture establishments, for release into the wild, or for other purposes, excluding direct human consumption

    The official certificate referred to in Article 1(2)(b) to be used for the entry into the Union of consignments of aquatic animals intended for aquaculture establishments, for release into the wild, or for other purposes, excluding direct human consumption shall correspond to the model AQUA-ENTRY-ESTAB/RELEASE/OTHER drawn up in accordance with the model set out in Annex II.

    Article 8

    Model declaration for the transport of certain aquatic animals entering the Union by sea

    The declaration referred to in Article 1(2)(c) to be used for the transport of certain aquatic animals entering the Union by sea shall correspond to the model addendum AT-AQUA-SEA drawn up in accordance with the model set out in Annex III.

    That addendum shall be completed by the master of the vessel and attached to the relevant official certificate.

    Article 9

    Repeal of Commission Regulation (EC) No 1251/2008

    1.Regulation (EC) No 1251/2008 is repealed with effect from 21 April 2021.

    2.References to the Regulation (EC) No 1251/2008 shall be construed as references to this Regulation and read in accordance with the correlation table in Annex IV.

    Article 10

    Transitional provisions

    Consignments of aquatic animals and products of animal origin from aquatic animals accompanied by official certificates issued in accordance with models applicable before 21 April 2021 shall be accepted for the entry into the Union until 20 July 2021 provided that the certificate was signed before 21 April 2021.

    Article 11

    Entry into force and application

    This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

    It shall apply from 21 April 2021.

    This Regulation shall be binding in its entirety and directly applicable in all Member States.

    In accordance with the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community, and in particular Article 5(4) of the Protocol on Ireland/Northern Ireland in conjunction with Annex 2 to that Protocol, this Regulation applies to and in the United Kingdom in respect of Northern Ireland.

    Part II: Certification

    II. Health information

    I, the undersigned official veterinarian, hereby certify:

    II.1.    According to official information, the aquatic animals in the consignment described in Part I meet the following animal health requirements:

    II.1.1.The aquatic animals do not originate from (1)[an establishment] (1)[a habitat] which is subject to the movement restrictions or the emergency measures referred to in Article 191(2)(b)(i) and (ii) of Regulation (EU) 2016/429 which have been established to control listed diseases for which the species in the consignment is listed, or emerging diseases;

    II.1.2. The aquatic animals:

    (1)either[originate from (1)[an establishment] (1)[a habitat] where there are no increased mortalities with an undetermined cause.]

    (1)or[originate from a part of (1)[an establishment] (1)[a habitat] which is independent of the epidemiological unit where increased mortalities or disease symptoms have occurred, and the Member State of destination (1)[and the Member State(1)[s] of transit] (1)[has] (1)[have] given consent for the movement to occur.]

    (1)[II.2.    Aquaculture animals in the consignment described in Part I meet the following requirements:

    II.2.1.They come from an aquaculture establishment which is (1)[registered in accordance with Article 173 of Regulation (EU) 2016/429] (1)[approved in accordance with Article 176 or Article 177 of Regulation (EU) 2016/429] where mortality records, movement records and health and production records are regularly updated and a documentary check on those records has been carried out within a period of 72 hours prior to the time of departure and has not indicated any cause for concern;

    II.2.2.The aquaculture animals:

    (1)either[have undergone a clinical inspection and where relevant, a clinical examination in accordance with Article 15(1)(b) of Commission Delegated Regulation (EU) 2020/990 carried out within a period of 72 hours prior to the time of departure and have not shown symptoms of relevant listed diseases or emerging diseases.]

    (1)or[are eggs or molluscs which do not require a clinical inspection within a period of 72 hours prior to departure as they are subject to derogation laid down in Article 15(2) of Commission Delegated Regulation (EU) 2020/990.]

    (1)or[do not require a clinical inspection within a period of 72 hours prior to the time of departure as they are subject to the derogation laid down in Article 16(1) of Commission Delegated Regulation (EU) 2020/990.]

    (c)    molluscs which are packaged and labelled for human consumption in accordance with the specific requirements for those animals as set out in Sections VII and VIII of Annex III to Regulation (EC) No 853/2004 and which are intended for further processing without temporary storage at the place of processing.

    II.1.    According to official information, the aquatic animals in the consignment described in Part I meet the following animal health requirements:

    II.1.1.    The aquatic animals do not originate from (1)[an establishment] (1)[a habitat] which is subject to the movement restrictions or the emergency measures referred to in Article 191(2)(b)(i) and (ii) of Regulation (EU) 2016/429 which have been established to control listed diseases for which the species in the consignment is listed, or emerging diseases.

    I, the undersigned official veterinarian, hereby certify:

    II.1.    According to official information, the aquatic animals referred to in Box I.27 of Part I meet the following animal health requirements:

    II.1.1.    The aquatic animals originate from (1)[an establishment] (1)[a habitat] which is not subject to national restriction measures for animal health reasons or because of the occurrence of abnormal mortalities with an undetermined cause, including the relevant listed diseases referred to in Annex I to Commission Delegated Regulation (EU) 2020/692 and emerging diseases.

    II.1.2.    The aquatic animals are not intended to be killed under a national programme for the eradication of diseases, including the relevant listed diseases referred to in Annex I to Commission Delegated Regulation (EU) 2020/692 and emerging diseases.

     (1)[II.2.    The aquaculture animals referred to in Box I.27 of Part I meet the following requirements:

    II.2.1.     They come from an aquaculture establishment which is (1)[registered] (1)[approved] by, and under the control of, the competent authority of the third country or territory of origin and has a system in place to maintain and to keep for at least 3 years, up-to-date records containing information regarding:

    (I)the species, categories and number of aquaculture animals on the aquaculture establishment;

    (II)movements of aquatic animals into, and aquaculture animals out of, the aquaculture establishment;

    (III)mortality in the aquaculture establishment.

    II.2.2.     They come from an aquaculture establishment which receives regular animal health visits from a veterinarian for the purpose of the detection of, and information on, signs indicative of the relevant listed diseases referred to in Annex I to Commission Delegated Regulation (EU) 2020/692 and of emerging diseases, at a frequency that is proportionate to the risk posed by the aquaculture establishment.]

    II.3. General health requirements

    The aquatic animals referred to in Box I.27 of Part I meet the following animal health requirements:

    II.3.1.    The aquatic animals originate from a (1)[country] (1)[territory], (1)[zone] (1)[compartment] with (2)code: __ __ - __ which, at the date of issuing this certificate is listed in Part 1 of Annex XX to Commission Implementing Regulation (EU) 2020/… [SANTE/7140/2020] for the entry into the Union of aquatic animals of the species referred to in Part I of that Annex.

    II.3.2.    They have undergone clinical inspection by an official veterinarian within a period of 72 hours prior to the time of loading. During the inspection, the aquatic animals showed no clinical symptoms of transmissible disease and, according to the relevant records of the aquaculture establishment, there was no indication of disease problems.

    II.3.3.    They will be dispatched directly from the establishment of origin to the Union.

    II.3.4.    They have not been in contact with aquatic animals of a lower health status.

    II.6.    Transport requirements

    Arrangements have been made to transport the aquatic animals referred to in Box I.27 of Part I in accordance with the provisions laid down in Articles 167 and 168 of Commission Delegated Regulation (EU) 2020/692 and specifically that:

    II.6.1.    the aquatic animals are dispatched directly from the establishment of origin to the Union and are not unloaded, moved to another means of transport or unloaded from their container when transported by air, sea, railway or by road;

    II.6.2.    the water in which they are transported is not changed in a third country or territory, zone or compartment which is not listed for entry of the particular species and category of aquatic animals into the Union;

    II.6.3.    the animals are not transported under conditions that jeopardise their health status, in particular:

    (i)    when the animals are transported in water, it does not alter their health status;

    (ii)    the means of transport and the containers are constructed in such a way that the health status of the aquatic animals is not jeopardised during transportation;

    (iii)    the (1)[container] (1)[well boat] is previously unused or cleaned and disinfected, in accordance with a protocol and with products approved by the competent authority of the (1)[third country] (1)[territory] of origin, prior to loading for dispatch to the Union;

    II.6.4.    from the time of loading at the establishment of origin until the time of arrival in the Union, the animals in the consignment are not transported in the same water or (1) [container] (1) [well-boat] together with aquatic animals which are of a lower health status or which are not intended for entry into the Union;

    II.6.5.    where a water exchange is necessary in a (1) [third country] (1) [territory] (1) [zone] (1) [compartment] which is listed for entry of the particular species and category of aquatic animals into the Union, it only occurs (1)[in the case of transport on land, at water exchange points approved by the competent authority of the (1) [third country] (1) [territory] where the water exchange takes place] (1)[in the case of transport by well-boat, at a distance which is at least 10 km from any aquaculture establishments which are located en-route from the place of origin to the place of destination in the Union].

    II.7.    Labelling requirements

    Arrangements have been made to identify and label the (1) [means of transport] (1)[containers] in accordance with Articles 169(1) and 169(2) of Commission Delegated Regulation (EU) 2020/692 and specifically that:

    II.7.1.    the consignment is identified by (1)[a legible and visible label on the exterior of the container] (1)[an entry in the ships manifest when transported by well boat,] which clearly links the consignment to this official certificate;

    II.7.2.    the legible and visible label will contain at least the following information:

    (a)    the number of containers in the consignment;

    (b)    the name of the species present in each container;

    (c)    the number of animals in each container for each of the species present;

    (d)    the purpose for which the animals are intended.

    II.8.    Validity of official certificate

    This official certificate is valid for a period of 10 days from the date of issuing. In the case of transport by waterway/sea of aquatic animals, this period of 10 days may be extended by the duration of the journey by waterway/sea.

    Notes

    ‘Aquatic animals’ are animals as defined in point (3) of Article 4 of Regulation (EU) 2016/429. ‘Aquaculture animals’ are aquatic animals which are subject to aquaculture as defined in point (7) of Article 4 of Regulation (EU) 2016/429.

    This certificate is intended for entry into the Union of aquatic animals for the purposes indicated in its title, including when the Union is not the final destination of those animals.

    This model certificate does not apply to the entry into the Union of aquatic animals intended for direct human consumption including those animals which are intended for the following aquaculture establishments (i) a disease control aquatic food establishment as defined in point (52) of Article 4 of Regulation (EU) 2016/429, or (ii) a dispatch centre as defined in point (3) of Article 2 of Commission Delegated Regulation (EU) 2020/691. Model certificates for the entry into the Union of aquatic animals intended for those purposes are set out in Chapter 28 (MODELFISH-CRUST-HC) and Chapter 31 (MODEL MOL-HC) of Commission Implementing Regulation (EU) C(2020)8100. This certificate does apply to the entry into the Union of live aquatic animals intended for all other aquaculture establishments including purification centres and relaying areas.

    The guidance on the completion of this official certificate available in Chapter 4 of Annex I to Commission Implementing Regulation (EU) C(2020)8100 shall be followed accordingly.
